ABSTRAK
Merek merupakan salah satu unsur terpenting dalam dunia perdagangan baik nasional maupun internasional, keberadaannya menjadi pembeda bagi produk berupa barang dan/atau jasa yang di produksi oleh pelaku usaha. Adanya kesamaan pada merek suatu produk tidak hanya dapat menimbulkan kerugian bagi pemilik merek, tetapi juga dapat menimbulkan kekeliruan pada masyarakat. Seperti yang terjadi pada merek milik PT Len Industri (Persero) yaitu merek “LEN” dan merek “LENZ” milik Mahdi. Masalah yang akan diteliti yaitu mengenai persamaan pada pokoknya dan tindakan hukum yang dapat dilakukan oleh PT Len Industri (Persero) terhadap merek “LENZ” dikaitkan dengan ketentuan – ketentuan dalam Undang-Undang Nomor 15 tahun 2001 Tentang Merek.
Penelitian dalam Memorandum hukum ini menggunakan metode pendekatan yuridis normatif dengan spesifikasi bersifat deskriptif analitis yang mempelajari dan meneliti pelanggaran merek dihubungkan dengan Undang- Undang No. 15 Tahun 2001 Tentang Merek. Dengan menggunakan metode ini, kasus yang terjadi diuraikan kemudian dianalisis berdasarkan ketentuan peraturan perundang-undangan di bidang merek.

ABSTRACT
Brand is one of the most important elements in both national and international trade, it existence is a differentiator for the product in the form of goods and / or services produced by businesses. The similarity on the brand of a product not only caused harm to brand owners, but it can also
cause confusion in the public. As happened to brand that owned by PT
Len Industri (Persero) the brand of "LEN" and brand "LENZ" that belong to Mahdi. The issue that has been analyzed are about the substantial
similarity and lega actions that can be perform by PT Len Industri
(Persero) to brand “LENZ” in association with the regulation on Indonesian Law on Trademark No. 15 of 2001.
This legal memorandum is using judicial normative research method with the specification of analytical descriptive which learn and analyzed the breach of trademark associated with Indonesian Law on Trademark No 15 of 2001. With this method, the existing case were being united and then analyzed based on the regulation on te law of trademark.
According to the research, it obtain a conclusion that brand “LENZ”
which belong to Mahdi has a substantial similarity as mentioned in
Indonesian Law on Trademark No 15 of 2001 Article 6 (1) a, because of the similarity of the conspicuous element from the combination of letters and the sound of pronunciation which found on that trademark compared to “LEN” trademark that belong to PT Len Industri (Persero) which has been registered first. Thus, PT Len Industri (Persero) can perform legal action such filed a trademark lawsuit, claim for damages and termination of activities related to the brand, or resolve through arbitration.
