Divorce is legal events relating to joint property in marriage. The implementation of the division of joint property is done by either party without the agreement of the other parties concerned. This, done because of the magnitude of the contribution in the marriage. The amount of contribution in a marriage can be seen from the presence or public opinion assessment of the division of joint property. The purpose of this study is to understand the reason for the division of joint property by the amount of contribution of marriage and the social view of District Rural Mlaras Sumobito Jombang on the division of joint property in marriage.
This research was using normative legal theory’s approach by examining secondary data consisting of literature, primary legal materials, legal materials of secondary, and tertiary legal materials, as well as primary data obtained from interviews. Specifications are descriptive analytical study that illustrates the legislation in force associated with the implementation of legal theory and practice of positive law concerning the above problems. Research stage through library research and field study . Methods of data analysis is normative qualitative research.
