1. INTRODUCTION

Qualifications and experience 1.1 My full name is David Patrick Wilson.

1.2 My qualifications and experience are set out in section one of my Statement of Evidence dated 29 October 3013.

1.3 I have read the Code of Conduct for Expert Witnesses contained in the Environment Court Practice Note and agree to comply with it. I confirm that this supplementary evidence is written within my area of expertise, except where otherwise stated, and that I have not omitted to consider material facts known to me that might alter or detract from the opinions expressed.

2. RESPONSE TO SUPPLEMENTARY EVIDENCE OF MR LEY 2.1 In this brief, I have replied to matters raised by Mr Dugald Ley in his

supplementary evidence titled "Information and Comment from Hearing the Applicant's Evidence".

Paragraph 4

2.2 I understand that the proposed upstream diversion is programed for 2025 and that there are no improvements proposed within 200m of the culvert outlet. Therefore the culvert will remain outlet controlled for the foreseeable future.

Paragraph 7

2.3 At paragraph 7 Mr Ley refers to discussions had with Council Hydrologists, and makes the statement that the peak one hour rainfall intensity during the December 2011 storm was only 14 mm/hr which is less than an annual event. From this he infers that the photographs show the stream was not coping under this less than annual event.

Having analysed the December 2011 rainfall information provided to me by Tasman District Council Hydrologist Matt McLarin on 2 October 2013 (attached), I note that the event occurred over three days and the rainfall total that fell on the catchment was greater than the 1%

AEP event.

2.4 The photo Mr Ley attached to his statement was taken around 19:30 on 14 December 2011 (approximately 26 hours through the December 2011 event). The total rainfall for the previous 24 hours was 201 mm, which is greater than the 191mm predicted for a 1% AEP event. It is my opinion that this shows the catchment was responding to a significantly larger event than the annual event and the observed water levels shown are not as a result of a less than annual event.

2.5 I understand that during the December 2011 event, throughout Richmond upstream water ways became blocked with debris and slips, which I believe may have resulted in storm water runoff discharging in unexpected directions. So although Mr Ley is correct in saying that the peak one hour rainfall intensity for the December 2011 event was 14 mm/hr, it is not valid to say the resulting water levels are a less than annual event.

2.6 As per paragraph 5.16 of my evidence, I can confirm that the hydraulic modelling of the water levels in the drain ignores any benefit of the attenuation provided by the proposed rain gardens. The hydraulic model conservatively assumed that the rain gardens would be full.

Paragraphs 8-12

2.7 Details of the outfall configuration and alignment will be provided with any future Discharge Consent Application.

Paragraph 13

2.8 None of the analysis completed to date would indicate any benefit in having the outfall from the site downstream of the culvert outlet.

2.9 Regardless this matter would have to be considered in any Resource Consent application as Tasman Resource Management Plan rule 36.4.2.3 (4) states that Council has restricted the exercise of its discretion to (amongst other matters) the nature, design and location of outlet structures.
