Cabarita Beach Hotel Motel Bridal Expo SUMMARY OF REPORT:
The Cabarita Beach Hotel Motel has requested use of the grassed area fronting the hotel on Sunday 28 April 2002 to erect a marquee to stage a bridal expo.
RECOMMENDATION:
That the Trust:-
1. Consents to the Department of Land and Water Conservation providing owners consent to the lodging of a development application for a bridal expo on 28 April on that section of reserve 1001008 shown on figure one of this report;
2. Issues the Cabarita Beach Hotel Motel with a temporary licence under the provisions of Section 108 of the Crown Lands Act, 1989 for a bridal expo on 28 April 2002 for that section of Crown Reserve 1001008 as shown in figure one of this report.

REPORT:
The Cabarita Beach Hotel Motel has requested use of the grassed area fronting the hotel on Sunday 28 April 2002 to erect a marquee to stage a bridal expo.
This area is part of Crown Reserve 1001008 the single coastal reserve (figure 1) zoned 6a under the Tweed LEP 2000.
Clause 12 of the LEP states:
“12 Temporary development of land (1) Objective
• To enable the temporary development of land for a purpose that would otherwise be prohibited in the zone.
(2) Consent may be granted to development (other than designated development) for any purpose that is elsewhere prohibited by a provision of this plan for a maximum period of 14 days, whether consecutive or not, in any one year”
Subsequently, under clause 12, the applicant may be granted consent subject to lodgement of a development application. The Department of Land and Water Conservation require the consent of the Trust prior to providing owner’s consent to the development application.

(a) Reconsider its recommendations on the Draft Development Control Plan Number 46 and the related Plan of Management drafted by the Department of Land and Water Conservation (as the Trust considers that the currently recommended maximum levels of development may not be soundly based on development viability.
(b) Engage the consultant who valued the property previously to undertake a study of the development potential of the site.”

That the Trust:
1. Subject to a satisfactory submission, engages a suitable consultant to undertake the evaluation of development viability of Lot 490 DP 47021 Reserve 1002202 (former Tourism NSW site) South Kingscliff.
2. Considers the results of the consultant’s report for potential amendments to the Draft Development Control Plan and Draft Plan of Management – the latter, in that event, to be submitted to the NSW Minister for Land and Water Conservation.
3. Acknowledges that, if such amendments are determined, that another public exhibition will occur of the Draft Development Control Plan and Draft Plan of Management.
