Flooding
The regulation proposal may not contain provisions that apply to areas between the flood zone of planning and. probable maximum flood subject to special flood considerations which:. a) to allow construction in flooded areas. For the purposes of preparing a planning proposal, the flood-planned area must comply with the principles of the 2005 Flood Area Development Manual or otherwise determined by a study or flood risk management plan adopted by the competent council. A planning proposal may only be inconsistent with this direction if the authority responsible for the planning proposal can satisfy the Planning Secretary (or his designee) that: a) the planning proposal is consistent with a floodplain management study or plan adopted by it appropriate council in accordance with the principles and guidelines of the Floodplain Development Manual 2005, or. b) if there is no flood risk management plan or study adopted by the council, the regulation proposal is consistent with the flood study adopted by the council, prepared in accordance with the principles of the Manual for the Development of Flood Areas 2005 or c) the planning proposal is supported by a flood impact and risk assessment undertaken by the relevant planning authority and is prepared in accordance with the principles of the Floodplain Development Manual 2005 and in accordance with the requirements of the relevant planning authorities, or. d) the provisions of the planning plan, which are inconsistent, are of lesser importance than determined by the competent planning authority. a) “floodplain”, “flood storage”, “floodway” and “high hazard” have the same meaning as in the 2005 Floodplain Development Manual.

NSW Department of Planning and Environment | 46 Note: Under section 10(2) of the Coastal Management Act 2016, no provision of the LEP defining a coastal management area (or part of such area) may be made without the recommendation of the Minister administering the Coastal Management Act 2016. Planning for Bushfire Protection
For a planning proposal to contravene the terms of this directive, the relevant planning authority must satisfy the Secretary for Planning (or an officer of the Department appointed by the Secretary) that the council has obtained written advice from the NSW Rural Commissioner Fire Service that, notwithstanding the non-compliance, the NSW Rural Fire Service has no objection to the progress of the planning proposal.

The goals of this course are: a) mitigating the significant impacts of short-term rental accommodation where the period of short-term rental accommodation needs to be shortened, and. b) ensure that the impacts of short-term rental accommodation and community views are taken into account. This guidance applies to Byron Shire Council when the council makes a planning proposal to determine or reduce the number of days on which non-guest short-term rental accommodation can be operated in parts of its local government area. Note: Section 137A of the Management of Strata Schemes Act 2015 provides that a by-law made by special resolution of the owners' association may prohibit the use of a plot for the purposes of a short-term rental.
