On September 10, 2009, the Government of Senegal issued Decree 2009-872, which supports Food Safety Law 68-48. This decree requires that imported and domestically produced refined vegetable oils be enriched with vitamin A; more specifically, the decree applies to palm, cotton, palm kernel, peanuts,
sesame, sunflower, canola, corn, and soybean oil. It also requires that soft wheat flour be enriched with iron and folic acid. The decree notes that all fortified products should follow Standards NS-03-72 to NS 03-81, and adds that although fortification was previously not required, it is currently obligatory in order to address nutrition deficiencies among the citizenry.

DECREE no. 2009-872 of September 10, 2009 requiring the application of standards on refined edible oils enriched with vitamin A, and soft wheat flour enriched with iron and folic acid.
PRESENTATION
Vitamin or mineral deficiencies or “hidden hunger” is a real public health problem throughout the world, but particularly in Sub-Saharan Africa and the rest of the suffering third-world population.
In Senegal, the proportion of children under the age of six years who are affected with subclinical vitamin A deficiencies is 61%, and anemia, which is a primary result of nutritional deficiencies in iron, affects 82.6% of children between the ages of 6 and 59 months and 59.1% of women between the ages of 15 and 49 years (Demographic and Health Survey of Senegal, 2005).
The sanitary and socio-economic consequences of these nutritional deficiencies are significant: increased mortality and morbidity, altered physical and mental development, diminished capacity for work and learning.
From the perspective of important players, the Government of Senegal started the fortification process that led to the adoption of Senegalese standards on food oils fortified with vitamin A and soft wheat flour enriched with iron and folic acid.
As a result, it is now necessary to require that such products be enriched, as well apply standards and rules in order to effectively fight against the deficiency in micro nutrients.

Considering act no. 66-48 of May 27, 1966 regarding the control of food products and the fight against fraud;
Considering act no. 94-63 of August 22, 1994 on prices, competition and economic disputes;
Considering decree no. 68-507 of May 7, 1968 regulating the control of products destined for human or animal consumption;
Considering decree no. 68-508 of May 7, 1968 establishing the conditions of investigation and determination of infractions to the act of May 27, 1966 regarding the control of food products and the fight against fraud;
Considering decree no. 2002-746 of July 19, 2002 regarding the standardization of the certification and standards compliance system;
Considering decree no. 2009-451 of April 30, 2009 providing for the nomination of the Prime Minister; Considering decree no. 2009-991 of April 30, 2009 regarding the attributions of the Minister of Commerce; Considering decree no. 2009-459 providing for services of the State and control of public institutions, national societies and democratic societies, to be carried out by the President of the Republic, the Prime Minister cabinet and the Ministers; modified by decree no. 2009-628 of July 13, 2009;
Considering decree no. 2009-548 of June 9, 2009 terminating the functions of a Minister, naming a new Minister and establishing the composition of government;
On the report of the Minister of Commerce;
IT IS HEREBY DECREED:
First Article – The enrichment of food oils with Vitamin A and soft wheat flour with iron and folic acid, as intended by this decree, is made obligatory throughout the national territory.
Art. 2. - The application of the above Senegalese standards is made obligatory, as well as any later revisions. - Standard NS 03-072 on refined edible palm oil, enriched with Vitamin A. Specifications;
- Standard NS 03-073 on refined edible cotton oil, enriched with vitamin A. Specifications; - Standard NS 03-074 on refined edible palm kernel oil, enriched with vitamin A. Specifications; - Standard NS 03-075 on refined edible peanut oil, enriched with vitamin A. Specifications;
- Standard NS 03-080 on refined edible soybean oil, enriched with vitamin A. Specifications; - Standard NS 03-081 on the general principles regulating the addition of nutritional elements and
foods;
- Standard NS 03-075 on soft wheat flour enriched with iron and folic acid. Specifications.
Art. 3. - Any infraction to the provisions of this decree are punishable by sanctions provided under act no. 87-47 of December 28, 1987 regarding the Customs and Duty Code and by act no. 66-48 of May 27 1966 regarding the control of food products and the fight against fraud.
Art. 4. - The Minister of the State, the Minister of the Economy and Finance, the Minister of State, the Minister of Mines and Industry, of Food Transformation, of Agricultural Products and Small and Medium-Sized Businesses, the Ministry of Health, of Public Prevention and Hygiene and the Minister of Commerce are each responsible for their part in the execution of the present decree, which will be published in the Official Journal.

RAPPORT DE PRESENTATION
Les carences en vitamines et minéraux ou « faim inapparente constituent un véritable problème de santé publique dans le monde et particulièrement en Afrique subsaharienne où le tiers de la population
continue d'en souffrir.
Au Sénégal, la proportion d'enfants de moins de six ans affectés par une carence en vitamines A sub-clinique est de 61 % tandis que l'anémie, qui est le plus souvent la conséquence d'une déficience alimentaire en fer, fait souffrir 82,6 % des enfants de 6 à 59 mois et 59,1 % des femmes de 15 à 49 ans (Enquête Démographie et Santé 2005 au Sénégal).
Les conséquences sanitaires et socio-économiques de ces déficiences nutritionnelles sont considérables : mortalité et morbidité accrues, développement physique et mental altéré, capacités de travail
d'apprentissage diminuées.
L'enrichissement des aliments est incontestablement reconnu parmi les interventions les plus efficientes dans le monde. En Afrique de l'Ouest, la fortification des huiles en vitamines A est déjà effective au Ghana, au Nigéria et en Côte d'Ivoire.
Au regard de ces importants enjeux, le Gouvernement du Sénégal a enclenché le processus de
fortification qui a abouti à l'adoption normes sénégalaises sur les huiles comestibles fortifiées en vitamine A et la farine de blé tendre enrichie en fer et acide folique.
Dès lors, il est apparu nécessaire de rendre obligatoire l'enrichissement desdits produits ainsi que l'application des normes relatives afin de lutter efficacement contre la carence micronutriments.
Telle est, Monsieur le Président de la République, l'économie du présent projet de décret soumis à votre signature.

DÉCRÈTE :
Article premier. L'enrichissement des huiles comestibles en vitamine A et de la farine de blé tendre en fer et acide folique visées par le présent décret est rendu obligatoire sur le territoire national.
Art. 2. L'application des normes sénégalaises ci-dessous indiquées est rendue obligatoire, ainsi que leurs révisions ultérieures.

Art. 3. — Toute infraction aux dispositions du présent décret est passible de sanctions prévues par la loi no 87-47 du 28 décembre 1987 • portant Code des Douanes et par la loi no 66-48 du 2ì ma; 1966 relative au contrôle des produits alimentaires et à la répression des fraudes.
Art. 4. — Le Ministre d'Etat, Ministre de l'Economie et des Finances, le Ministre d'Etat, Ministre des Mines, de l'Industrie, de la Transformation alimentaire des Produits agricoles et des P.M.E., le Ministre de la Santé, de la Prévention et de l'Hygiène publique et le Ministre du Commerce sont chargés, chacun en ce qui le concerne, de l'application du présent décret qui sera publié au Journal officiel.
