MINISTERIAL REGULATION OF TRADE

OF THE REPUBLIC OF INDONESIA

NUMBER 97/M-DAG/PER/11/2015

ON

IMPORT PROVISION OF FORESTRY PRODUCT

BY THE GRACE OF GOD THE ALMIGHTY

MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA,

Considering:

a.

that in order to boost national competitiveness, it is

necessary to simplify the licensing trade, especially

import of forestry product;

b.

that import provision of forestry product as stipulated

in the Regulation of the Minister of Trade Number

78/M-DAG/PER/10/2014 on Import Provision of

Forestry Product as amended several times, the latest

by Ministerial Regulation of Trade Number

63/M-DAG/PER/8/2015 have considered to be irrelevant;

c.

that based on the consideration as referred to in

paragraph b, it is necessary to revoke Ministerial

Regulation of Trade Number 78/M-DAG/PER/10/2014

on Import Provision of Forestry Product as amended

several times, the latest by Ministerial Regulation of

Trade Number 63/M-DAG/PER/8/2015 and rearrange

the import provision of forestry product;

d.

that based on the considerations as referred to in letter

a, letter b, and letter c, it is necessary to stipulate

Ministerial Regulation of Trade on Import Provision of

Forestry product.

In view of:

HAS DECIDED:

To Stipulate: MINISTERIAL REGULATION OF TRADE ON IMPORT PROVISION

OF FORESTRY PRODUCT.

Article 1

In this Ministerial Regulation what is meant by:

1.

Forestry product is product which is generated from forest, both raw

product and processed product and their derivatives, for raw material

used or auxiliary material in the production process of itself or to be

traded and / or to be transferred to another party.

2.

Import is a activity to supply goods to the customs area.

3.

Import Approval is approval which is being used as a license to do import

of Forestry Product.

4.

Import Declaration is a statement letter from the importer stating that

Forestry Product to be imported is meet with the result of due diligence

(uji tuntas) undertaken by importer.

5.

Recommendation is a letter issued by the minister or official appointed

containing technical explanations regarding Forestry Product which will

be imported.

6.

Minister is the minister who held government affairs in the field of trade.

7.

The Director General is the Director General of Foreign Trade, Ministry of

Trade.

Article 2

(1)

Import of Forestry Product shall be restricted.

(4)

Article 3

Every Forestry Products as referred to in Article 2 that are imported shall

obliged to fulfill the legality of Forestry Product in accordance with law and

legislation.

Article 4

(1)

Forestry Product as referred to in Article 2 may only be imported by the

company owner of General Importer Identification Number (API-U) or the

company owner of Producer Importer Identification Number (API-P) which

has received Import Approval from the Minister.

(2)

The Minister shall give mandate of the issuance of Import Approval as

referred to in the paragraph (1) to the Director General.

Article 5

(1)

Forestry Product as referred to in Article 2 that is imported by the

company owner of API-U may only be traded and / or transferred to

another party.

(2)

Forestry Product as referred to in paragraph (1) shall be prohibited to be

traded and/or transferred abroad before further processing in the

country.

(3)

Forestry Product as referred to in Article 2 that is imported by the

company owner of API-P may be used as a raw material or supporting

material for the production process itself and forbidden to be traded and /

or transferred to another party.

Article 6

(1)

To obtain Import Approval as referred to in Article 4, the company has to

submit an application electronically to the Director-General, with the

following documents:

a.

API-U or API-P;

b.

Import Declaration;

c.

Registered license Shelter (TPT) and / or evidence of the mastery of a

storage area in accordance with the characteristics of the product, for

company owning API-U; and

d.

Recommendation of the Minister of Environment and Forests or

appointed official.

The Director General on behalf of the Minister shall issue the Import

Approval not later than three (3) working days since the date of

application as referred to in paragraph (1) is received completely and

correctly.

(5)

Article 7

The validity of Import Approval as referred to in Article 6 paragraph (2) shall in

accordance with the of validity Recommendation, commencing since the date of

issuance of Import Approval.

Article 8

(1)

Application submission to obtain Import Approval as referred to in Article

6

may

only

be

received

by

an

electronic

system

through

http://inatrade.kemendag.go.id.

(2)

In the event that force majeure condition (keadaan memaksa) that cause

the electronic system through http://inatrade.kemendag.go.id does not

work, the application submission as referred to in paragraph (1) shall be

submitted manually.

Article 9

(1)

Import Approval as referred to in Article 6 paragraph (2), shall be

forwarded electronically from INATRADE portal to Indonesia National

Single Window (INSW) portal.

(2)

In the case that Forestry Product is conducted through the port that is

not connected with the Indonesia National Single Window (INSW), the

copy of Import Approval as referred to in Article 6 paragraph (2) shall be

submitted manually to the relevant agencies.

Article 10

(1)

Company that has obtained Import Approval shall obliged to submit the

report electronically on the implementation of Forestry product Imports,

whether it implemented or not, through http://inatrade.kemendag.go.id.

(2)

The report as referred to in paragraph (1) shall be submitted to the

Director-General, every month no later than date of 15 (fifteen) for the

next month.

(3)

In the event that force majeure condition (keadaan memaksa) that cause

the electronic system through http://inatrade.kemendag.go.id does not

work, reporting as referred to in paragraph (1) shall be submitted

manually.

Article 11

The company that does not undertake it obligation to submit report as referred

to in Article 10 as much 2 (two) times, shall be sanctioned suspension of

import approval request for the next period of 6 (six) months.

Article 12

a.

violates the restriction provision of trade and/or transfer Forestry Product

abroad before further processing in the country, as referred to in Article 5

paragraph (2), for company of API-U owning;

b.

violates the restriction provision of trade and/or transfer Forestry Products

imported to other parties, as referred to in Article 5 paragraph (3), for

company of API-P owning;

c.

proved to convey data and/or information that is not correct as the

requirement to obtain import approval, after the Import Approval has

issued;

d.

proven to change the information contained in Import Approval;

e.

proved to be an offense under the recommendations of the relevant

technical agencies to be lifted Import Approval; and / or

f.

found guilty by a court decision that has had permanent legal force for a

criminal offense related to the abuse of Import Approval.

Article 13

Suspension of application for Import Approval asreferred to in Article 11 and

the revocation of Import Approval as referred to in Article 12 shall be carried

out by the Director General.

Article 14

The company which is has been subject to revocation sanction of Import

Approval as referred to in Article 12 may only reapply for Import Approval after

1 (one) year since the date of revocation.

Article 15

(1)

Company which is not complying with the provision Forestry Product

Import of this Ministerial Regulation shall subjected to sanction in

accordance with the provision of the law and legislation.

(2)

Imported Forestry Product is not comply with the provision of this

Ministerial Regulation, should be re-exported or destroyed by the

importer in accordance with the provision of the law and legislation.

(3)

The cost of the implementation of the re-export and the destruction as

referred to in paragraph (2) shall be the responsibility of the importer.

Article 16

(1)

Import of Forestry Product of:

a.

goods for research a

nd development of science’s need;

b.

goods of grant, souvenir, or gift for the purposes of public worship,

charity, social, cultural, or for the prevention of natural disaster;

d.

goods for exhibition’s need,

shall be obtained Import Approval from the Director of Import.

(2)

To obtain Import Approval as referred to in paragraph (1), the applicant

has to apply in written to the Director of Imports by attaching a Certificate

Letter from the Ministry of Environment and Forestry.

(3)

Import of Forestry Product of:

a.

export goods which is rejected by overseas buyers and then re-import

with the most appropriate amount to the Goods Export Declaration

(PEB);

b.

personal belonging of passengers and crew members; and

c.

border crossers goods to be consumed alone,

shall not required an Import Approval.

(4)

Import of Forestry Product as referred to in paragraph (1) and paragraph

(3) shall be exempted from the requirements of API.

Article 17

(1)

In order to supervise of import forestry product, the Directorate General of

Foreign Trade, Ministry of Trade may make a compliance assessment

(post-audit) to the company that has obtained Import Approval.

(2)

Compliance assessment (post-audit) as referred to in paragraph (1) shall

apply to:

a.

the truth of import realization report;

b.

conformity of imported goods with the data as listed in Import

Approval;

c.

conformity and appropriateness of storage site in accordance with the

characteristic of its product; and/or

d.

comply with law and regulation.

Compliance assessment of (post-audit) as referred to in paragraph (1) may

be carried out at any time and in coordination with relevant technical

ministries.

(4)

The Director General may establish Integrated Team to carry out the

compliance assessment (post audit) as referred to in paragraph (1).

Article 18

At the time this Ministerial Regulation comes into force, Ministerial Regulation

of Trade Number 78/M-DAG/PER/10/2014 on Import provision of Forestry

Product as amended several times, the latest by Ministerial Regulation of Trade

Number 63/M-DAG/PER/8/2015, shall be revoked and declared null and

void.

Article 19

This Ministerial Regulation comes into force on January 1, 2016.
