Kegiatan usaha hulu minyak dan gas bumi telah berlangsung sejak sebelum kemerdekaan Indonesia. Sistem pengelolaan yang digunakan dalam kegiatan usaha hulu tersebut sering berubah seiring dengan perkembangan. Saat ini, dalam kegiatan usaha hulu digunakan sistem penggantian biaya operasi terhadap biaya yang telah dikeluarkan oleh KKKS selama masa produksi. Sistem ini dianggap masih menimbulkan pro dan kontra karena disinyalir kurang sesuai dengan perkembangan zaman. Tujuan dilakukan penelitian ini adalah untuk menganalisis penerapan penggantian biaya operasi ditinjau dari UU Migas serta pengaturan penggantian biaya operasi dalam praktik ditinjau dari PP Biaya Operasi.
Metode pendekatan yang digunakan dalam penelitian ini bersifat yuridis normatif yang dilakukan dengan cara meneliti bahan-bahan pustaka yang berupa data sekunder dan didukung oleh data primer yang diperoleh secara langsung dari narasumber.
Hasil penelitian terhadap masalah di atas menunjukkan: Pertama, penerapan penggantian biaya operasi oleh SKK Migas terhadap KKKS dalam kontrak kerja sama ditinjau dari UU Migas telah melalui 3 (tiga) generasi dan mengalami perbaikan di setiap generasinya. Kedua, pengaturan penggantian biaya operasi dalam KKS pada dasarnya telah didasarkan pada PP Biaya Operasi, akan tetapi pada praktiknya hasil akhir besaran jumlah penggantian biaya operasi tersebut berbeda satu sama lain.

The upstream activities of oil and gas have been going on since before the independence of Indonesia. Management systems that were used in the upstream business activities often change in line with development. Currently, in the upstream activities used recovery of operating costs against the costs that have been spent by the contractor during the production period. This system is still considered causing the pros and cons for allegedly not in accordance with the development era. The purpose of this study is to analyze the implementation of the recovery of operating costs viewed of oil and gas law and regulation on recovery of operating costs in practice viewed of government regulation concerning Recovery of Operating Costs.
The method used in this research is a normative juridical by examining the library materials in the form of secondary data and supported by primary data obtained directly from the source.
The study of the above problems shows: First, the application of recovery of operating costs by Special Task Force for Upstream Oil and Gas Business Activities towards the contractor in terms of the cooperation contract oil and gas law has been through three (3) generations and an improvement in every generation. Second, the regulation of recovery of operating costs in the PSC essentially has been based on government regulation on Recovery of Operating Costs, but in practice the final result proportion of recovery of operating costs are different from each other.
