PEMERINTAH ROMANIA
Pemerintah Republik Indonesia dan Pemerintah Romania, yang dalam Persetujuan ini disebut "Kedua Pihak", terdorong oleh keinginan untuk mengembangkan dan mengokohkan hubungan ekonomi dan perdagangan antara kedua negara, berdasarkan prinsip per-samaan dan keuntungan timbal-balik, telah mencapai persetujuan sebagai berikut :
Pasal 1
Kedua pihak, sesuai dengan perundang-undangan,
peraturan-peraturan dan prosedur yang berlaku pada masing-masing negara, akan mengambil .tindakan yang diperlukan untuk memberi-kan kemudahan, memperkokoh dan mendiversifikasimemberi-kan perdagangan barang dan jasa antara kedua negara.
Pasal 2
Masing-masing Pihak, selaku anggota The General Agreement on Tariffs and Trade (GATT) akan memberikan kepada Pihak lain dalam Persetujuan ini perlakuan yang paling
menguntungkan dalam semua hal yang berkaitan dengan :
a. ~ea masuk dan segala pungutan, termasuk cara penarikan bea dan pungutan, yang dikenakan pada atau yang menyangkut impor dan ekspor, atau yang dikenakan pada transfer pembayaran untuk impor dan ekspor.

-b. Peraturan-peraturan, cara-cara dan pungutan
yang bertalian dengan penyelesaian bea cukai; 1·
c. Semua pajak dalam negeri atau segala macam pungutan dalam negeri-lainnya yang dikenakan pada atau yang berkaitan dengan barang-barang impor dan ekspor.
Pasal 3
Ketentuan-ketentuan didalam Pasal sebelumnya dalam Persetujuan ini tidak berlaku terhadap keuntungan-keuntungan, keistimewaan atau pengecualian-pengecualian yang masing-masing Pihak telah memberikan atau yang mungkin akan diberikan :
a. Kepada negara-negara tetangga untuk mengem-bangkan perdagangan.
b. Kepada negara-negara yang menjadi anggota suatu kesatuan pabean atau wilayah perdagangan bebas, dimana masing-masing Pihak telah atau akan
menjadi peserta.
c. Sebagai akibat keikut-sertaan dalam pengaturan perdagangan bilateral, multilateral dan
regional.
d. Terhadap barang-barang yang diimpor dalam rangka program pemberian bantuan dari negara-negara atau badan-badan dan organisasi-orga-nisasi internasional.
Pasal 4
1. Kapal-kapal dari salah satu Pihak dan muatan, penumpang serta awak kapalnya, dalam hal masuk, keluar dan tinggal di pelabuhan negara Pihak lainnya, akan menikmati keuntungan-keuntungan yang serupa seperti diberikan oleh undang-undang, ketentuan dan peraturan kepada kapal-kapal yang berlayar dibawah bendera negara ketiga.
2. Ketentuan-ketentuan tersebut dalam sub 1 Pasal ini tidak berlaku terhadap perdagangan pantai.
Pasal 5
Penyerahan barang-barang dan jasa akan dilakukan sesuai dengan Persetujuan ini atas dasar kontrak-kontrak yang dibuat antara warganya, perusahaan-perusahaan atau organisasi-organisasi dari masing-masing negara yang dapat melakukan aktivitas perdagangan luar negeri menurut ketentuan-ketentuan dan peraturan-peraturan yang berlaku di kedua negara dan
kebiasaan perdagangan internasional.
Kedua Pihak akan mendorong dan memberikan bantuan seperlunya kepada perusahaan-perusahaan dan organisasi-orga-nisasi yang berkepentingan di masing-masing negara untuk menjajagi kemungkinan diadakan pengaturan-pengaturan perda-gangan sesuai dengan perundang-undangan yang berlaku di masing-masing negara.
Pasal 6
Segala pembayaran antara kedua negara akan di-lakukan dalam mata uang yang secara bebas dapat dipertukarkan seperti yang ditetapkan oleh Dana Moneter Internasional (IMF), atau dengan pembayaran lainnya yang disetujui oleh Kedua
Pihak.
Pasal 7
Kedua Pihak apabila perlu, mengeluarkan izin impor dan ekspor kepada warganya, perusahaan-perusahaan dan organisasi-organisasi di masing-masing negara, sesuai dengan undang-undang dan peraturan-peraturan yang berlaku di masing-masing negara.
Pasal 8
Ketentuan-ketentuan dalam Persetujuan ini tidak akan membatasi hak-hak dari masing-masing Pihak untuk

-menetapkan dan melaksanakan tindakan-tindakan yang bertalian dengan perlindungan dan pengamanan kesehatan umum atau pen-cegahan penyakit dan hama pada hewan dan tanaman.
Pasal 9
Untuk mengembangkan perdagangan antara kedua negara, kedua Pihak akan mendorong dan memberikan fasilitas kunjungan-kunjungan para pengusaha, wakil-wakil perusahaan dan organisasi serta delegasi dagang,dan partisipasi dalam pameran-pameran dagang yang diadakan di kedua negara.
Pasal 10
Kedua Pihak akan mengadakan konsultasi apabila dianggap perlu untuk mempertimbangkan langkah-langkah guna memperluas perdagangan timbal-balik atau untuk memecahkan masalah-masalah yang mungkin timbul sehubungan dengan pelak-sanaan ketentuan-ketentuan dari Persetujuan ini.
Pasal 11
Persetujuan ini akan berlaku mulai .tanggal pem-beritahuan terakhir untuk dilaksanakannya Persetujuan ini oleh kedua Pihak menurut persyaratan perundang-undangan kedua negara, dan akan berlaku untuk jangka waktu 3 tahun, dengan perpanjangan berlakunya secara otomatis untuk jangka waktu 3 tahun lagi, kecuali apabila salah satu Pihak memberitahukan secara tertulis 3 bulan sebelum habis berlakunya tentang
niatnya untuk mengakhiri Persetujuan ini.
Pada tanggal mulai berlakunya Persetujuan ini, Persetujuan yang lama antara kedua Pemerintah yang ditanda-tangani pada tanggal

Maret 1975 di Bucharest, menjadi tidak berlaku lagi.Ketentuan-ketentuan yang tercantum dalam Perse-tuj uan ini akan tetap berlaku setelah berakhirnya PersePerse-tujuan khususnya mengenai kontrak-kontrak yang dibuat selama Perse-tujuan tersebut masih berlaku, akan tetapi belum dilaksanakan
sepenuhnya pada tanggal berakhirnya Persetujuan.
Persetujuan ini dapat dirubah atas kesepakatan bersama. Suatu perubahan atau pengakhiran Persetujuan ini harus dilakukan tanpa mengganggu hak-hak dan kewajiban yang ditimbulkan dari atau yang telah disepakati atas dasar Per-setujuan ini, sampai pada tanggal perubahan atau pengakhiran Persetujuan.
Sebagai bukti, yang bertanda tangan dibawah ini dengan diberi kuasa oleh Pemerintah masing-masing telah menanda tangani Persetujuan ini.
Dilakukan di Bucharest, Romania, pada tanggal 3 Mei 1991 dalam rangkap tiga asli masing-masing dalam bahasa Indonesia, Romania dan Inggris; semua naskah mempunyai
ke-absahan yang sama, apabila terdapat perbedaan dalam penafsiran antara masing-masing naskah Persetujuan ini, maka naskah
berbahasa Inggris yang dipergunakan menjadi dasar.

TRADE AGREEMENT
between
THE GOVERNMENT OF
THE
REPUBLIC
OF
INDONESIA
and
THE GOVE
RNM
ENT OF ROMANIA
The Government of the Republic of Indonesia and the
Government of Ro
m
ania (hereinafter ref erred to as
"
the
Contracting
Parties
"),
desirous of developing and
strengthen-ing economic and trade relations between the two countries on
the basis of equality and
mutual
benefit,
Have
agreed as
follows:
AR
TICLE 1
The Contracting
Parties
shall, subject to the laws,
regulations and procedures in force in their respective
countries take all appropriate measures to facilitate,strengthen
and diversify trade and services between the two countries.
ART
ICLE 2
Each Contracting
Party
as a member of General
Agree-ment on Tariffs and Trade (GATT) shall
grant
the other
Party
the most-favoured-nation treatment in all matters relating to:
a) customs duties and charges of any kind, including
the
method
of levying such duties and charges,
imposed on or in connection
with
importation or
exportation. or imposed on the transfer of
pay-ment for imports or exports;
b) rules, formalities and charges connected with
customs clearance; and

-c) all internal truces or other internal charges of
any kind imposed on or in connection with imported
and exported products.
ARTICLE
3
The provisions of the preceeding Article of this
Agreement shall not apply to advantages, preferences or
exceptions which either of the Contracting
Parties
has granted
or may grant:
a)
to neighbouring countries in order to improve
border trade;
b) to countries who are members of a customs union
or a free trade zone that either of the
Contract-ing
Parties
has joined or may join
·
;
c) as a result of participation in bilateral,
multi-lateral, as well as regional trading arrangements;
d) to goods imported under or by virtue of relief
programs
granted
by the countries or international
bodies and/or organizations.
ARTICLE 4
1. Ships of each country and their cargoes, passengers
and crews shall enjoy in respect of entry, exit and stay in the
ports of the other country the
advantages
similar to those
granted by its respective laws, rules and regulations to ships
sailing under the flag of third countries.
2. The provisions of para 1 shall not apply to coastal
trade.
ARTICLE
5
The deliveries of goods and services shall be made
in accordance
with
this Agreement on the basis of contracts
to be concluded between
nationals,
enterprises or organizations
of
each
country, enabled to do foreign trade
activities
,
in
keeping
with
the rules
and
regulations in force in
-
both
countries
and
the international trading practices.
The Contracting
Parties
shall encourage and provide
necessary
assistance
to the relevant
hationals
,
enterprises
or organizations of
each
country to explore the possibility
to conclude short or long term trading
arrangements
,
in
accord-ance
with
their respective legislation.
ARTICLE
6
All payments between the two countries shall be
effected in freely convertible currencies
as
defined by the
International
Monetary
Fund or otherwise the payments be
executed as mutually agreed
upon
by both sides.
ARTICLE
7
The Contr

undertake to grant, whenever
necessary, import and export licences to nationals, enterprises
and
organizations
:intheir respective countries,
inaccordance
with
.
the laws and regulations in each country.
ARTICLE
8
The provisions of this Agreement shall not limit the
rights of either Contracting
Party
to adopt or execute measures
relating to the protection of its security and public health or
the
prevention
of diseases and pests in animals and plants.
ARTICLE
9
With
a view to promoting trade between the two
countries, the Contracting
Parties
shall encourage and facilitat=
the visits by businessmen, representatives of companies or
organizations and trade delegations, as
well
as the
participa-tion in fairs and exhibiparticipa-tions organized in the two countries
•

Both Parties shall consult each other, whenever
necessary, in order to recommend measures for expanding
mutual
trade or to solve problems that might arise
in
connec-tion with the implementaconnec-tion of the provisions of this
Agree-ment.
ARTICLE
11
This Agreement shall come into force on the date
of
the last notification regarding the carrying out by both
Contracting
Parties
of the requirements of their own
legisla-tion and shall be valid for a period of
3
years, with automatic
extension for additional
3
year periods, unless one of the
Contracting Parties notifies, in writing,
3
months before
expiry of the period of validity, its intention to terminate it.
On the date of coming into force of this Agreement,
the previous Trade Agreement between the two Governments,
signed on
March
8,
1975,
in Bucharest,
ce
ases
its validity.
The provisions
of
this Agreement shall remain equally
applicable after its termination in respect
of
all contracts
concluded during the period of its validity but which have not
been fully implemented on
the date of its expiry.
This
Agreement
may be modified by mutual consent.
Any
such modification or termination of this Agreement shall
be made without prejudice to the rights and obligations
deriving from, or contracted on the basis
of
this Agreement,
upto the date of such modification or termination.
In witness thereof, the undersigned, duly authorised
thereto by their respective Government, have signed this
Agree-ment.

and in English, all texts being equally authentic.
Inthe event
of discrepancies between any of the texts of this Agreement, the
English text shall prevail.
