MINISTER OF INDUSTRY AND TRADE THE REPUBLIC OF INDONESIA

NUMBER: 466/MPP/Kep/8/2004 REGARDING

AMENDMENT OF DECREE OF MINISTER OF INDUSTRY AND TRADE NUMBER

757/MPP/Kep/12/2003 REGARDING TEMPORARY BAN OF IMPORT OF RUMINATED ANIMAL AND ITS DERIVATIVE PRODUCT FROM THE UNITED STATES

MINISTER OF INDUSTRY AND TRADE THE REPUBLIC OF INDONESIA

Considering:

a. In the framework protecting people’s health and national biological resources as well as preventing the influx of Bovine Spongioform Encephalopathy disease (BSE or Mad Cow ) which is now spreading in the United States, it is deemed necessary to temporary ban import of ruminated animal and its derivative product from the United States into Indonesia.

b. That as the handling of BSE disease on ruminated animals has been performed in accordance with clauses of OIE Terresterial Animal Health Code agreed during Office International des Epizooties/OIE) meeting on 23-28 May, 2004 therefore it is necessary to reassess policy on temporary ban of less risky product, and after having considered Decree of Minister of Finance Number 545/KMK regarding classification of imported products, it is deemed necessary to amend Decree of Minister of Industry and Trade Number 757/MPP/Kep/12/2003 regarding temporary ban of import of ruminated animal and its derivative product from the United States.

c. Therefore it is deemed necessary to issue Decree of Minister of Industry and Trade.

In view of:

1. Decree of Minister of Industry and Trade Number 757/MPP/Kep/12/2003 regarding temporary ban of import of ruminated animals and its derivative products from the United States;

2. Decree of Minister of Finance Number 545/KMK.01/2003, regarding Classification of Imported Products.

Bearing in mind:

Decree of Minister of Agriculture Number 153/PD.620/M/7/2004 on revenue from import of ruminated product from the United States.

DECIDE

Stipulate:

DECREE OF MINISTER OF INDUSTRY AND TRADE OF THE REPUBLIC OF INDONESIA NUMBER: 466/MPP/Kep/8/2004 REGARDING AMENDMENT OF DECREE OF MINISTER OF INDUSTRY AND TRADE NUMBER 757/MPP/Kep/12/2003 REGARDING TEMPORARY BAN OF IMPORT OF RUMINATED ANIMAL AND ITS DERIVATIVE PRODUCT FROM THE UNITED STATES.

Change provision stated in Decree of Minister of Industry and Trade Number 757/MPP/Kep/12/2003 regarding temporary ban of import of ruminated animals and its derivative product from the United States as follows:

1. Lift some ruminated product such as meat, cement, embryo, liver, heart, legs from the list of ruminated product whose import is banned under Decree of Minister of Industry and Trade Number 757/MPP/Kep/12/2003, so that the new list of product is as mentioned in the appendix of this decree. 2. Change classification/HS of ruminated animals and its derivative whose import is temporary banned

under Decree of Minister of Industry and Trade 757/MPP/Kep/12/2003 so that the final classification is as mentioned in the appendix of this decree.

Article II

1. With the stipulation of article I of this decree, ruminated animal and its derivative from the United States such as meat, meat, cement, embryo, liver, heart and legs which are excluded from the banned imported product can be imported into Indonesia effective 15 July 2004 according to the date of manifest and according to the existing regulation.

2. Some of ruminated animals such as meat, cement, embryo/ova, liver, heart and legs whose import violate provision stated in paragraph 1 shall be re-exported or destroyed in accordance with the existing regulation.

Article III

This decree shall come into effect as it is stipulated.

For anybody to be aware of it, this decree shall be put into the State Gazette of the Republic of Indonesia.
