THE ASIAN

COCONUT

COMMUNITY

PREAMBLE

The Governments of Ceylon, India, Indonesia, Malaysia, Philippines, Singapore and Thailand, parties to this Agreement (hereinafter called the Contracting Parties),

CONVINCED that the present situation of and future outlook for the

coconut industry necessitates their joining together and developing a well-planned programme of concerted action to solve their common problems and to enable them to obtain the benefits of economies of scale in the areas of production, marketing and research generally,

RECOGNIZING that the formation of a regional organization among the

developing Asian countries having a substantial interest in the production and marketing of coconut products is a necessary and effective instrument for implementation of the basic strategy of plan harmonization and partial integration on a commodity basis for achieving accelerated development of their economies,

BELIEVING that such a regional grouping is in accordance with the

principle endorsed by the United Nations Economic Commission for Asia and the Far East at its twenty-third and twenty-fourth sessions held in 1967 and 1968 respectively, the United Nations Economic and Social Council at its forty-third and forty-fifth sessions, and also by the United Nations Conference on Trade and Development at its first session in 1964 in General Principle Ten of its Final Act,

REALIZING that the co-ordination of national efforts among the interested countries of the region that could be effected by such an organization would lead to greater economy of resources and would yield better and quicker results, and

PRAAMBULE

Les Gouvernements de Ceylan, de l'Inde, de l'Indon~sie, de la Malaisie, des Philippines, de Singapour et de la Thailande, parties au present Accord, (ci-apr~s d~nomm~s les Parties contractantes),

CONVAINCUS que la situation actuelle et les perspectives d'avenir de l'industrie de la noix de coco n6cessitent qu'ils s'unissent et 6laborent un programme bien con~u d'action concert~e pour r~soudre leurs probl~mes communs et leur permettre de recueillir les avantages des 6conomies d'chelle dans les domaines de la production, de la commercialisation et de la recherche en g~n6ral,

RECONNAISSANT que la formation d'une organisation r~gionale des pays en voie de d~veloppement d'Asie ayant un int6r~t substantiel dans la production et la commercialisation des produits d~riv~s de la noix de coco est un moyen ncessaire et efficace de mettre en oeuvre la strat6gie fondamentale d'harmonisation des plans et d'int~gration partielle par produit de base, propre h acclkrer leur d6veloppement 6conomique,

RECOGNIZING that such an organization would be of immense value in

the mobilization of resources for promoting the coconut industry in the region and for ensuring its rapid development,

HAVE RESOLVED to combine their efforts and have agreed as follows: Article 1

ESTABLISHMENT OF THE COMMUNITY

There shall be established an organization to be known as the Asian Coconut Community (hereinafter called the Community), having the member-ship, functions and powers hereinafter prescribed.

Article 2

MEMBERSHIP

1. Initially the Community shall consist of the Contracting Parties only, or such number of them not being less than three which shall have ratified this Agreement as hereinafter provided.

2. Other developing countries which are States members of the United Nations Economic Commission for Asia and the Far East may apply to become members of the Community and may become members on the unanimous decision of the then existing members of the Community and by

accession to this Agreement.

Article 3

FUNCTIONS

The functions of the Community shall be to promote, co-ordinate and harmonize all activities of the coconut industry with a view to achieving the maximum economic development of the industry, and to these ends the Community shall:

(1) In the field of production, identify common problems and evolve common solutions by taking into account among other factors the experience of the member States;

(2) In the area of the processing industries, study and seek ways and means of improving the efficiency and diversification of those industries so as to maximize the utilization of their industrial potential;

Article premier

CRtATION DE LA COMMUNAUTt

II est cr6 une organisation d6nomm6e Communaut6 asiatique de la noix de coco (ci-apr~s d6nomm6e la Communaut6), dont la composition, les fonctions et les pouvoirs sont d6finis ci-apr~s.

Article 2

COMPOSITION

1. A l'origine, la Communaut6 sera compos6e des Parties contractantes seulement, ou de celles d'entre elles, dont le nombre ne devra pas 6tre inf~rieur

trois, qui auront ratifi6 le present Accord comme il est pr6vu ci-apr~s.

2. Tous les autres pays en voie de d6veloppement qui sont membres de la Commission 6conomique des Nations Unies pour l'Asie et l'Extr~me-Orient pourront demander h faire partie de la Communaut6 et pourront en devenir membres par decision unanime des i tats composant alors la commu-naut6 et en adh6rant au pr6sent Accord.

Article 3

FONCTIONS

La Communaut6 a pour but d'encourager, de coordonner et d'harmoniser l'ensemble des activit~s de l'industrie de la noix de coco en vue d'assurer son d6veloppement 6conomique maximal et,

cette fin, elle a pour fonctions:

1. En ce qui concerne la production, de d6finir les probl~mes communs et de concevoir des solutions communes en tenant compte, notamment, de

'exp~rience des Rtats membres;

2. En ce qui concerne le traitement, de rechercher et d'6tudier des moyens d'augmenter le rendement des industries de la noix de coco et de les diversifier, afin d'utiliser leurs possibilit6s au maximum;

(4) Study the possibilities of enlarging the markets both among the coun-tries of the region and elsewhere and to this end undertake market surveys and market research regarding coconut products;

(5) Study and seek ways and means of improving and establishing uniform standards for products of the coconut industry with a view not only to improving marketing but also to securing higher rewards to the producer for better quality production;

(6) Study and seek to evolve improved trade procedures and practices acceptable both to exporters and importers;

(7) Study the problem of both internal and external transport of the products of the coconut industry, including shipping facilities, and in particular the question of freight rates;

(8) Study and seek ways and means of removing trade restrictions advers-ely affecting the coconut industry, paying due consideration to the balance of payments and other problems of the developing countries;

(9) Study and seek ways and means of promoting the development of bilateral or multilateral exchanges of goods or other payment arran-gements among the countries of the ECAFE region with the object of facilitating the marketing of coconut products within the region;

(10) Assist member States to intensify their own research activities by

mobilizing both internal and external resources and technical assistance and by promoting the co-ordination of the research activities of member States, and undertake intensive research into all aspects of the coconut industry, seeking the help of national and international organizations;

(11) Evolve training programmes for the training of appropriate personnel to meet the varying needs of the coconut industry;

(12) Make requests on behalf of member States for financial and other forms of assistance in support of coconut industry projects and studies;

7. D'6tudier le probl~me du transport int~rieur et ext6rieur des produits de l'industrie de la noix de coco, y compris le transport maritime et en particulier la question des frets;

8. De rechercher et d'6tudier des moyens de supprimer les obstacles aux 6changes qui sont pr6judiciables h. l'industrie de la noix de coco, en tenant daiment compte des difficult6s de balance des paiements et des autres probl~mes des pays en voie de d6veloppement;

9. De rechercher et d'6tudier des moyens d'encourager les 6changes bila-t~raux et multilat6raux de marchandises ou d'autres arrangements concernant les paiements entre les pays de la r6gion de la CEAEO, en vue de faciliter la commercialisation, dans la region, des produits d~riv~s de la noix de coco;

10. D'aider les Ittats membres h intensifier leurs activit~s de recherche en mobilisant leurs ressources, int6rieures et ext6rieures, et l'assistance technique, et en coordonnant leurs activit6s entre eux, et d'entreprendre une 6tude approfondie de tous les aspects de lindustrie de la noix de coco, en sollicitant le concours des organisations nationales et inter-nationales int~ress~es;

11. D'6laborer des programmes de formation du personnel n~cessaire pour r6pondre aux divers besoins de l'industrie de la noix de coco;

12. D'6tablir, au nom des Ittats membres, des demandes d'assistance, financi~re ou autre, en vue de 'ex6cution de projets et d'6tudes concernant l'industrie de la noix de coco;

(14) Perform such other functions as it may consider necessary to secure the maximum economic development of the coconut industry; and

(15) For the purpose of furthering the performance of its functions and accomplishing the aims and objectives of the Community, submit proposals and make recommendations to the Governments of member States and take appropriate measures to implement those proposals and recommendations which are approved by the Governments of member States.

Article 4

RELATIONSHIP WITH UNITED NATIONS ORGANIZATIONS

The Community shall maintain close relations with United Nations bodies and the specialized agencies. In carrying out its functions in any particular field the Community shall seek to consult and co-operate with the United Nations body or specialized agency having particular responsibility in that field.

Article 6

ORGANIZATION

1. Each member State shall be represented in the Community by one representative with plenipotentiary authority and may if it so desires also appoint one or more alternates. A member State may also designate one or more advisers to accompany its representative or alternate.

2. The chairmanship of the Community shall be held in turn by the representatives of member States in the alphabetical order of the member States. Each representative shall hold office for one year.

3. The Community shall be serviced by a secretariat comprised of a Director and such other staff as the Community may decide. The Director shall be selected and appointed by the Community to hold office for a term of five years on terms and conditions established by the Community. The Director shall appoint such other staff as are decided on by the Community on terms and conditions established by the Community. The secretariat of the Community will work in close co-operation with the secretariat of the United Nations Economic Commission for Asia and the Far East.

4. The Community shall submit reports on its activities not less than once a year to the Governments of member states.

Article 4

RAPPORTS AVEC LES ORGANISMES DES NATIONS UNIES

La Communaut6 entretiendra des rapports 6troits avec les organes de I'ONU et les institutions spcialis6es. Dans l'accomplissement de ses taches dans tous les domaines, la Communaut6 demandera les conseils et la coop6ration de l'organe de PONU ou de l'institution sp6cialis6e comp6tents.

Article 5

ORGANISATION

1. Chaque IRtat membre est repr~sent6 k _{la Communaut6 par un}

pl6nipotentiaire auquel peuvent 6tre adjoints un ou plusieurs suppliants. I peut designer en outre un ou plusieurs conseillers pour accompagner son repr~sentant ou son suppliant.

2. La Communaut6 est pr6sid6e, par rotation, par le repr6sentant de

chaque iRtat membre, selon l'ordre alphab~tique des Rtats membres. La dur6e du mandat du pr6sident est d'un an.

3. Le service de la Communaut6 est assur6 par un secretariat compos6

d'un directeur et du personnel que la Communaut6 d6cide de lui adjoindre. Le directeur est choisi et nomm6 par la Communaut6 pour une dur6e de cinq ans aux conditions fix~es par elle. Le directeur nomme le personnel approuv6

par la Communaut6 aux conditions fix~es par elle. Le secr6tariat de la Communaut6 travaille en 6troite collaboration avec le secretariat de la

Commission 6conomique des Nations Unies pour l'Asie et l'Extr~me-Orient.

4. La Communaut6 pr6sente au moins _{une fois par an un rapport}

d'activit6 aux gouvernements des ttats membres.

Article 6

RPUNIONS DE LA COMMUNAUTA

2. The Community shall meet as often as the Director considers necessary but in any case not less than twice in each calendar year. In addition the Community shall meet if a request to that effect is made in writing to the Director by any two members of the Community. The Director shall be responsible for convening all meetings of the Community.

3. Decisions of the Community shall be unanimous among members present and voting.

Article 7

OBSERVERS

The Community may invite representatives of Governments of non-member States and of United Nations bodies and specialized agencies to attend meetings of the Community in the capacity of observers without the right to vote.

Article 8

FINANCE

The administrative and operational expenses of the Community shall be met by contributions from member States assessed in accordance with decisions made by the Community.

Article 9

GENERAL PROVISIONS

1. Subject to the provisions of the Agreement the Community shall adopt such regulations, including financial and staff regulations, as are necessary to carry out the provisions of this Agreement.

2. The Community shall be a separate legal entity with the capacity to contract and the right to acquire, hold and dispose of property.

2. La Communaut6 se r6unit aussi souvent que le directeur le juge n~cessaire, mais, en tous les cas, au moins deux fois par annie civile. En outre, la Communaut6 se r6unit, si une demande 6crite h cet effet est adress~e au directeur par deux membres de la Communaut6. Article 7

OBSERVATEURS

Article 8

FINANCEMENT

Les d~penses d'administration et de fonctionnement de la Communaut6 sont couvertes par les contributions des Etats membres dont le montant est d6termin6 conform6ment aux d6cisions de la Communaut6.

Article 9

DISPOSITIONS GtNtRALES

1. Sous reserve des dispositions du pr6sent Accord, la Communaut6

adoptera les r~glements, y compris le r~glement financier et le r~glement du personnel, n~cessaires pour ex~cuter lesdites dispositions.

2. La Communaut6 est une personne juridique autonome ayant la capacit6 de contracter et le droit d'acqu6rir et de d6tenir des biens et d'en disposer.

Article 10

SIGNATURE

Le present Accord, fait en un exemplaire unique en langue anglaise, est

ouvert h la signature des repr~sentants dfiment accr~dit~s des Parties contractantes, au si~ge de la Commission 6conomique des Nations Unies

pour l'Asie et l'Extr~me-Orient, h Bangkok, jusqu'au 30 juirr 1969. L'Accord

sera ensuite transmis au Secr6taire g6n~ral de 'Organisation des Nations

Article 11

RATIFICATION

This Agreement shall be subject to ratification or acceptance by the signatory Governments in accordance with their respective constitutional procedures.

Instruments of ratification or acceptance shall be deposited with the Secretary-General of the United Nations not later than 31 December 1969.

Article 12

ENTRY INTO FORCE

This Agreement shall enter into force between those Contracting Parties which have deposited instruments of ratification or acceptance when not less than three of them have deposited such instruments.

Article 13

ACCESSION

Other States members of ECAFE may accede to this Agreement in accordance with the provisions of article 2 (2).

Article 14

VOLUNTARY WITHDRAWAL

After this Agreement has entered into force a member State may withdraw voluntarily from the Agreement by giving written notice of withdrawal to the Secretary-General of the United Nations. Withdrawal shall become effective ninety days after the notice is received.

Article 15

AMENDMENT

The Community may by a unanimous vote of the members present and voting amend the provisions of this Agreement. The Secretary-General of the United Nations shall be notified forthwith of any such amendment.

Article 16

NOTIFICATIONS BY THE SECRETARY-GENERAL OF THE UNITED NATIONS

Article 11

RATIFICATION

Le present Accord est sujet & ratification ou acceptation par les

gou-vernements signataires, conform~ment h leur proc6dure constitutionnelle.

Les instruments de ratification ou d'acceptation seront d~pos6s aupr~s du Secr6taire g~n~ral de l'Organisation des Nations Unies au plus tard le 31 d~cembre 1969.

Article 12

ENTRtE EN VIGUEUR

Le pr6sent Accord entrera en vigueur entre les Parties contractantes ayant d6pos6 des instruments de ratification ou d'acceptation quand trois au moins d'entre elles auront d~pos6 lesdits instruments.

Article 13

ADHtSION

Les autres membres de la CEAEO peuvent adh~rer au pr6sent Accord

en application des dispositions du paragraphe 2 de l'article 2.

Article 14

RETRAIT VOLONTAIRE

Apr~s l'entr~e en vigueur du present Accord, un Rtat membre pourra s'en retirer volontairement en donnant notification 6crite de son retrait au

Secr~taire g~n~ral de l'Organisation des Nations Unies. Le retrait prendra effet 90 jours apr~s la date de r~ception de la notification.

Article 15

MODIFICATION

La Communaut6 peut, par un vote unanime des membres pr6sents et votants, modifier les dispositions du present Accord. Toute modification est port6e imm6diatement h la connaissance du Secr~taire g~n~ral de l'Organisation des Nations Unies.

Article 16

NOTIFICATIONS PAR LE SECRP-TAIRE GtNtRAL DE L'ORGANISATION DES NATIONS UNIES

Le Secr~taire g~n~ral de l'Organisation des Nations Unies notifiera aux Parties contractantes le d~p6t de chaque instrument de ratification, d'acceptation ou d'adh6sion, ainsi que la date k laquelle le pr6sent Accord

entrera en vigueur.

IN WITNESS WHEREOF the undersigned, having been duly authorized

to this effect by their respective Governments, have signed this Agreement on the dates appearing opposite their signatures.

The original of this Agreement and any amendments thereto shall be deposited in the archives of the United Nations and the Secretary-General of the United Nations shall transmit certified copies thereof to each signatory and acceding Government.
