THE SUPREME COURT ACTS AMENDMENT (RULES RATIFICATION)

ACT of 1928 19 Geo. 5 No. 3

[Reprinted as at 1 September, 1984]

An Act to Declare the Validity of Rules of Court Made or Purporting to have been Made under "The Judicature Act" and "The Supreme Court Act of 1921," and to confirm and Validate Certain Orders of the Supreme Court Made pursuant to such Rules of Court; and for other purposes

[ASSENTED TO 4 OCTOBER, 1928]

BE IT ENACTED by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:-

1. Short title and construction of Act. This Act may be cited as

"The Supreme Court Acts Amendment (Rules Ratification) Act of 1928,"

and shall be read as one with "The Supreme Court Act of 1921," herein referred to as the Principal Act.

2. (1) Ratification of Rules of Court. Notwithstanding anything contained in any Act or judgment to the contrary, it is hereby declared that all Rules of Court existing at the passing of this Act and made or purporting to have been made under "The Judicature Act" or the Principal Act are and have always been and shall be valid and binding Rules of Court under and for the purposes of such Acts, and are hereby approved, ratified, and confirmed; and such Rules of Court are and have always been and shall be so valid and binding until the same or any of them are rescinded, amended, varied, or added to pursuant to the powers and authorities contained in the Principal Act.

(2) Rules of Court to have same force and effect as Principal Act.

It is hereby declared that all such existing Rules of Court and any Rules of Court hereafter made pursuant to the powers and authorities contained in the Principal Act shall be of the same authority, force, and effect as if they formed part of the Principal Act, and shall be judicially noticed, and shall not be questioned in any legal proceedings whatever.

3. Ratification of certain Orders. It is hereby declared that any order made or purporting to be made before the passing of this Act pursuant to Order sixty-nine and the Rules thereunder of the said Rules of Court (which said Order and Rules thereunder are hereby declared

by this Act to be and to have always been valid and binding, and duly approved, ratified, and confirmed) shall be deemed to be and to have been validly and duly made, and any such order is hereby ratified and confirmed, subject however to any variation which may hereafter be made pursuant to the said Order and the Rules thereunder.
