AMENDMENT TO THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 230/MPP/Kep/7/1997 ON GOODS SUBJECT TO THE

IMPORT TRADE SYSTEM AS ALREADY SEVERAL TIMES AMENDED THE LATEST BY THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO.

290/MPP/Kp/6/1999

THE MINISTER OF INDUSTRY AND TRADE

Considering :

a. that with a view to preventing the emergence of deeper social disparity and unrest in the economic crisis, it is necessary to control the import motor vehicles in completely built-up (CBU) condition;

b that for this purpose it is necessary to issue a decree of the Minister Industry and Trade to this effect.

In view of:

1. Law No. 14/1992 on road traffic and transportation (Statute Book of 1992 No. 49 Supplement to Statute Book No. 3480);

2. Government Regulation No. 44/1993 on motor vehicles and drivers (Statute Book of 1993 No. 64, Supplement to Statute Book No. 3530);

3. The Decree of the Minister of Finance No. 344/KMK.01/1999 on the amendment of the of the Decree of the Minister of Finance No. 440/KMK.05/1996on the classifications of goods and import duty rates off goods;

4. The Decree of the Minister Industry and Trade No. 230/MPP/Kep/7/1997 on goods subject to the import trade system;

5. The Decree of the Minister Industry and Trade No. 160/MPP/Kep/4/1998 on the amendment of the Decree of the Minister of Trade No. 77/Kp/III/78 on limited trading activities for production companies under investment arrangements;

6. The Decree of the Minister of Industry and Trade No. 275/MPP/Kep/6/1999 on the motor vehicle industry;

7. The Decree of the Minister of Industry and Trade No. 276/MPP/Kep/6/1999 on the registration of types and variants of motor vehicles;

8. The Decree of the Minister of Industry and Trade No. 550/MPP/4/1999 on importer’s identity numbers (API).

The Decree of the Minister of Industry and Trade No. 290/MPP/Kp/6/1999 on the Decree of the Minister of Industry and Trade No. 230/MPP/Kep/7/1997 on goods subject to the import trade system as already several times amended the latest by the Decree of the Minister of Industry and Trade No. 439/MPP/Kep/9/1998.

To stipulate :

THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE CONCERNING AMENDMENT TO THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 230/MPP/Kep/7/1997 ON GOODS SUBJECT TO THE IMPORT TRADE SYSTEM AS ALREADY SEVERAL TIMES AMENDED THE LATEST BY THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 290/MPP/Kp/6/1999.

Article 1

To amend the Decree of the Minister Industry and Trade No. 230/MPP/Kep/7/1997 as follows:

1. To revoke Article 1 Letter h.

2. To amend Article 6, so that it reads :

Article 6

1. The import of motor vehicles in completely built-up (CBU) condition shall be realised by Companies already possessing importer’s identity numbers (API) or limited importer’s identity numbers (APIT)

2. Importers of motor vehicles as meant in paragraph (1) shall meet the following document requirements :

a. Vehicle Identification Numbers (VIN) from manufacturing countries of origin, at least mentioning originating countries;

b. Test certificates/evidence of types from the Ministry of Communications, for the types of motor vehicles imported exceeding 10 (ten) units;

c. Test certificates/evidence of types from manufacturing countries of origin or countries of origin of import for the types of motor vehicles imported up to 10 (ten) units;

d. Statements from importers on guarantee effective in Indonesia for quality after sale service;

e. Other documents stipulated by the Director General of Metal, Machine, Electronic and Multifarious Manufacturing Industries.

2. Article 6A shall be inserted between Article 6 and Article 7, which reads : Article 6A

The import of the following motor vehicles in CBU condition shall be prohibited:

a. Motor vehicles for the transport of less than 10 (ten) persons of the type of sedan/station wagon of a cylinder capacity of 4000 cc or more (tariff heading numbers HS 8703.33.190 and 8703.90.000) or at the FOB price of USD 40.000 or more.

b. Motor vehicles for the transport of less than 10 (ten) persons of the 2 (two) drive-axle system of a cylinder capacity of 5000 cc or more (tariff heading numbers HS 8703.24.929, 8703.33.190 and 8703.90.000) or at the FOB price of USD 40.000 or more. c. With the stipulation of this decree, all other provisions contained in the Decree of the

Minister of Industry and Trade No. 230/MPP/Kep/7/1997 shall be declared null and void. Article II

This decree shall come into force as from the date of stipulation.

For public cognizance, this decree shall be announced by publishing it in the State Gazette of the Republic of Indonesia.
