MEMORANDU.l\f OF UNDERSTANDING BETWEEN

THE CORRUPTION ERADICATION COMMISSION OF THE REPUBLIC OF INDONESIA

AND

THE MINISTRY OF SUPERVISION OF TIIE PEOPLE'S REPUBLIC OF CHINA

The Corruption Eradication Commission of the Republic of Indonesia and the Ministry of Supervision <?f the People's Republic of China, hereinafter referred as "the· Parties"; .. Realizing that corruption has deteriorated the welfare of people and nations worldwide; Acknowledging that preventing and combating corruption which is transnational in nature can be enhanced by the collaborative and continuous efforts among the Parties based on generally accepted international conventions;

Desiring to streng1hen collaborative efforts among them

preventing and combating corruption;

Stressing that the establislunent of cooperation among them would further strengthen the existing strategic partnership between their respective countries;

Recognizing the importance of the principles of sovereignty, national independence, equality and mutual benefits;

In accordance with the prevailing laws and regulations of their respective countries; Have agreed as follows:

The objective of the cooperation include:

Article 1

b) To increase capacity and institutional building among the Parties in preventing and combating corruption.

Article2 Areas of Cooperation

The areas of the cooperation will include, subject to the Parties respective domestic law, regulation, and practices, within the limit of their competence the following:

a) To exchange information in respect of experience in and methods and means of preventing and combating corruption and/or corrupt practices;

b) To cooperate in conducting training, exchange of · expertise and hosting and , participating in forums, workshops, seminars, conventions, and conferences;

c) To exchange information on community education and media campaign, to enhance . public awareness on anti-corruption and to strengthen public participation;

d) To provide technical assistance in operational activities including through the usage of

Treaty on Mutual Legal Assistance;

e) To perform other areas of cooperation as deemed necessary.

Article 3

Technical Arrangement

Activities described in this Memorandum of Understanding will be implemented through the development of specific arrangements, programs or projects between the Parties. Such arrangements, programs or projects will specify the objectives, financial arrangement, and

other details relating to specific undertakings of ｾＱＱ＠ the Patties involved.

Article4

The information or documents obtained from the respective Parties will be kept confidential and will not be disseminated to any third party, nor be used for administrative, prosecution or judicial purposes without prior consent of the disclosing Party.

Article 5

Implementation Mechanism

a) The Parties will hold meetings as necessary to review the implementation of this Memorandum of Understanding and to recommend programs of cooperation.

b)

Any

dispute arising out of the interpretation, application or implementation of this Memorandum of Understanding will be resolved through negotiation.

c) Each Party will designate its representative as Contact Person. Any change of Contact Person will be communicated to. the other Party.

Article 6

Amendment

The Parties will review or amend any part of this Memorandum of Understanding by mutual consent in writing and such amendment will become effective on such date as detennined by the Parties and will form as an integral part of this Memorandum of Understanding.

Article 7 Entry into Force

I. This Memorandum of Understanding will become effective on the date of its signing.

2. Any Party will express its intention to withdraw from this Memorandum of

Understanding by written notification 6 (six) months prior notice to the other Party. The Memorandum of Understanding will cease to be effective thereafter for that Party.

IN WITNESS WHEREOF, the undersigned, the authorized representatives of the respective Parties, have signed this Memorandum of Understanding.

DONE in duplicate in Beijing on 23 May 2007 in both English and Chinese languages.
