PERTANGGUNGJAWABAN PIDANA TERHADAP PENGUNGSI (REFEGUEES) YANG MELAKUKAN TINDAK PIDANA: STUDI

ABSTRAK
Pengungsi internasional pencari suaka (refeguees) merupakan persoalan yang sedari lama sudah terjadi di berbagai belahan dunia. Hal tersebut terjadi dikarenakan persoalan-persoalan yang berbahaya di negara asal mereka seperti tak berkesudahan sehingga memaksa mereka keluar dari negaranya untuk mencari keamanan terhadap hak asasi manusianya. Daerah Bintan sendiri para pengungsi (reguees) ditempatkan di Hotel Bhadra dan beberapa dari mereka tidak dapat beradaptasi dengan aturan norma yang berlaku di masyarakat. Sejumlah Tindak Pidana seperti asusila dan penganiayaan dilakukan oleh beberapa orang yang berstatus pengungsi dan hal ini sangatlah meresahkan dan mengganggu warga yang tinggal disekitaran Hotel Bhadra. Penelitian ini menggunakan metode penelitian hukum normatif dan empiris dengan lokasi penelitian dilakukan di Kantor Satgas PPLN Bintan, Kepolisian Resor Bintan dan Rudenim Tanjungpinang. Hasil penelitian menunjukkan penanganan pengungsi pelaku tindak pidana oleh Polres Bintan serta sejumlah bentuk pertanggungjawaban pidana terhadap pengungsi yang melakukan tindak pidana. Kesimpulannya adalah terdapat penanganan pengungsi oleh Polres Bintan secara preventif, Sedangkan untuk Preventif dibutuhkan koordinasi dari Satgas PPLN. Selain itu, terdapat pertanggungjawaban dari masing- masing kasus pengungsi yang melakukan tindak pidana di Kabupaten Bintan.

CRIMINAL ACCOUNTABILITY AGAINST REFUGEES WHO COMPLETE CRIMINAL ACTIONS: A STUDY OF BINTAN POLICE

ABSTRACT
International refugees seeking asylum (refeguees) are a long-standing problem in various parts of the world. This happens because the dangerous problems in their country of origin seem endless, forcing them to leave their country to seek security for their human rights. The Bintan area itself, the refugees (reguees) were placed in the Bhadra Hotel and some of them could not adapt to the norms prevailing in society. A number of crimes such as immorality and persecution were committed by several people with refugee status and this was very troubling and disturbing to residents living around the Bhadra Hotel. This research uses normative and empirical legal research methods with research locations conducted at the Bintan PPLN Task Force Office, the Bintan Resort Police and the Tanjungpinang Detention Center. The results of the study show the handling of refugees who commit criminal acts by the Bintan Police and a number of forms of criminal responsibility for refugees who commit criminal acts. The conclusion is that there is preventive handling of refugees by the Bintan Police. Meanwhile, for prevention, coordination from the PPLN Task Force is needed. In addition, there is accountability for each case of refugees who commit criminal acts in Bintan Regency.
