MEMORANDUM SALING PENGERTIAN ANT ARA

PEMERINTAH REPUBLIK INDONESIA DAN

PEMERINTAH REPUBLIK ARAB SURIAH MENGENAI

KERJASAMA DI BIDANG PARIWISATA

Pemerintah Republik Indonesia dan Pemerintah Republik Arab Suriah, selanjutnya disebut "Para Pihak" ;

BERHASRA T untuk memperkokoh hubungan persahabatan antara kedua negara di bidang pariwisata;

MENIMBANG perlunya mengembangkan dan meningkatkan hubungan pariwisata, termasuk kerjasama antar badan-badan resmi pariwisata;

SESUAI dengan hukum dan perundang-undangan yang berlaku bagi kedua Pihak. TELAH MENYETUJUI SEBAGAI BERIKUT :

PASAL1 Tujuan Kerjasama Memorandum Saling Pengertian ini bertujuan untuk:

a. Meningkatkan kedatangan wisatawan mancanegara dari negara-negara penghasil wisatawan dunia melalui Republik Indonesia dan/atau melalui Republik Arab Suriah; a. Mendorong distribusi kunjungan wisatawan lebih luas menuju ke berbagai daerah tujuan

dan atraksi wisata di tiap-tiap negara;

b. Mendorong kunjungan-kunjungan dari para warganegara dan penduduk kedua negara ke masing-masing negara; dan

c. Mendorong pertumbuhan industri pariwisata yang sehat di kedua negara.

PASAL 2

Badan-badan Pelaksana

Para Pihak bersepakat untuk menjalin kerjasama yang erat di bidang-bidang yang menyangkut masalah kepariwisataan, melalui badan-badan resmi, yang selanjutnya akan bertindak selaku pelaksana Memorandum Saling Pengertian ini. Dalam hubungan ini, pelaksana resmi dari Pemerintah Republik Indonesia adalah Direktorat Jenderal Pariwisata, Departemen Pariwisata, Pos dan Telekomunikasi, dan untuk Pemerintah Republik Arab Suriah adalah Direktorat Perencanaan dan Hubungan Luar Negeri, Kementerian Pariwisata.

PASAL 3

Bidang-Bidang Kerjasama

Kedua Pihak akan berupaya untuk meningkatkan kerjasama pariwisata sesuai dengan hukum dan peraturan yang berlaku di masing-masing negara, dalam bidang-bidang sebagai berikut:

1. Penelitian dan Pengembangan

Kerjasama di bidang penelitian dan pengembangan dilakukan melalui pertukaran informasi dan studi riset pada bidang-bidang yang saling menguntungkan kedua belah pihak.

2. Pendidikan dan Pelatihan

Kerjasama di bidang pendidikan dan pelatihan dilakukan melalui pertukaran informasi, studi banding atas program-program pelatihan serta peningkatan kemampuan baik di sektor pemerintah maupun sektor swasta.

3. Promosi

i) dalam bidang promosi, kedua pihak akan melakukan kerjasama dalam penyebaran bahan-bahan informasi pariwisata kedua negara.

ii) Para pihak akan meningkatkan arus wisatawan antara kedua negara dan akan berupaya untuk mencari jasa-jasa penting yang dapat ditawarkan untuk mendukung maksud tersebut.

4 . Pertemuan, lnsentif, Konvensi dan Pameran

Kerjasama di bidang pertemuan, insentif, insentif, konvensi dan pameran akan dilakukan melalui pertukaran program antara kedua negara.

5. Kerjasama dengan pihak swasta

Kerjasama di bidang pariwisata yang dilakukan oleh sektor swasta kedua negara akan didukung dan diperkuat.

PASAL 4 Pelaksanaan

1. Para pihak setuju untuk membentuk sebuah Kelompok Kerja yang akan memberikan kemudahan bagi pelaksanaan Memorandum Saling Pengertian ini.

2. Kelompok Kerja tersebut akan menetapkan prosedur, rencana kerja dan memberikan rekomendasi program-program kerjasama demi tercapainya tujuan, melalui badan-badan resmi sebagaimana tersebut dalam Pasal 2.

3. Kelompok Kerja akan meninjau kembali pelaksanaan atas Memorandum Saling Pengertian ini secara berkala dan melaporkan hasilnya kepada Badan-badan Pelaksana.

PASAL 5

Penyelesaian Sengketa

Perbedaan-perbedaan antara Para Pihak yang muncul dalam penafsiran dan/atau pelaksanaan dari Memorandum Saling Pengertian ini akan diselesaikan secara bersahabat melalui konsultasi dan negosiasi antara Para Pihak.

PASAL 6 Perubahan

Salah satu Pihak dapat meminta perubahan atau modifikasi secara tertulis dari Memorandum Saling Pengertian ini. Setiap perubahan atau modifikasi yang telah disetujui oleh kedua belah Pihak sesuai dengan hukum dan peraturan yang berlaku di masing-masing Pihak akan merupakan bagian dari Memorandum Saling Pengertian ini. Para Pihak akan menentukan tanggal berlakunya perubahan atau modifikasi tersebut.

PASAL 7 Mulai Berlaku

Memorandum ini mulai berlaku sejak tanggal penandatanganan.

PASAL 8 Masa Berlaku

a. Memorandum Saling Pengertian ini berlaku untuk jangka waktu 5 (lima) tahun dan selanjutnya akan secara otomatis diperpanjang berturut-turut setiap 5 (lima) tahun,

kecuali dibatalkan oleh salah satu Pihak dengan memberikan pemberitahuan tertulis 6

(enam) bulan sebelum berakhirnya Memorandum Saling Pengertian ini.

b. Pengakhiran Memorandum Saling Pengertian ini tidak akan mempengaruhi keabsahan dan berlakunya pengaturan-pengaturan, rencana-rencana, dan program-program yang dibuat berdasarkan Memorandum Saling Pengertian ini, hingga terselesaikannya pelaksanaan pengaturan-pengaturan, rencana-rencana dan program-program kerjasama tersebut.

MEMORANDUM OF UNDERSTANDING BETWEEN

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND

THE GOVERNMENT OF THE SYRIAN ARAB REPUBLIC ON

COOPERATION IN TOURISM

The Government of the Republic of Indonesia and the Government of the Syrian Arab Republic, hereinafter referred to as "the Parties" ;

DESIRING to strengthen the friendly relations between the two countries in the field of tourism ; CONSIDERING the need to develop and foster the tourism relations, as well as the cooperation between their official tourist agencies ;

PURSUANT to the prevailing laws and regulations of their Parties ; HAVE AGREED as follows :

ARTICLE 1 Aims of Cooperation This Memorandum of Understanding aims to :

a. Increase tourist arrivals to both countries from world tourist generating markets, through the Republic of Indonesia and /or through the Syrian Arab Republic ;

b. Encourage a wider distribution of visitors to the various tourist destinations and attractions in each country ;

c. Encourage visits of both nationals and residents to each country ; d. . Encourage the healthy growth of the tourism industry in both countries.

ARTICLE 2 Executing Agencies

The Parties are committed to keep close relations as regards to the tourism field, through their competent official agencies, which shall be the executive of this Memorandum of Understanding. In this connection , the official agency for the Government of the Republic of Indonesia is the Directorate General of Tourism, Department of Tourism, Post and Telecommunications, and for the Government of the Syrian Arab Republic is the Directorate of Planning and International Relations, Ministry of Tourism .

ARTICLE 3 Areas of Cooperation

Both Parties shall endeavour to promote tourism cooperation in accordance with the laws and regulations of their countries in the following areas :

1. Research and Development

Cooperation in the area of research and development shall be undertaken through exchange of information and research studies in areas that benefit both parties.

2. Education and Training

Cooperation in the area of education and training shall be undertaken through exchange of information, comparative studies on training programmes and skills improvement in both public and the private sectors.

3. Promotion

(i) In the areas of promotion, both Parties shall cooperate in disseminating tourist promotion materials of each country to the other country.

(ii) The Parties shall promote the tourist flows between the two countries and shall endeavour to seek the supply of essential services for that purpose.

4. Meeting, Incentives, Conventions and Exhibitions

Cooperation in the areas of meeting, incentives, conventions and exhibitions shall be undertaken through exchange of programmes between both countries.

5. Private sector Cooperation

The cooperation in the areas of tourism between the respective private sectors of both countries shall be further encouraged strengthened.

ARTICLE 4 Implementation

1. Both Parties agree to establish a Working Group to facilitate the implementation of this Memorandum of Understanding ;

2. The Working Group shall set down the procedures, plans and recommend programmes of cooperation toward achieving its aims through the competent official agencies as mentioned in the article 2 ;

3. The Working Group shall review the implementation of this Memorandum of Understanding regularly and submit the report to the Executing Agencies.

ARTICLE 5 Settlement of Disputes

Any disputes between the Parties concerning the interpretation and /or implementation of this Memorandum of Understanding shall be settled amicably through consultations and negotiations.

ARTICLE 6 Amendment

Either party may request in writing an amendment or modification of any part of this Memorandum of Understanding. Any amendment or modification agreed to by both Parties in conformity with the laws and regulations of the Parties shall constitute part of this Memorandum of Understanding. Such amendment or modification shall enter into force on such a date as will be determined by both Parties.

ARTICLE 7 Entry into Force

This Memorandum of Understanding shall enter into force on the date of its signing.

ARTICLE 8 Duration

a. This Memorandum of Understanding shall be in force for a period of 5 (five) years and shall automatically be extended for subsequent period of 5 (five) years each, unless either Party terminates it by giving written notification at least 6 (six) months prior to its expiration .

b. The termination of this Memorandum of Understanding shall not effect the validity and duration of any arrangement, plans and programmes made under this Memorandum of Understanding until the completion of such arrangement, plans and programmes.
