ABSTRACT
Indonesia consumer has waited the presence of Act No.8 of 1999 on Consumer Protection for long time. Problems that have been faced by the consumers too complex. Conflict, dispute, and loss; which faced by the consumers ac a result of producer act which is unreliable and have no intention to the consumer interest and safety, on the goods/services which were produced or offered; should be noticed by the government. Government as public servant, which its duty to prosperity of its people, bear the big responsibility for the consumer protection. To execute its duty and function, government has competence and freedom to take action or policy which is considered need and urgent to anticipate the existing problem which is related to the consumer protection. Act No.8 of 1999 on Consumer Protection stipulate that local Government has the competence to settle the dispute faced by the consumer in its territory.
The research was done to answer the question about the competence of Medan Municipality Government in consumer protection and its role to settle the dispute for the loosed. Approach, which has been used in this research, is sociological juridical and normative juridical approach and supported by primary and secondary data. Primary data was collected by interview and questionnaire, from the consumer sample the amount of 20 peoples of Medan Baru sub-district, which is taken by purposive. Secondary data was collected by study of literature to bibliography material.
The research show that the Act No.8 of 1999 on Consumer Protection tittle 49 given to local government competence to constitute a consumer settlement of dispute board in territory of regency/city, but could not be realized yet. From all of the respondents give the answer that the institution or board is really needed. Effort which done by Government of Medan Municipality to elucidate Act no.8 of 1999 on Consumer Protection, based on the people judgement, has not optimum yet. The government of Medan Municipality has been tried to establish the consumer settlement of dispute board to meet the people demand. The Government of Medan Municipality faced some obstacles such as inappropriate of the consumer settlement
of dispute board form or type to the form or type of the central government. A regulation which gives a law certainty and legal protection on all activities related to the consumer transaction is an unconditional matter. This research show that 100 ')/o of the producer respondent supported the presence of Act No.8 of 1999 on Consumer Protection. One of the appropriate efforts to solve the existing problem between the producer and the consumer which is the consumer settlement of dispute board, compare with the settlement of dispute through the existing official court. The hope of consumer and producer on the presence of the consumer settlement of dispute board could be urging by the consumer loss case which appear and bring to the court, not all of it could be settle quickly, inexpensive and simple.

Tentang Perlindungan Konsumen merupakan hal yang ditunggu-tunggu konsumen Indonesia selama ini. Permasalahan yang dihadapi konsumen sangat kompleks. Persengketaan, perselisihan dan kerugian yang dialami oleh konsumen sebagai akibat dari perbuatan produsen yang tidak bertanggung jawab dan tidak memperhatikan kepentingan dan keselamatan konsumen terhadap barang/jasa y ang diproduksi/ditawarkan sudah sepatutnya men dapat p e r h a t i a n d a n p e m e r i n t a h . P e m e r i n t a h s e b a g a i p e l a y a n m a s y a r a k a t , b e r t u g a s mensejahterakan masyarakatnya, memikul tanggung jawab yang besar terhadap perlindungan konsumen. Untuk melaksanakan tugas dan fungsinya, pemerintah mempunyai kewenangan dan keleluasaan untuk mengambil tindakan/kebijakan yang dianggap perlu dan mendesak guna mengantisipasi masalah yang sedang dihadapi termasuk persoalan yang berkaitan dengan perlindungan konsumen. UU No.8 Tahun 1999 Tentang Perlindungan Konsumen menyebutkan bahwa pemerintah daerah memiliki kewenangan untuk menyelesaikan sengketa yang dialami konsumen di daerahnya.
P e n e l i t i a n d i l a k u k a n u n t u k m e n j a w a b m a s a l a h t e n t a n g k e w e n a n g a n Pemerintah Kota Medan dalam perlindungan konsumen dan peranannya dala m menyelesaikan sengketa atas kerugian yang timbul. Pendekatan yang dilakukan dalam penelitian ini bersifat yuridis sosioloais dan yuridis normatif yang didukung oleh data primer dan data sekunder. Data primer dikumpulkan melalui wawancara dan kuesioner, dari sampel konsumen sebanvak 20 orang di kecamatan Medan Baru yang diambil secara purposive. Data sekunder dikumpulkan melalui studi literatur terhadap bahan kepustakaan.
Penelitian menunjukkan bahwa Undang-Undang No.8 Tahun 1999 Tentang Perlindungan Konsumen, Pasal 49 memberi kewenangan kepada pemerintah daerah u n t u k m e m b e n t u k s u a t u b a d a n p e n y e l e s a i a n s e n g k e t a k o n s u m e n d i d a e r a h k o t a / k a b u p a t e n , n a mu n b e l u m d a p a t d i r e a l i s a s i . D a r i r e s p o n d e n y an a d i t e l i t i semuanya memberi jawaban bahwa lembaga tersebut sangat dibutuhkan. Upaya yang dilakukan oleh Pemerintah Kota Medan untuk sosialisasi Undang-Undang No. 8 Tahun 1999 Tentang Perlindungan Konsumen dinilai masyarakat belum optimal. P e m e r i n t a h K o t a M e d a n t e l a h m e l a k u k a n u s a h a u n t u k m e m b e n t u k b a d a n penyelesaian sengketa konsumen (BPSK) yang diharapkan masyarakat. Beberapa kendala yang dihadapi oleh Pemerintah Kota Medan yaitu ketidaksesuaian bentuk
atau format badan penyelesaian sengketa konsumen (BPSK) dengan format dari p e m e r i n t a h p u s a t . S u a t u p e r a t u r a n p e r u n d a n g a n - u n d a n g a n y a n g m e m b e r i k a n kepastian hukum dan perlindungan hukum terhadap segala kegiatan yang berkaitan dengan transaksi konsumen merupakan hal yang mutlak, dari penelitian diperoleh data bahwa 100% produsen yang menjadi responden mendukung kehadiran UU No. 8 tahun 1999 tentang Perlindungan Konsumen ini. Salah satu upaya yang tepat untuk mengatasi permasalahan antara produsen dan konsumen yang terjadi yaitu adanya BPSK dibandingkan dengan penyelesaian sengketa melalui lembaga peradilan resmi yang ada. Harapan konsumen dan produsen akan kehadiran BPSK ini terdorong oleh kasus-kasus kerugian konsumen yang muncul dan sampai ke pengadilan, belum semua dapat diselesaikan secara cepat, murah dan sederhana.
