ON
THE TEAM IN CHARGE OF CONTROLLING LABOR CRISIS IN THE FIELDS OF INDUSTRY AND TRADE
THE MINISTER OF MANPOWER AND TRANSMIGRATION AND THE MINISTER OF INDUSTRY AND TRADE,
Consideration :
a. that the expansion of job opportunities and business opportunities is a key to the success of the Indonesian economic recovery;
b. that the expansion of job opportunities and business opportunities as referred to in letter a is done in line with efforts to improve work productivity and worker's welfare;
c. that one of the efforts to improve work productivity and worker's welfare as referred to in latter b is made by preventing labor upheavals particularly those occurring in the industrial and trade sectors;
d. that based on the considerations as referred to in letter a, b and c, it is necessary to form a team in charge of controlling labor crisis in the fields of industry and trade by stipulating a joint decree of the Minister of Manpower and Transmigration and the Minister of Industry and Trade.
In view of :
1. Law No. 14/1969 on the principles of labor force (Statute Book of 1969 No. 55, Supplement to Statute Book No. 2912);
2. Law No. 5/1984 on industry (Statute Book of 1984 No. 22, Supplement to Statute Book No. 3274);
3. Presidential Decree No. 228/M/2001 on the formation of the Mutual Help Cabinet. DECIDES :
To stipulate :
CONTROLLING LABOR CRISIS IN THE FIELDS OF INDUSTRY AND TRADE. CHAPTER I
GENERAL PROVISIONS Article 1
Hereinafter referred to as :
1. Labor crisis shall be the condition that causes discomfort in doing work and business, thus impeding work productivity and worker's welfare.
2. Team in charge of controlling labor crisis in the fields of industry and trade, hereinafter referred to as crisis-controlling team, shall be the joint consultative team of the Minister of Manpower and Transmigration, the Minister of Industry and Trade, the Organization of Businessmen, and the Labor Union/Trade Union.
CHAPTER II
FORMATION AND LINEUP Article 2
(1) A team in charge of controlling labor crisis in the fields of industry and trade shall be formed.
(2) The Minister of Manpower and Transmigration and the Minister of Industry and Trade shall jointly form the crisis-controlling team as referred to in paragraph (1).
Article 3
(1) The lineup of the crisis-controlling team as referred to in Article 2 shall consists of :
a. Chairman I : The Director General of Industrial Relations Development and Manpower Supervision, Ministry of Manpower and Transmigration;
b. Chairman II : The Director General of Chemical, Agro and Forestry Product Industry, Ministry of Industry and Trade;
c. Secretary I : The Director of Labor Requirements and Dispute Settlement, Ministry of Manpower and Transmigration;
d. Secretary II : The Secretary of the Directorate General of Metal, Machinery, Electronic and Miscellaneous Industry, Ministry of Industry and Trade;
e. Members :
1. The Head of the Planning Bureau, Ministry of Manpower and Transmigration; 2. The Head of the Financial Bureau, Ministry of Manpower and Transmigration;
Workers Placement, Ministry of Manpower and Transmigration;
4. The Secretary of the Inspectorate General, Ministry of Manpower and Transmigration;
5. The Head of the Legal and Organizational Affairs Bureau, Ministry of Manpower and Transmigration;
6. The Director of the Industrial Relation Institute Development, Ministry of Manpower and Transmigration;
7. The Director of Manpower Norms Supervision, Ministry of Manpower and Transmigration;
1. The Head of the Planning Bureau, Ministry of Industry and Trade;
2. The Head of the Financial and Equipment Bureau, Ministry of Industry and Trade;
3. The Secretary of the Directorate General of Chemical, Agro and Forestry Product Industry, Ministry of Industry and Trade;
4. The Secretary of the Directorate General of Small and Medium Industry and Trade, Ministry of Industry and Trade;
5. The Secretary of the Inspectorate General of the Ministry of Industry and Trade;
6. The Head of the Legal and Organizational Affairs Bureau, Ministry of Industry and Trade;
7. The Director of Business Development and Corporate Registration, Directorate General of Domestic Trade, Ministry of Industry and Trade;
(2) In carrying out its tasks, the crisis-controlling team shall involve elements of the Labor Union/Trade Union and the Indonesian Chamber of Commerce and Industry/Businessmen Association.
(3) The participation of the elements of the Labor Union/Trade Union and the Indonesian Chamber of Commerce and Industry/Businessmen Association as referred to in paragraph (2) shall take into account the substance of the matter discussed.
CHAPTER III
TASK AND RESPONSIBILITY Article 4
The task of the crisis-controlling team shall be to :
a. inventory and discuss manpower issues in the industrial and trade sectors;
b. industry and analyze steps to control manpower crisis in the industrial and trade sectors;
c. formulate efforts to prevent manpower cases in the industrial and trade sectors as well as in other sectors, if necessary;
relevant parties;
e. if necessary, formulate efforts to prevent manpower cases and recommend steps to settle manpower cases to the relevant parties;
f. report the realization of task to the Minister of Manpower and Transmigration and Minister of Industry and Trade.
Article 5
The crisis-controlling team shall be responsible to the Minister of Manpower and Transmigration and Minister of Industry and Trade.
Article 6
In carrying out its tasks, the crisis-controlling team can coordinate with relevant parties. Article 7
To ensure that the crisis-controlling team can carry out its tasks as referred to in Article 2 smoothly, the team shall be assisted by the secretariat formed by the chairman of the team.
Article 8
The working system of the crisis-controlling team as referred to in Article 2 and the secretariat shall be further stipulated by the chairman of the team.
CHAPTER IV EXPENSE
Article 9
The expense arising from the implementation of this joint decree shall be borne by the budget of the Minister of Manpower and Transmigration and Minister of Industry and Trade according to their respective authority.
CHAPTER V OTHER PROVISIONS
Article 10
With the formation of the crisis-controlling team, the existing team in charge of preventing and settling industrial relation problems shall remain valid, provided that it is not against the crisis-controlling team.
