TENTANG KERJA SAMA DI BIDANG PENDIDIKAN
Kementerian Pendidikan dan Kebudayaan Republik Indonesia dan Biro Pendidikan Pemerintah Hong Kong Wilayah Administratif Khusus Republik Rakyat Tiongkok ("Hong Kong Wilayah Administratif Khusus") (selanjutnya masing-masing disebut sebagai "Peserta" dan secara bersama disebut sebagai "Para Peserta");
Memperkuat kerja sama di bidang pendidikan dan untuk mendorong pertukaran di bidang pendidikan di antara Para Peserta;
Memperhatikan pertemuan antara Presiden Republik Indonesia dan Kepala Eksekutif Hong Kong Wilayah Administratif Khusus di Jakarta pada ta nggal 17 September 2015;
Sesuai dengan hukum dan peraturan perundang-undangan yang berlaku di Republik Indonesia dan di Hong Kong Wilayah Administratif Khusus serta prosedur dan kebijakan pendidikan masing-masing ;
PASAL1
Tujuan dari Memorandum Saling Pengertian (selanjutnya disebut sebagai "MSP") ini adalah untuk mengakui dan mendukung kerja sama di antara
komunitas pendidikan di Republik Indonesia dan di Hong Kong Wilayah Administratif Khusus yang didasarkan pada timbal balik dan saling menguntungkan.
PASAL2
Para Peserta akan berupaya untuk mendorong dan meningkatkan kerja sama di bidang pendidikan dan penelitian yang dilaksanakan oleh institusi-institusi pendidikan sebagai berikut:
(a) menyediakan beasiswa bagi pelajar Para Peserta;
(b) memfasilitasi pertukaran ilmu, keahlian dan pengalaman di bidang pendidikan yang terbuka melalui pertemuan, konferensi dan pelatihan ;
(c) melakukan pertukaran kepustakaan pendidikan, alat bantu pengajaran, bahan-bahan peragaan dan informasi terkait lainnya;
(d) mendorong pertukaran sarjana, guru, tenaga ahli, pelajar dan tenaga kependidikan di antara institusi pendidikan yang saling menguntungkan bagi Para Peserta;
(e) kegiatan lainnya yang diputuskan bersama oleh Para Peserta.
PASAL 3
2. Biaya dari kegiatan-kegiatan kerja sama di bawah MSP ini tergantung pada ketersediaan dana dan sumber daya dari kedua Peserta dan akan dibebankan sesuai dengan ketentuan-ketentuan yang diputuskan bersama oleh Para Peserta. Setiap Peserta akan berupaya untuk menyediakan sumber daya yang cukup untuk pelaksanaan komitmen masing-masing terkait dengan kegiatan-kegiatan tersebut.
PASAL4
Setiap Peserta akan menghormati otonomi institusi-institusi pendidikan Peserta lainnya bilamana institusi-institusi tersebut melaksanakan setiap kegiatan bersama dan dalam penerimaan pelajar sesuai dengan peraturan mereka yang terkait.
PASAL5
1. Setiap Peserta akan memperlakukan semua dokumen, informasi atau data lain apapun yang dipertukarkan, diterima atau diberikan oleh Peserta lainnya berdasarkan MSP ini secara rahasia dan tidak akan mengungkapkan informasi, dokumen atau data tanpa izin tertulis yang spesifik dari Peserta yang menyediakannya.
2. Para Peserta akan memberikan setidaknya tingkat perlindungan dan kerahasiaan yang sama untuk semua dokumen, informasi atau data lain apapun yang diterima berdasarkan MSP ini sesuai dengan peraturan perundang-undangan dan sistem hukum setempat yang berlaku di negara Peserta yang menyediakannya.
PASAL 6
Para Peserta akan melakukan pertemuan-pertemuan tahunan atau korespondensi untuk membahas lebih lanjut dan meningkatkan kerja sama
pendidikan di antara mereka.
PASAL 7
Setiap Peserta karena alasan keamanan, ketertiban umum atau kesehatan publik, dapat menangguhkan sementara, baik keseluruhan atau sebagian pelaksanaan MSP ini. Penangguhan tersebut akan berlaku segera setelah pemberitahuan diberikan kepada Peserta lainnya melalui saluran-saluran resmi.
PASAL 8
MSP ini dapat diubah setiap saat dengan adanya kesepakatan tertulis oleh Para Peserta.
PASAL 9
Setiap perselisihan yang timbul dari penafsiran dan pelaksanaan MSP ini akan diselesaikan secara damai melalui konsultasi atau negosiasi di antara Para Peserta.
PASAL 10
1. MSP ini akan mulai berlaku pada saat tanggal penandatanganan.
Peserta memberitahukan secara tertulis keinginannya untuk mengakhiri MSP ini 60 (enam puluh hari) sebelumnya melalui saluran-saluran resmi.
3. Berakhirnya MSP ini tidak akan mempengaruhi pengaturan, program,
kegiatan atau proyek apapun yang sedang berlangsung saat berakhirnya MSP ini sampai terselesaikannya pengaturan, program, kegiatan atau proyek tersebut kecuali Para Peserta memutuskan lain.
DITANDATANGANI dalam rangkap dua di Jakarta pada tanggal 16 Desember 2015 dalam Bahasa Indonesia, Bahasa lnggris dan Bahasa Tiongkok, semua naskah memiliki kekuatan hukum yang sama. Apabila terdapat perbedaan penafsiran, maka naskah dalam Bahasa lnggris yang berlaku.

MEMORANDUM OF UNDERSTANDING
BETWEEN
THE MINISTRY OF EDUCATION AND CULTURE OF
THE REPUBLIC OF INDONESIA
AND
THE EDUCATION BUREAU OF THE GOVERNMENT OF
THE HONG KONG SPECIAL ADMINISTRATIVE REGION OF
THE PEOPLE'S REPUBLIC OF CHINA
ON COOPERATION IN THE FIELD OF EDUCATION
The Ministry of Education and Culture of the Republic of Indonesia and the
Education Bureau of the Government of the Hong Kong Special Administrative Region of the People's Republic of China (the "Hong Kong Special Administrative Region") (hereinafter referred to singularly as the "Participant"
and together as the "Participants");
Strengtheni ng the collaboration in education and to promote educational
exchanges between the Participants;
Taking into account the meeting between the President of the Republic of Indonesia and the Chief Executive of the Hong Kong Special Administrative Region in Jakarta on 17th of September 2015;
Pursuant to the applicable laws and regulations of the Republic of Indonesia and the Hong Kong Special Administrative Region as well as their respective procedures and policies on education;
ARTICLE 1
The objective of this Memorandum of Understanding (hereinafter referred to as "MoU") is to recognize and support collaborations between the educational
communities of the Republic of Indonesia and the Hong Kong Special Administrative Region on the basis of reciprocity and mutual benefit.
ARTICLE 2
The Participants will endeavour to encourage and promote cooperation in the fields of education and research conducted by their educational institutions as
follows :
(a) to provide scholarships to students of the Participants;
(b) to facilitate the exchange of publicly-available knowledge, expertise and experience in the field of education through meetings, conferences, and
workshops;
(c) to exchange educational literature, teaching aids, demonstration materials, and other relevant information;
(d) to promote exchanges of scholars. teachers. experts. students. and education personnel between their educational institutions that will be of mutual benefit to both Participants; and
(e) Any other activities to be mutually determined by the Participants.
ARTICLE 3
2. The cost of the cooperative activities under this MoU will be subject to the availability of funds and resources of both Participants, and will be borne on terms to be mutually determined by the Participants. Each Participant will endeavour to provide adequate resources for the implementation of its own
commitments in relation to such activities.
ARTICLE 4
Each Participant will respect the autonomy of the education institutions in respect of the other Participant when such institutions are carrying out any collaborative activities and in their admission of students in accordance with their relevant regulations.
ARTICLE 5
1. Each Participant will treat all documents, information or any other data exchanged, received or supplied by the other Participant pursuant to this MoU as confidential and will not disclose the information, documents or data without the specific written permission of the Participant providing them.
2. The Participants will grant at least the same level of protection and confidentiality to all documents, information or any other data received pursuant to this MoU as that provided under the domestic law and legal system of the Participant providing them.
ARTICLE 6
The Participants will convene annual meetings or exchange correspondences to further discuss and enhance education collaborations between them.
ARTICLE 7
Each Participant may for reasons of security, public order or public health, suspend temporarily, either in whole or in part, the implementation of this MoU . Such suspension will be effective immediately after notification has been given to the other Participant through official channels.
ARTICLE 8
This MoU may be amended at any time by mutual written consent of the
Participants.
ARTICLE 9
Any dispute arising from the interpretation and implementation of this MoU will
be resolved amicably through consultations or negotiations between the Participants.
ARTICLE 10
1. This MoU will be effective on the date of its signing.
2. This MoU will remain effective for a period of 5 (five) years and will be
in writing of its intention to terminate this MoU sixty (60) days in advance through official channels.
3. The termination of this MoU will not affect any arrangements, programs,
activities or projects that are ongoing at the date of termination of this MoU until the completion of such arrangements, programs, activities or projects, unless the Participants mutually determine otherwise.
SIGNED in duplicate at Jakarta, on this 161h day of December in the year 2015, in the Indonesian, English and Chinese languages, all texts being equally valid . In case of any divergence of interpretation , the English text will prevail.
