DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 58/MPP/Kep/I/2002 DATED JANUARY 31, 2002
ON
THE ASSIGNMENT OF THE INDONESIAN RUBBER PRODUCERS ASSOCIATION (GAPKINDO) AS THE
NATIONAL TRIPARTITE RUBBER CORPORATION (NTRC)
THE MINISTER OF INDUSTRY AND TRADE, Considering :
a. that since natural rubber is a national natural resource mostly exploited by rural farmers, its exploitation needs to be regulated properly and managed maximally for the welfare of rubber farmers;
b. that in order to achieve the objective as meant in letter a and to execute the agreement on the Joint Declaration of State Ministers of the World Natural Rubber Producing Countries between the Minister of Industry and Trade of Indonesia, the Minister of Basic Industry of Malaysia and the Minister of Agriculture and Cooperatives of Thailand in Denpasar, Bali on December 12, 2001, it is necessary to establish a National Tripartite Rubber Corporation (NTRC);
c. that for the purpose, it is necessary to issue a decree of the Minister of Industry and Trade.
In view of :
1. Government Regulation No. 1/1982 on the Realization of Exports, Imports and Flow of Foreign Exchange (Statute Book of 1982 No. 1, Supplement to Statute Book No. 3210) as already amended by Government Regulation No. 24/1985 (Statute Book of 1985 No. 33, Supplement to Statute Book No. 3291);
2. Government Regulation No. 25/2000 on the Authority of the Government and the Authority of Province as Autonomous Regions;
3. Presidential Decree No. 260/1967 on the Affirmation of Tasks and Responsibilities of the Minister of Trade in the Field of International Trade;
4. Presidential Decree No. 102/2001 on the Establishment of the Cabinet of Gotong Royong (Mutual Cooperation);
5. Presidential Decree No. 102/2001 on the Status, Tasks, Functions Authority, Organizational Structure and Working Arrangements of Ministries;
6. Presidential Decree No. 109/2001 on First Echelon Organization Units and Tasks of Ministries;
8. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 on the Organization and Working System of the Ministry of Industry and Trade.
Observing :
The Joint Declaration of State Ministers of the World's Main Natural Rubber Producing Countries between Minister of Industry and Trade of Indonesia, the Minister of Basic Industry of Malaysia and the Minister of Agriculture and Cooperatives of Thailand in Denpasar, Bali on December 12, 2001.
DECIDES : To stipulate :
THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON THE ASSIGNMENT OF THE INDONESIAN RUBBER PRODUCERS ASSOCIATION AS THE NATIONAL TRIPARTITE RUBBER CORPORATION (NTRC).
Article 1
To assign the Indonesian Natural Rubber Producers Association (GAPKINDO) as the National Tripartite Rubber Corporation (NTRC) as meant in the Joint Ministerial Declaration of State Ministers of the World's Main Natural Rubber Producing Countries between Minister of Industry and Trade of Indonesia, the Minister of Basic Industry of Malaysia and the Minister of Agriculture and Cooperatives of Thailand.
Article 2
(1) NTRC as meant in Article 1 is the executor of policies of International Tripartite Rubber Council (ITRC).
(2) NTRC functions to coordinate and monitor punctually and effectively. Article 3
(1) Members of NTRC as meant in Article 1 consist of producers/exporters of Indonesian natural rubber registered as members of GAPKINDO.
(2) NTRC has the task of executing the agreed export tonnage scheme and supply management scheme in accordance with the Joint Ministerial Declaration of State Ministers of the World's Main Natural Rubber Producing Countries between Minister of Industry and Trade of Indonesia, the Minister of Basic Industry of Malaysia and the Minister of Agriculture and Cooperatives of Thailand.
Article 4
The execution of the function and tasks of NTRC shall be reported to the Tripartite Natural Rubber Cooperation Committee.
Article 5
The appointment of GAPKINDO as NTRC as meant in Article 1 is effective for 2 (two) years as from the date of stipulation of this decree and will be evaluated every 3 (three) months.
This decree starts to be effective on the date of stipulation.
For public cognizance, this decree shall be announced by placing it in the Statute Book of the Republic of Indonesia.
