5. ~nterpre~at~on. In these regulations the terms used shall have the meanings respectively assigned to them by section 6 of this Act and unless the contrary intention appears-
“accounting standards” means the Aboriginal and Islander Accounting Standards published under regulation 1 8A;

“elector” means an elector named as such in an electoral roll compiled pursuant to the Elections Act 1983 and enrolled on a voter’s roll compiled pursuant to this Act;
“clerk” means the person appointed by an Island Council to act as the clerk of the council. The term includes the person for the time being performing the duties of the clerk;
“fine option order” has the same meaning the term has pursuant to the Ofenders Probation and Parole Act 1980-1983;
“manual” in relation to the financial administration procedures of an Island Council means the administration and financial procedures manual produced by the Council pursuant to regulation 18A;
“rules for the conduct of elections” means the rules for the conduct of elections contained in the Third Schedule of the Local Government Act 1936-1 984;
“secretary” means the person appointed by the Island Co- ordinating Council to act as secretary of the Island Co- ordinating Council;
“the Act” means the Community Services (Torres Strait) Act 1 984- 1990.

6. Election of members of councils. (1) Subject to these regulations, the franchise for elections of Island Councils, the conduct of elections, the filling of casual vacancies and the election of members of those councils shall with all necessary adaptations be in accordance with the provisions of-
(a) subsections (2A), 7) (i), (7) (iii), (7) (iv), and (9) of section (b) the rules contained in the Third Schedule to the Local Government Act 1936-1984, other than rules 5, 6, 13, 19, 21A, 22 (1) (a) of Subdivision I, rule 36 of Subdivision 11, and Subdivision 111; and

as being a reference to an Island Council; and
(b) a reference in rules 2, 12 and 14 of the rules for the conduct of elections to the Governor in Council shall be construed as being a reference to the Minister.
(3) A person who contravenes a provision of the Local Government Act 1936-1984 which has application pursuant to subregulation (1) shall be liable to a penalty-
(a) where the penalty prescribed by that Act is $200 or less, Loca

7. Composition of Island Council. (1) Subject to subregulation (1 A), the Island Councils set out in Column 1 of the First Schedule shall be composed of the number of members set out in Column 2 of the First Schedule opposite the respective Council.
(lA)(a) An Island Council may pass a resolution, or the electors in a trust area may forward a petition to the Minister, requesting the Minister to approve the resolution or petition which seeks-
(i) to alter the number of members constituting the Council to a number which is not less than 3 which number, in the case of a resolution, is to be specified in the resolution;
or
(ii) to require the chairman of the Council to be elected by the electors of the trust area;
or
subregulation.
(iii) the matters referred to in both paragraphs (i) and (ii) of this (b) The Council must take all reasonable steps to immediately disclose or otherwise inform electors in the trust area of the content and nature of such a resolution and shall notify electors of a date not less than 14 days after the passing of the resolution by which objections in writing to the referral of the resolution to the Minister may be made to the clerk.
(c) After considering all objections duly made to the passing of the resolution, the chairman is to cause a copy of the resolution to be submitted to the Minister so that the Minister will receive the copy no less than 60 days before the next triennial election of the Council.
The copy of the resolution must be accompanied by-
(i) a certificate of the chairman and the clerk that the provisions (ii) all objections to the passing of the resolution that were duly

(h) If the effect of such a resolution or petition is published in the Gazette, the electors of the area concerned, voting to elect the Island Council, are entitled to vote at the next triennial election for the number of members, or for the chairman, of the Council or both, as published in the Gazette.
A Council so elected will be composed of that number of members (including the chairman) and a chairman so elected will hold office, subject to these regulations, until the conclusion of the next triennial election of that Council.
(i) At any such election a person can not be qualified to be a candidate for the office of chairman and also for the office of an ordinary member of a Council.
(2) The members of an Island Council shall be elected by the electors of the area.
(3) The members present at the first meeting of the Council after each triennial election or other election under this Act or at some adjournment of such meeting must-
(a) where no provision has been made pursuant to subregulation (1A) for the election of a chairman by the electors of the area, appoint one of their number to be the chairman;
and
(b) appoint one of their number to be the deputy chairman;
to hold such office, subject to these regulations, until the conclusion of the next triennial election.
(4) When no provision has been made pursuant to subregulation (1A) for the election of a chairman by the electors of the area, until a chairman or deputy chairman is appointed pursuant to subregulation (3), the clerk shall preside at the meeting referred to in subregulation (3) and at all adjournments thereof until a chairman or deputy chairman has been appointed and while so presiding shall have and may exercise

all the powers and authorities of the chairman other than the right to vote.
(5) Where 21 days after the day appointed for the holding of the first meeting of the Council after the conclusion of the triennial election have elapsed and no appointment of a member to be chairman or deputy chairman has been made, the Minister may by notice in writing to the Council appoint a member to be chairman or deputy chairman and the member so appointed shall be deemed to have been duly appointed by the members of the Council.
(6) A member appointed to be chairman or deputy chairman pursuant to subregulation (5) shall, subect to these regulations, hold office until the conclusion of the next triennial election.
(7) Subject to subregulations (1A) and

(a) has resided continuously in the area for not less than 24 (b) is enrolled on the voters roll;
(c) is not under a disability specified in subregulation (2), months prior to the nomination day for an election;
shall be qualified to be nominated as a candidate and to be elected as a member of the Island Council for that area.
(2) No Islander or Aborigine who-
(a) is undergoing a sentence of imprisonment, whether or not the execution of such sentence has been suspended under section 656 of The Criminal Code;
(b) is made bankrupt or otherwise takes advantage of the laws relating to bankruptcy in force for the time being relating to bankrupt or insolvent debtors;
or

9. Nomination of candidate. (1) In order that any person may be (a) be nominated in writing by not less than 2 electors in the
area in which he proposes to be or become a candidate;
(b) consent in writing to such nomination;

1. Vacancy. (1) For the purpose of this regulation, a “qualified person” is a person entitled to qualify to be nominated as a candidate under regulation 8( 1).
(2) When a vacancy arises in the office of a member of an Island Council-
(a) within 2 years after his election thereto-an election shall be held in accordance with these regulations to fill the vacancy;
(b) other than in paragraph (a)-the Island Council shall, at a special meeting called for the purpose within 2 weeks of the occurrence of the vacancy, appoint a qualified person to be a member.
(3) An election held pursuant to this regulation shall be held on a day, other than a Sunday, appointed by the returning officer within 2 months of the occurrence of the vacancy.
(4) If after the expiration of the time allowed for the nomination of a person to fill a vacancy, no qualified person has nominated to fill

such vacancy, the Island Council may appoint a qualified person to 6 1 such vacancy.
(5) A person elected or appointed to fill any vacancy shall, subject to this Act, hold office for the remainder of the period for which his predecessor was elected or appointed.
12. Vacating office of member. The office of a member of an Island Council shall become vacant if-
(a) he dies or his term of office expires;
(b) he resigns from office;
(c) he ceases to possess all the qualifications of a member of a council;
(d) he is absent, without leave of the council, from 3 consecutive meetings of the council of which notice has been duly given to him personally, or by post;
(e) he is a patient within the meaning of the Mental Health

15. ~ p p o i n t m e ~ t of clerk. An Island Council from time to time shall appoint a person being, wherever practicable, an Islander resident of the area governed by it, to be the clerk of the Island Council to assist in the proper exercise of its powers and discharge of its functions.

s. (1) In the exercise and performance of its functions the Island Co-ordinating Council shall establish and unde

(c) a Trust Fund;
(d) an Enterprise Fund.
(2) The Funds shall be separate and distinct and a separate and distinct bank account shall be kept for each Fund.
(3) There shall be paid into each Fund all moneys received by the Island Co-ordinating Council for the purpose for which the Fund is established.

The Minister, after consulting with the Auditor-General may from time to time publish amendments to the accounting standards, which amendments will take effect on the date of that publication.
(2) Every Island Council, after consulting with the Auditor-General or a person appointed by the Auditor-General under section 30C of the Act, must produce an administration and financial procedures manual by the 31st December, 1992.
The manual must set out accounting and financial procedures which, by force of this regulation, will apply to the administration of the Council’s finances after those procedures take effect.
(3) The manual will take effect upon the signing of a certificate for that purpose by the chairman.

(4) The manual may be amended from time to time and the amended portion of the manual will take effect on the signing of a certificate for that purpose by the chairman.
(5) The manual must not be inconsistent with the accounting standards, and the manual is to the extent of any inconsistency with the standards, invalid.
19. State ~ o v e r n m ~ n t Financ~al Fund. (1) The State Government Financial Aid Fund shall consist moneys received in respect of financial aid pursuant to section 82 of this Act or any other moneys appropriated by Parliament to the Council.
(2) The moneys in the State Government Financial Aid Fund shall for the purpose for which such moneys are received.

(1) Subject to this Act, the procedures for and the enforcement of decisions of an Island Court shall be-
(a) where but for this Act an action would be brought in the State pursuant to the provisions of the Justices Act 1886- 1982, in accordance with the provisions of that Act;

where but for this Act an action would be brought in the State pursuant to the provisions of the Magistrates Courts Act 1921-1982, in accordance with the provisions of that Act.
Island Council may from time to time appoint an Islander resident of an area governed by it to be a clerk of the Island Court for the area for which the court is constituted.
(3) For the purpose of the application of the Acts referred to in (a) a reference therein to a Magistrates Court, shall be construed
as being a reference to an Island Court;
(b) a reference therein to a Stipendiary Magistrate, shall be construed as being a reference to the two justices who constitute an Island Court;
(c) a reference therein to a clerk of the court, shall be construed as being a reference to a clerk of an Island Court.

26. ~ ~ a ~ r ~ a n and uty c ~ a i r ~ a n . (1) At the first meeting of the newly elected Island Co-ordinating Council the members present shall elect a chairman and a deputy chairman from their number.
(2) The office of chairman or deputy chairman of the Island Co- ordinating Council shall become vacant if the person elected to the position-
(a) resigns as chairman or deputy chairman; or

24. ees. (1) A person who contravenes or fails to comply with any provision of these regulations commits an offence against these regulations.
(2) A person who-
(a) fails to do that which he is directed to do;
(b) does that which he is forbidden to do, by a person acting under the authority of these regulations,
commits an offence against these regulations.
(3) Save where a specific penalty is otherwise prescribed a person who commits an offence against these regulations is liable to a penalty of $200.
