The objectives of the Faculty of Law are:-. a) provide courses that meet the needs of the legal profession, taking into account the requirements of the Bar Association and the Bar Association; The Faculty of Law is housed on Levels 6 and 7 (the two highest floors) of 'V' Block, a new building in the heart of the campus.

Responsibility for Conduct of Examinations

The supervisor may prescribe the form to be submitted by students intending to take the departmental examination and prescribe the deadline by which they must submit it to him. At the discretion of the Registrar or Head of Division, as the case may be, a form required to be filed under these rules may be accepted after the date prescribed for filing, subject to payment of any fee prescribed for late filing.

The Head of School may forward the application to the relevant Chief Examiner who, in consultation with the relevant examiner or examiners, will consider the information contained as they see fit in deciding the result to be recommended for the candidate in the subject concerned.

The Academic Council will classify each result in terms of the grading of pass as wet in Part VI I of these rules. The responsible Head of Department will send a list of the final results of each candidate enrolled for that course and nominated for the examination to the relevant Academic Council. Except in the case where the Academic Council responsible for the course has decided that further assessment is desirable before the publication of a final result, the student will be given the opportunity to submit reasons to the Registrar why the result should not be withheld not.

The Academic Board responsible for the course in which the student is enrolled must notify the Registrar of the final result no later than two weeks (or six weeks with the approval of the Academic Board) after the start of the following semester. The results may be published by the Head of the Department offering the course, subject to the approval of the Academic Committee controlling the course, or of the Committee of the Board where the authority has been delegated under section 40. Non-registered students must apply for enrollment each year and their applications may be accepted or rejected by the Registrar on the recommendation of the appropriate department head.

An Academic Council may appoint a Committee of the Academic Council to make recommendations to the Academic Council. Subject to the overall control of the Director and the Institute Board, the Chief Librarian shall:-.

Union Fees means such fees as may be prescribed by the Council for Membership of the Queensland Institute of Technology Union. A student must pay only one deposit regardless of the number of such subjects included in an enrolment. All full-time or part-time members of the teaching staff (and those with academically equivalent salaries including principals, vice-principals and heads of school) must have a permit.

Equipment is available for their use in the Library, while most of the materials can be borrowed. Reader education: The library staff, in collaboration with academic staff, provides training in the use of the library and non-fiction. Saturday & Sunday From the last week of lectures until the end of the exam.

Student union cards will be issued at the start of the academic year upon production of QIT enrollment statement. Since the establishment of the Union there has been a gradual increase in the number of clubs and associations.

ENTRANCE REQUIREMENTS

Registration - Enrolment

In the case of a Non-Law elective or of Introductory Accounting, a student registered for a full-time course or for a part-time internal course must meet the enrollment requirements of the School of Business Studies. In the case of a Non-Law elective or of Introductory Accounting, a student registered for a full-time course or for a part-time internal course must meet the attendance and assessment requirements of the School of Business Studies. In the case of a subject which is the equivalent of a non-law elective or of introductory accounting, or, as regards James Cook University, in the case of a subject which is the equivalent of Introduction to Law or of Criminal Law and Procedure , a student registered for an external course must meet the attendance and assessment requirements of the approved tertiary institution or institutions. a) Each student must make a proper effort to complete the assignments (including moots, reports of court proceedings and other practical work) set out in each Law subject for which he or she is enrolled.

In the case of a non-legal elective or of Introductory Accounting, a student enrolled in a full-time degree program or in a part-time internal course must meet the assignment requirements of the School of Business Studies. In the case of a subject which is the equivalent of a non-legal elective or of Introductory Accounting, or, in the case of James Cook University, in the case of a subject which is the equivalent of Introduction to Law or of Criminal Law and Procedure a student enrolled in an external course must meet the assignment and practice requirements of the recognized tertiary institution(s). In the case of a subject covering one semester, there will normally be one formal examination at the end of the semester, worth 75 percent. of the total number of points for that subject.

For a non-legal elective or Introductory Accounting, a student enrolled in a full-time program or a part-time internal program must meet the examination requirements of the School of Business Studies. In the case of a subject which is the equivalent of a non-legal elective or of Introductory Accounting, or, in the case of James Cook University, in the case of a subject which is the equivalent of Introduction to Law or of Criminal Law and Procedure a student who is registered for an external course must meet the examination requirements of the recognized tertiary institution(s).

Passes

To gain a pass in a subject which is equivalent to a non-law or introductory accountancy elective or, in relation to James Cook University, in a subject which is equivalent to Introduction to Law or Criminal Law and Procedure, a student of registered for an external course must meet the requirements of the approved tertiary institution or institutions. Each student should have his or her own copy of each of the books described, although a number of copies of each will be kept in the Law School Library. Students should not purchase their own copy of the recommended reference books, but should, when necessary, consult the copy or copies on file in the Law School Library.

The Crown and its immunities and privileges will be studied, as well as the responsibility of the Crown, servants of the Crown and public authorities. There will be a detailed examination of the remedies available against administrative bodies, such as declaration, injunction, mandamus, injunction, certiorari and habeas corpus. It begins with a brief review of the various types of personal property recognized in the Australian legal system.

In twenty hours of lectures, the wider context of the operation of the criminal law will be taken into account. It should be noted that the students' knowledge of substantive law will be assumed throughout the course.

Part II The Burden and Standard of Proof (a) The burden of proof

The law of evidence is concerned with the rules and principles relating to the presentation and proof of facts to a Court. Litigation largely involves the application of substantive law to the facts determined according to the rules of evidence. Broadly, the course will examine the following questions: Who is obliged or entitled to present and prove the facts at issue in a case.

And what limitations are placed on the type and amount of evidence accepted by a court. However, several important statutes exist that have a significant impact on procedural issues and this legislation, particularly the Evidence Act (Queensland), will be closely scrutinized. In addition to the technical rules covered in the course, students will be encouraged to view the principles in the context of the opponent system and recognize the problems of applying rigid rules within that system.

Part IV Admissibility of Evidence (a) Documentary evidence

Introduction Definition of contract law; overview of legal remedies in Contract Law; unenforceable, voidable, void and illegal contracts in broad terms. The course in this subject deals with the legal principles of the tax system in Australia. The residence of the taxpayer (and double taxation agreements with foreign nations). v) The derivation of income (both in relation to place of derivation and time of derivation). vi) Income from personal effort.

This is not simply a copy of the lecture notes in the subject, but has been specially prepared for external students. A good knowledge of the nominated cases in itself is not enough to ensure a pass in the subject.
