Kejahatan dalam dunia maya salah satunya ialah pencemaran nama baik yang dilakukan melalui SMS sebagaimana yang dilakukan oleh Prabowo terhadap Nur Dewi Alfiyanah, KUHP tidak mengatur mengenai adanya kejahatan yang dilakukan melalui SMS akan tetapi dengan adanya UU No.11/2008 Tentang Informasi dan Transaksi Elektronik telah memuat mengenai adanya tindak pidana pencemaran nama baik melalui media elektronik. Akan tetapi muncul pertanyaan mengenai sejauh manakah pengakuan serta keabsahan atas alat bukti elektronik dalam peradilan di Indonesia serta bagaimana penerapan dari peraturan perundangan yang ada.
Metode penelitian yang digunakan dalam menganalisa dan meneliti studi kasus ini adalah melalui data yuridis normatif dengan data utama berupa data sekunder yang diperoleh dengan studi kepustakaan.

Defamation is one of many cases that classified as
cybercrime as Prabowo did to Nur Dewi Alfiyanah, where Prabowo sent Nur Dewi Alfiyanah SMS for several times with intention to mock Nur Dewi Alfiyanah, the Indonesian criminal law act (KUHP) is not containt the part that regulate defamation through electronic media, but the government through The Information and Electronic Transaction Act No.11/2008 has provide a regulation about cybercrime especialy a defamation through electronic media. Furthermore a question apeal about the recognition of electronic evidence and it’s legality and about how the regulation can work actually in the court system of Indonesia.
The metode that being used in analyze and researching this case studys is through juridical normatif as the main data and references study as the secondary data.
The result of the research of this case study indicates, first that the recognition of the electronic evidence has already recognized as it’s should be in the Indonesian Trial system as The Information and
Electronic Transaction Act has regulate, second the application of article 27 part (3) which is a Lex Speciallis of Book II chapter XVI of the
