Pemerintah Konfederasi Switzerland dan Pemerintah epublik Indonesia akan berusaha lll1.tuk memad j ukan sed j auh mungkin kerdjasama ant ara kedua negara dalam bi dang tehnologi

da.n ilmiah .

Pasal 2 ·. ·

Ke tentuan-ketentuan rsetud j uan i ni berlaku : a) untuk r o jekpro j ek kerdjasama tehnik antara kedua Peme

-rintah;

b ) djuga untuk pro jek-projek kerd j asa.ma tehn.ik j ang sudah dimulai oleh baik badan- badan Pemerintah Swit zerland

mau-ptm Indonesia a tau organisasiorganisas i s rasta , berdasar

-kan suatu permufakatan jang telah di adakan untuk maksud i n i ol eh kedua Pemerintah .

Pasal 3

-perset djuan bersama , dapat menjusun rentjana-rentjana jang meliputi projek - proje chusus kerd jasama tehnik .

Pasal

4

Kerd j asama tehnik itu da at dilaksanakan seperti berikut

a ) pengiriman para ahli atau pegawai tebnik lainnj a;

b) pemberian beasiswa -bea siswa untuk belad j ar atau untulc

lati-han djabatan. Pemerintah Switzerland

akan,

bilamana sadja, memberi beasiswa-beasiswa di Indonesia, di Switzerland atau dinegara-negara ketiga, untuk beladjlar maupun untulc latihan djabatan dan tehnik kepada para tjal.on jang untulr itu harus sudah dipilih atas dasar permufakatan kedua Pemerintah. Pemerintah Indonesia berusaha keras untuk menempatkan

mere-ka sedemikian r upa , sehingga terdjamin pemanfaatan penuh penge t ahuan j ang telah mereka perole h sekembali par a peme -gang beasiswa i ni kenegara mereka sendiri;

c ) pembe rian bant uan kepada badan-badan setengah pemerintah atau swasta dengan maksud lll1tuk merealisasi suatu projek pembangunan tertentu;

d) setiap bentuk kerdjasama lainnja jang telah disetudjui bersama oleh para peserta jang bersangkuta.n .

Pasal

ｐｲｯｪ･ｫ Ｍ ｰｲｯｪ･ｾ＠ kerdjasama tehnik serta elaksanaannja akan diatur dengan permufakatan chusus .

Pasal 6

Kerdjasama tehni, dalam rangka persetudju.an ini a an dilakukan atas dasar pembiajaan bersama dan dala batas - batas k emampuan pihak peserta masin -masing. Biaja - biaja j ang

di-beban an dala.m mata-u.ang Rupiah lazimnja akan dipikul oleh Pemerintah Indonesia .

- memikul biaja hidup , bi aja l a t i han dan b i aja pe rdjalana.n pulang dari Swi tzerland ke Indonesia bagi uarganegara Ind ones i a jang diundang ke Swi t zerland untuk dilatih dalam rangka kerdjasama tehnik .

Masaalah mengenai s i a pa j ang memikul biaja perd j alanan ke Swi t z erland akan di putuskan , apabila perlu , oleh para pedjabat k edua Pemerint ah jang berwenang .

- mengusahakan bi a ja perd j alana.n , pengangkutan , surat-men j urat, mau pun biaja - biaj a t i l p on dan kawa t jang d i pe rlukan mis i;

La cooperation technique pourra revetir les formes suivante s

a ) envo i d ' experts ou e personnel e chni u e d 'autre s categories; b ) octroi de bour ses d'etudes ou de for at i on professionnelle .

Le Gouvernement suisse ac co dera , dans la mesure de ses

possibilites , des bourses d'etudes e t de formation rofessioi -nelle ou techni que , en I ndonesie , en Suisse ou dans des

pays tiers , aux candidats que les deux Gouvernements auront choisi s d ' un commun a ccord . Le Gouvernement i ndone sien

s'efforcera de placer le s - enefi c i a ires de ces bourses ,

ut iliser plei ement les connais sances ac uises;

c) subvention a des institutions semi-publiques ou privees en vue de realiser un projet determine de developpement ;

Agreement on technical co-operation between

the Swiss Confederation

and

the Republic of Indonesia

The Government of the Swiss Conf'edera ... ion and the Government of the Repub lic of Indonesia , being desirous of strengthening the ties of friendship exis t ing between t he two nations and of furthering · he technical ｣ｯＭｯｰ･ｲ｡ｾｩｯｮ＠

bet reen the t o count ries,, agree upon the following rovisions :

Article 1

The Government of the Swiss Confederation and the Government of the Rep blic of Indonesia undertake to promote as far as possible co-operation between the two coillltries i n t he f ields of technology and science .

Article 2

The r ovisions of the present greement apply :

a) to pro jects of te chnical co -operation between the two Governments ;

b ) equally to proj e cts of technical co-o pe ration i n itiated by bot h Swiss and Indones ian public corporations or

private organizations, based upon an arrangement concluded

to this

effect between

the

two Governments.

Article 3

Within the framework of their national legislation and in conf·ormity with international law and general pratice.s, the contracting Parties may, by mutual agreement, es:tabli,sh programmes covering specific projects of technical

-Article 4

The technical co-operation may be undertaken in the following manner :

a) the

dispatching of experts

or

other technical staff;

b) the granting of scholarships for studies or for professional training.

The Swiss Government shall, whenever possible, grant in

Indonesia, in Switzerland or in third countries, scholarships for studies as well

as

for profe s s ional and technical training of s uch candidates as shall have

been

selec-ted by mutual

a greement of the two Governments . The Government of Indonesi a shall, on t he r eturn of t he benefi ciaries of these

scholarships to their own country endeavour to place them in

s uch a way as to ensure that full use shall be made of the knowledge acquired ;

c ) the granting o· subvent ions to semi - public or pri vate

institutions with a vie1 to realizing a certain pro je ct of development;

d ) any other form of co - operation t hat has been mutually agreed upon by the parties concerned .

Article 5

The pro ject s of technical co-operation and the ir i mplementation 1 ill be the object of special arrangements.

Article 6

The technical co -o peration within the fram.eto rk of this agreement shall be carried out on a joint financial bas i s and within the limits of each contracting Party ' s o er . The expenses

to be paid in Indonesian cu.rr,ency will as a rule be borne by the Government of Indonesi a.

to pay t he salari es and ins uranc e premiums of the staff provided by the Swis s Government;

- to cover t he cost of selection and formation of t his s taff ; - t o cover the cost of t ravel f rom Switzerland t o I ndonesia

and re turn f are;

- to assume t he plll'chas e and transport ation co st of equipment n ot available in Indone sia ;

- to cover t he l i ving co sts , training expenses and t he return fare from Swit zerland to Indonesia of c itizens of

Indonesia invited to Switzerland to be t rained . there wi thin the framework of t e chnical co-operation .

The quest ion as t o who bears t he fare to Swit zerland will be de cided , if ne cessary , by t he compe ten t authorit ies of both Governments .

2 ) Indonesia :

- to provide the n ecessary c ount erparts who will t ake over the projects after t he de artur of the Swiss s taff; - t o pay the salarie s and insuranc e premi ums of t he

Indonesian staff ;

- t o provide t he material and the e qu i pment whi ch is availabl e l ocall y;

- t o provide , as far as possibl , adequate housing f or the techni cal c o-operation s taff ;

to provide office qua.rters and other nec e ssary premises and t o pay the rent thereof ;

- t o assume the cost of trave l, transportation , mailing , as wel l a s t he telephone and t elegraph expenses ent ailed in the mission;

- to provide the servic es which can be r endered by local personnel and to pay for secretari a t, translation a.nd s inilar faci l it i es;

Article 7

Tith regar to the importation and e_ portation of equi ｾ ･ｮｴ Ｌ＠ demonstration material and o her go ods re q1ired by

the Swis staff for the er ormance of the i r task or or

in,Q-part of material ma de available in cases of technical co-o e atico-on co-on a brco-oader scale, the same e ations as are applicable t o United Nations equipment and supplies shall be a plied.

The provi sions of the resent greement s hall ap ly equally :

a) to t he Swiss staff , as well as to t heir families, who are already wor ing in Indonesia under t he a pices of the

tee ical co-operation between the two Governments, according to ar ticle 2, litt. a ) and b ) above ;

b) to the persons of Swiss nat ionality who are in charge of the administrat i on of the wiss staff in Indonesia •

.Article 9

The c ontracting Part ie s shall meet pe riodically with a view to analyzing t he r esults obtained in the r ealization of

projects of deve l opment executed i n the· f ramework of the pres.ant agreement.

Article 10.

The present {S!'eement. shall apply provisiona lly as from the date of its signature. It shall come into :force as soon as the contracting Parties have notified each other of the fulfilment of the constitutional requirement s relating to the conclusio.n and entry into force of international agreements.

After the signing of the agreement it shall remain in force for three years. Thereafter, it .shall be prorogated for one year by

tacit renewal until terminated by one of the contracting Parties
