MEMORANDUM SALING PENGERTIAN

ANT ARA

PEMERINTAH REPUBLIK INDONESIA

DAN

PEMERINTAH REPUBLIK

RAKYAT DEMOKRATIK KOREA

DALAM BIDANG INFORMASI

Pemerintah Republik Indonesia dan Pemerintah Republik Rakyat Demokratik Korea (selanjutnya diseb ut sebagai "para pihak)

Menyadari perlunya memperkuat hubungan yang sudah berlangsung selama ini antara kedua negara.

Meyakini bahwa peningkatan kerjasama dalam bid ang informasi akan memberikan kontribusi bagi hubungan bersahabat dan kerjasama diantara kedua bangsa yang didasarkan pada prinsip sating menghormati kedaulatan dan tidak mencampuri urusan dalam negeri.

Merujuk pada Persetujuan antara Pemerintah Republik Indonesia dan Pemerintah Republik Rakyat Demokratik Korea tentang Kerjasama di bidang llmu Pengetahuan, Teknologi, dan Kebudayaan yang ditandatangani di Jakarta pada tanggal 15 Nopember 1963.

Menggantikan Memorandum Saling Pengertian antara Pemerintah Republik Rakyat Demokratik Korea dan Pemerintah Republik Indonesia di bidang lnformasi, yang ditandatangani di Pyongyang pada 30 September 1985, dan untuk bekerja sama dalam bidang informasi

Berdasarkan hukum dan peraturan perundang-undangan yang berlaku dari masing-masing negara.

TELAH MENYETUJUI SEBAGAI BERIKUT: PASAL 1

Tujuan Kerjasama

PASAL2 Lingkup Kerjasama

Lingkup kerjasama Memorandum Saling Pengertian (MSP) ini meliputi penyiaran, media cetak dan elektronik, tekhnologi komunikasi dan informasi, serta kantor berita.

PASALJ Kegiatan Kerjasama

Kegiatan kerjasama berdasarkan Memorandum Saling Pengertian (MSP) ini adalah sebagai berikut:

1 . Pertukaran berita dan bahan informasi yang dapat memperkuat hubungan bilateral para pihak;

2. Pertukaran program-program radio dan televisi, materi-materi audio dan visual yang meliputi bidang politik, ekonomi, sosial dan budaya para pihak (berita, drama

dokumenter, program anak-anak dan hiburan);

3. Pertukaran program-program radio dan televisi yang meliputi perayaan Hari Kemerdekaan/Nasional para pihak yang dikirim melalui ｳ｡ｬｵｲ｡ｮｾ｡ｬｵｲ＠

diplomatik kepada pihak lain paling lambat satu bulan sebelum diberitakan;

4. Bekerja sama dalam bidang penyiaran radio dan televisi melalui penandatanganan suatu pengaturan antara kantor-kantor Radio dan

Televisi yang ada di Indonesia dan di Korea.

5. Pertukaran kunjungan pejabat dan tekhnisi radio dan televisi, sutradara, ahli perfilman, penyiar radio dan televisi, dan wartawan media cetak, yang telah disepakati bersama oleh para pihak;

6. Memajukan kerjasama di bidang ICT;

7. Mempertimbangkan kemungkinan pemberdayaan bagi pegawai yang bekerja di bidang lnformasi dari para pihak melalui penyelenggaraan pelatihan-pelatihan yang diselenggarakan oleh pihak ketiga di negara masing-masing;

8. Memfasilitasi lkerjasama dibidang pertukaran berita antara Kantor Serita Nasional Indonesia (ANTARA) dan Kantor Serita Pusat Korea (KCNA);

9. Memberikan kemudahan bagi tekniksi dan wartawan yang

bertanggungjawab meliputi peristiwa nasional dari para pihak.

PASAL 4

Pengaturan Keuangan

1. Pengiriman berita atau materi informasi harus berdasarkan ketentuan pembayaran uang jasa atau kondisi keuangan, dimana pihak pengirim berita atau materi informasi harus memberitahukan kepada pihak lainnya mengenai ketentuan-ketentuan tersebut, dan sebelum berita atau materi informasi tersebut dikirim harus mendapat persetujuan secara tertulis;

2. Dalam hal pertukaran kunjungan, negaira pengmm akan menanggung biaya perjalanan pergi-pulang, dan negara penerima akan menanggung transportasi lokal yang diperlukan di negara penerima berdasarkan ketentuan yang disepakati bersama;

3. Semua pengaturan keuangan untuk melaksanakan setiap kegiatan yang tercantum di artikel 2 dari Memorandum Saling Pengertian (MSP) ini dapat dinegosiasikan dan tergantung pada ketersediaan dana dan sumber-sumber pendanaan lainnya dari para pihak.

PASAL 5 Kerahasiaan

1. Para pihak akan bertanggung jawab untuk mernnJau kerahasiaan dokumen, informasi dan data-data lain yang diterima selama jangka waktu pelaksanaan Memorandum Saling Pengertian (MSP) ini.

2. Dalam hal berakhirnya Memorandum Saling Pengertian (MSP) ini, Para pihak sepakat bahwa ketentuan Pasal ini tetap berlaku .

PASAL 6 Komite Bersama

1. Dalam rangka pelaksanaan Memorandum Saling Pengertian (MSP) ini, para pihak akan membentuk Komite bersama yang memiliki fungsi sebagai berikut:

(1) Melakukan konsultasi bersama dan memberikan usulan kepada pejabat-pejabat terkait yang dapat memberikan bantuan bagi pelaksanaan Memorandum Saling Pengertian (MSP) ini;

(2) Memberikan saran mengenai cara-cara kerjasama yang baru antara para pihak di bidang informasi;

(3) Menyiapkan program-program, termasuk masalah-masalah

pembiayaan dan aspek-aspek keuangan lainnya yang terkait dengan pelaksanaan Memorandum Saling Pengertian (MSP) ini;

(4) Menindaklanjuti secara berkala pelaksanaan ketentuan Memorandum Saling Pengertian (MSP) ini berdasarkan permintaan dari salah satu pihak.

2. Komite Bersama akan melakukan pertemuan setiap sekali dalam dua tahun secara bergantian di masing-masing negara untuk melihat perkembangan kerjasama antara para pihak dan melaksanakan program eksekutif untuk periode dua tahun berikutnya. Dalam hal pertemuan tidak dapat dilaksanakan , pertukaran dokumen akan dilakukan sebagai pengganti atas pertemuan tersebut.

PASAL 7

Hak Atas Kekayaan lntelektual (HAKI)

1. Para pihak bersepakat agar setiap HAKI yang timbul dari pelaksanaan Memorandum Saling Pengertian (MSP) ini akan dimiliki bersama dan: (i) masing-masing pihak diijinkan untuk menggunakan HAKI tersebut

untuk tujuan memelihara, menyesuaikan, dan memperbaiki HAKI yang dimaksud;

(ii) Apabila salah satu pihak dan/atau institusi menggunakan HAKI tersebut dengan mengatasnamakan Pemerintah untuk tujuan-tujuan komersial, maka pihak lain juga harus memperoleh royalti yang sepadan;

(iii) Masing-masing pihak akan bertanggung jawab terhadap semua tuntutan yang dibuat oleh pihak ketiga mengenai kepemilikan dan legalitas dari penggunaan HAKI oleh pihak yang disebutkan sebelumnya berdasarkan Memorandum Saling Pengertian (MSP) ini untuk pelaksanaan kegiatan-kegiatan yang bersifat kerjasama.

2. Para pihak akan menjamin bahwa HAKI yang dibawa oleh salah satu pihak 1,

kedalam wilayah pihak lainnya dalam rangka melaksanakan setiap program kegiatan tidak akan mengakibatkan pelanggaran terhadap hak 1_•

pihak ketiga.

3. Apabila ada pihak yang menginginkan untuk membuka kerahasiaan data dan/atau informasi hasil kegiatan kerjasama, berdasarkan Memorandum Saling Pengertian (MSP) ini kepada pihak ketiga, pihak yang membuka kerahasiaan data dan informasi tersebut harus mendapatkan persetujuan terlebih dahulu dari pihak lainnya sebelum pembukaan kerahasiaan data/informasi tersebut dilakukan.

4. Apabila dikemudian hari ada salah satu pihak yang membutuhkan kerjasama dengan pihak lain diluar ｐ･ｭ･ｲ ｾ ｮｴ｡ｨ＠ Negara Republik Indonesia dan Pemerintah Negara Republik Rakyat Demokratik Korea untuk tujuan perjanjian niaga yang terkait dengan HAKI dan tercakup dalam Memorandum Saling Pengertian (MSP) ini, pihak tersebut akan lebih mendahulukan untuk bekerjasama dengan pihak yang terlibat dalam Memorandum Saling Pengertian (MSP) ini, apabila pihak lain tersebut tidak dapat bekerjasama dengan cara yang saling menguntungkan kedua belah pihak.

PASAL8 Lembaga Pelaksana

Untuk pelaksanaan Memorandum Saling Pengertian (MSP) ini, para Pihak menunjuk badan-badan sebagai berikut:

1. Departemen Komunikasi dan lnformatika untuk Pemerintah Republik Indonesia;

2. Komite lnformasi, untuk Pemerintah Republik Rakyat Demokratik Korea.

PASAL 9

Pembatasan Personil

Masing-masing pihak akan menjamin semua personil yang terlibat dalam kegiatan berdasarkan Memorandum Saling Pengertiarn (MSP) ini tidak akan terlibat dalam kegiatan-kegiatan yang bersifat politik dan atau kegiatan perniagaan (komersil) di negara tuan rumah, diluar kegiatan atau program-program kerjasama yang tercakup dalam Memorandum Saling Pengertian (MSP) ini.

PASAL10

Pertukaran Serita dan Materi lnformasi

Semua berita dan materi informasi yang diperoleh berdasarkan Memorandum Saling Pengertian (MSP) ini akan dimanfaatkan untuk kepentingan Piihak Penerima, dimana Pihak Penerima akan mematuhi ketentuan-ketentuan sebagai lberikut:

.a. Materi yang dikirim, tidak boleh dipindahtangankan kepada pihak ketiga atau diguna!kan untuk tujuan-tujuan komersil;

b. Materi yang dikirim kepada para pihak harus dalam bahasa lnggris;

c. salah satu pihak dapat menyunting berita atau program-program secara jujur dan professional. Bila terjadi sebaliknya, maka fakta-fakta dan isi berita atau program-program harus dirubah.

d. Pemilihan dan penggunaan materi pihak lain harus diserahkan secara penuh dan keseluruhan kepada kabijakan dari para pihak.

PASAL11 Amandemen

1. salah satu pihak dapat mengajukan revisi atau amandemen secara tertulis terhadap setiap bagian pada Memorandum Saling Pengertian (MSP) ini. .2. Setiap revisi amandemen yang disetujui antara para Pihak merupakan

suatu kesatuan yang integral dari Memorandum Saling Pengertian (MSP) ini dan ak::m berlaku pada tanggal penandatanganan oleh para Pihak.

PASAL12

Penyelesaian Perselisihan

1. Setiap perbedaan atau perselisihan yang timbul dari interpretasi dari ketentuan Memorandum Saling Pengertian (MSP) ini akan diselesaikan secara bersahabat melalui konsultasi atau negosiasi antar belah Pihak . .2. Para pihak memiliki hak untuk menunda sementara waktu pelaksanaan

Memorandum Saling Pengertian (MSP). Dalam kaitannya dengan hal tersebut, alasan penundaan harus disampaikan kepada pihak lainnya melalui saluran diplomatik.

PASAL13

Masa Berlaku, Jangka Waktu dan Pengakhiran

1. Memorandum Saling Pengertian (MSP) ini akan mulai berlaku pada tanggal penandatanganan.;

2. Memorandum Saling Pengertian (MSP) ini akan berlaku selama 5 (lima) tahun dan secara otomatis dapat diperpanjang untuk masa 5 (lima) tahun secara berturut-turut, kecuali dinyatakan secara tertulis tidak berlaku lagi oleh salah satu pihak dengan memberikan pemberitahuan 6 (enam) bulan sebelum berakhirnyanya melalu saluran diplomatik;

3. Pengakhiran Memorandum Saling Pengertian (MSP) ini tidak akan mempengaruhi semua keabsahan dan masa berlaku daripada setiap program dan kegiatan yang dibuat berdasarkan Memorandum Saling Pengertian ini.

Sebagai Bukti, para penanda-tangan di bawah ini, yang telah diberi kuasa penuh oleh Pemerintah masing-masing, telah menandatangani Memorandum Saling Pengertian ini,

Dibuat di Jakarta pada tanggal sembilan betas bulan Februari tahun dua ribu sembilan, dalam bahasa Indonesia, Korea, dan bahasa lnggeris, semua naskah mempunyai kekuatan hukum yang sama. Dalam hal penafsiran yang berbeda dari Memorandum Saling Pengertian ini, maka naskah bahasa lnggeris yang berlaku.

MEMORANDUM OF UNDERSTANDING BETWEEN

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND

THE GOVERNMENT OF THE DEMOCRATIC PEOPLE'S REPUBLIC OF KOREA IN THE FIELD OF INFORMATION

The Government of the Republic of Indonesia and the Government of the Democratic People's Republic of Korea (hereinafter referred to as " the Parties" );

RECOGNIZING their need to strengthen the existing relations between the two countries;

CONVINCED that the promotion of cooperation in the field of information will

greatly contribute to the relations of friendship and cooperation between the two peoples on the basis of principle of rei;pect for sovereignty and non-interference in internal affairs;

REFERRING to the agreement between the government of the Republic of Indonesia and the government of the Democratic People's of Korea on cooperation in the field of science, Technology and Culture signed in Jakarta on November 15,

1963;

SUPERSEDING Memorandum of Understanding between the Government of the Republic of Indonesia and the Government of the Democratic People's Republic of Korea in the field of Information, signed in Pyongyang on 30th of September 1985 and to cooperate in the field of Information pursuant to relevant laws and regulAtions of the respective countries.

HAVE AGREED AS FOLLOWS:

ARTICLE 1

Objectives of Cooperation

The objective of thG cooperation under this Memorandum of Understanding (MoU) is to encourage, promote and de'velop mutual cooperation in the fielLI of information between the two countries.

ARTICLE 2 Scope of Cooperation

Scope of Cooperation of this MoU shall cover broadcasting, print anct electronic media. information CQmmunication technology (ICT), and news agency.

-ARTICLE 3

Activities of Cooperation

The Activities of cooperation under this MoU are as follows:

1. Exchange of news and information materials, which will strengthen bilateral relations between the Parties;

2. Exchange of radio and television programs, audio or visual materials, covering the political, economic, social and cultural aspects of life of the Parties (news, TV dramas, documentaries, children programs and entertainment);

3. Exchange of radio and telev1ision programs covering the National Day celebrations of the Parties provided that it should be sent through diplomatic channels to the other Party at least one month before its diffusion;

4. Cooperate in the field of radio and television broadcasting by signing an Agreement between the Indonesian and Korean Radio and Television agencies;

5. Exchange visits of radio and television officials and technical [personnel, directors, film experts, radio and television announcers and print media, journalists, as mutually agreed upon by the Parties;

6. Promote cooperation in the ｦｩ･ ｾ ､＠ of ICT;

7. Consider the possibilities of benefiting the Information field personnel of each Party with training session organized by the ather Party;

8. Facil itate cooperation in the field of news between the Indonesian National Agency (ANT ARA) and the Korean Central News Agency (KCNA);

9. Provide technical facilities for journalist and technical staff in charge of coverage of national events of the other Party.

ARTICLE 4 Financial Arrangement

1. Should the sendi.ng of the material be subject to the payment of an honorarium or other financial conditions, the Party sending the material shall inform t he other Party of those conditions before dispatching the material and shall send it after receiving the letter's written consent;

2. In case of exchange of visit, the sending party shall cover the travel expenses from and to its country, and the receiving country shall cover the local transportation in its territory necessitated by the arrangement agreed upon;

3. All other financial arrangement to pursue any activities stipulate in article 2 of this MoU are subject of negotiation and subject to the availability cf fund and other resources of the country.

ARTICLE 5 Confidentiality

1. Each party shal I undertake to observe the confidentiality of documents. information and other data received during the period of implementation of this MoU.

2. In the event of the termination of this MoU , the Parties agree that the provision of this Article will survive the termination.

ARTICLE 6 Joint Committee

1. For the purpose of the implementation of this MoU, the Parties shall establish a Joint Committee responsible for performing the following functions:

(1) to carry on mutual consultations and make proposal to the relevant authorities that might best facilitate the implementation of this MoU;

(2) to suggest new methods of cooperation between the Parties in the field of information;

(3) to prepare executive programs, including financial and other budgetary aspects related to the implementation of this MoU;

(4) to follow up, p13riodically, the implementation of the provisions of this MoU, upon requec;t of each Party.

2. The Joint Committee shall meet once each two years alternatively in the respective countries to evaluate the cooperation between the Parties and elaborate the executive program for the following period of two years. Under certain circumstances the meeting could not be held, documents shall be exchanged in lieu of such meeting.

ARTICLE 7 Intellectual Property Rights

1. The Parties agree . that any intellectual property arising under the implementation of this MoU will be jointly owned and:

(i) Each Party shall be allowed to use such intellectual proverty for the purpose of maintaining, adapting and improving the relevant proverty.

(ii) In the event the Party and/or institution on behalf of the Government use the intellectual property for commercial purposes, the other Party shall be entitled to obtain equitable portion of royalty.

(iii) Each Party shall be liable for any claim made by any third party on the ownership and legality of the use of the intellectual property rights which the aforementioned Party brings in under this MoU for the

implementation of the cooperation activities.

-2. The Parties shall ensure that the Intellectual Property brought by the Party into the territory of the other Party for the implementation of any project arrangement of activities will not result in the infringement of third Party's legitimate rights.

3. If either of the Party wishes to disclose confidential data and/or information that resulted from the cooperation activities under this agreement to any third party, the disclosing party must obtain prior consent from the other Party before any disclosure can be made.

4. Whenever either Party requires the cooperation of another party outside the Republic of Indonesia and the Democratic People's Republic of Korea for any commercial undertaking that involves Intellectual property covered by this MoU this Party will give first preference of the cooperation to the other Party under this MoU which will be waived , if the other Party is unable to participate in a mutually beneficial manner.

ARTICLE 8 Executing Agencies

For implementation of this MoU, the Parties designated as follows:

A. The Ministry of Communication and Information Technology for the Government of the Republic of Indonesia;

B. The Information Committee, for the Government of the Democratic People's Republic of Korea

ARTICLE 9

Limitation of Personnel

Each party shall ensure that all personal engage in the activities under this · MoU will not involve in any political affairs and/or any commercial ventures in the

host country outside the activities or programs on cooperation under this MoU. 1•

ARTICLE 10 Exchange of Material

All material obtained under this MoU shall be used at the discretion of the Party receiving it, provided the letter shall comply with the fo!lowing conditions:

A. The material, for the purpose that it is sent, may not be handed over to a third party or used for commercial purposes;

B. The material that is sent to each party shall be in English;

C. Either Party may edit each other's news and programs faithfully and professionally. Under no circumstances shall the facts and content of the news or programs be changed;

D. The selection and used of each other's material shall be completely and entirely left to the discretion of each Party

-ARTICLE 11 Amendment

1. Either Party may request in writing a revision or amendment of any part of this MoU.

2. Any revision of amendment agreed to by the Parties shall form an integral part of this Mou and shall come into effect on the date of signing by the Parties.

ARTICLE 12 Settlement of Disputes

1. Any difference or dispute arising out of the interpretation or application of the provisions of this MoU shall be settled amicably by consultation or negotiation between the Parties.

2. Each Party reserves the right to suspend temporally the implementation of this MoU, due notitication shall be given to the other party through diplomatic channels.

ARTICLE 13

Entry into Force, Duration and Termination

1. This MoU shall come into force on the date of its signing.

2. This MoU shall remain in force for a period of 5 (five) years and automatically renewed for every 5 (five) years consecutively unless it is denounced in writing by either party giving 6 (six) months notice prior to the termination of this MoU through diplomatic channels.

3. The termination of this MoU shall not affect the validity and duration of any on going programs and activities made under this MoU.

IN WITNESS WHEREOF the undersigned, being duly authorized by their respective Governments, have signed this Memorandum of Understanding.

Done at Jakarta on the nineteenth day of February in the year 2009 (two thousand and nine), in the Korean, Indonesian, and English languages, all text being equally authentic. In case of any divergence in interpretation of this Memorandum of Understanding, the English text shall prevail.
