MENURUT UNDANG-UNDANG DASAR 1945 AMANDEMEN

ABSTRAK
Penelitian ini dilatar belakangi oleh pencalonan hakim Mahkamah Konstitusi dari Presiden yang disinyalir tidak transparansi dan partisipatif. Berangkat dari latar belakang tersebut, penelitian ini bermaksud untuk mengetahui mekanisme pencalonan hakim Mahkamah Konstitusi dari Presiden, DPR, Mahkamah Agung serta untuk mengetahui makna penetapan hakim konstitusi oleh Presiden menurut UUD 1945 AmandemenKe III.
Penelitian ini menggunakan pendekatan yuridis normatif dengan spesifikasi dengan penelitian deskriptif analitis. Penelitian ini juga membandingkan mekanisme pencalonan hakim Mahkamah Konstitusi dari Presiden, DPR, dan Mahkamah Agung. Teknikpengumpulan data yang digunakan berupa studi kepustakaan (library research) untuk mendapatkan data-data sekunder berupa bahan hukum primer maupun bahan hukum sekunder yang dianalisa secara kualitatif untuk menjawab identifikasi masalah yang diajukan.
Penelitian ini menyimpulkan bahwa pengaruh atau pertimbangan politis dalam pengangkatan hakim tergantung pada peranan lembaga-lembaga yang mengangkat tersebut. Adanya peranan lembaga-lembaga-lembaga-lembaga tertentu dalam melakukan seleksi calon hakim Mahkamah Konstitusi dianggap sangat penting untuk membatasi pertimbangan politis yang dianggap subjektif dalam pemilihan hakim Mahkamah Konstitusi tersebut. Sedangkan makna dari Presiden menurut UUD 1945 Amandemen Ke III merupakan kewenangan Presiden selaku kepala pemerintahan yang tidak boleh di campuri oleh kekuasaan lembaga tinggi negara lainnya.

ABSTRACT
This research is motivated by the nomination of the President of the Constitutional Court judges are allegedly no transparency and participatory. Departing from this background this study intends to determine the mechanism of Constitutional Court judges nomination of the President, Parliament, and Supreme of Court and to know determination of the meaning of the constitutional judges by the President under the third amendment of the 1945 constitution.
This study uses a normative juridical approach to the specification descriptive analytical study. This study also compand the mechanism of Constitutional Court judges nomination of element President, Parliament and the Supreme of Court. Data collection techniques used in the form of literature study to obtain data in the form of secondary data and the primary legal materials of secondary law qualitative analyzed to identifity problems that are taught to answer.
This study concludes that the influence or political considerations in the appointment of judges depends on the rule of institutions that raised it. The rule of institutions certain agencies in carrying out the selection of candidates for Constitutional Court judges considered very important no to limit the political considerations that are considered subjective in the selection of judges of the Constitutional Court. While the determination of Costitutional Court judge by the President according to the 1945 for the third amandement means nothing other that a state agency an title to the President for the authority. While the significance of the President under the 1945 Constitution Amendment III is the authority of the President as head of government should not be interfered by other state institutions of higher power .
