60 THE CONCEPT OF LEGAL CONSCIOUSNESS AND ITS SOCIAL AND PHILOSOPHICAL

ASPECTS

ANNOTATION

Like many concepts, the concept of legal consciousness has been the focus of scientific research.

In particular, the coverage of its socio-philosophical features is important in today's era of globalization. This article discusses this.

INTODUCTION

It is safe to say that human life, dignity and interests are highly regulated in our country. All that is required is for a person to be well aware of his rights and to use them to lead a prosperous life. To do this, first of all, members of society must have a high level of legal awareness.

Given the fact that the reforms being carried out by our government today are based on the individual and his interests, it becomes clear how important a high level of legal consciousness and legal culture is for the people. After all, the rule of law in the country can be achieved only by raising legal awareness and legal culture.

Our government, led by the President of the Republic of Uzbekistan Sh. Mirziyoyev, has adopted a number of decrees and resolutions that contribute to raising the legal awareness and culture of society, and is taking the necessary measures. Including, Presidential Decree “On the Action Strategy for the Further Development of the Republic of Uzbekistan” of February 7, 2017, “Dissemination and Use of Legal Information” adopted on September 7, 2017 The law of

In this process, the main task of our researchers is to study in depth the socio-philosophical features of the mind, especially legal consciousness, and to develop scientific aspects of its development.

It is well known that in philosophy, every reality or concept has a comprehensive view. This rule is no stranger to the concept of legal consciousness either. In particular, the concept of legal consciousness is a complex, broad concept. Legal consciousness is also, in fact, an integral part of social consciousness. At the same time, legal consciousness is, on the one hand, the object of study of philosophy, and, on the other hand, the focus of sociology, psychology, and all the disciplines of law.

Before considering the concept of legal consciousness from the point of view of social philosophy, it is expedient to first study the mind itself scientifically. It is known from history that a lot of research has been done on the existence of man, his inner world, his consciousness. In

61 particular, the concept of "Self-awareness" developed by G. Leibniz, "The main purpose of consciousness" put forward by the English scientist John Locke, as well as E. Durkhey's comments on "Social Consciousness" were made on the mind. served as a unique foundation in scientific research.

Combining research on the mind, we give the following definitions of the mind:

- The mind - the thinker and communicates with the reality around him;

- Consciousness - reflects a single, indivisible spiritual formation;

- Consciousness - reflects reality in human psychology;

- Consciousness is a state of mind associated with human activity.

- Consciousness also regulates human behavior.

Scientists of our country are also successfully conducting research on the socio-philosophical features of consciousness. According to one of the researches, Z.Ismailov, "Legal consciousness is a system of legal perceptions, ideas, perceptions that reflects the attitude of citizens to the current law, legislative processes, human rights, freedoms and duties in relation to legal idealism and other legal processes."

Russian scholars have also struggled with legal consciousness. In the last century, for example, they have published a lot of research. One of them is Y. Dmitriyev, who believes that "legal consciousness is a set of views, opinions and perceptions of people, their various communities and society as a whole on the current legal phenomena and the law itself."

In this regard, it is worth quoting NMKarkunov: “Legal consciousness is associated with the ideals of society, and the more developed the ability to create the ideals of society, including legal ideals, it will be so advanced. The law is being understood as one of the highest values of human life. ”

Legal consciousness has its own structure and system. The problem of legal consciousness is more relevant to the science of legal psychology. From a legal point of view, legal consciousness is a system of views, assessments, ideas of members of society about what the current law should be.

It should be noted that the fact that a person considers himself a full member of his rights and freedoms or, conversely, a person whose rights have been violated, as well as the understanding that his rights have been partially violated, serves to show the true nature of legal consciousness.

This indicates his level of legal awareness. Legal consciousness then influences legal activity, that is, a person's efforts to protect their rights.

At the same time, legal consciousness is embodied as one of the hallmarks of civil society. After all, social, political, economic, cultural factors contribute to the formation and development of legal consciousness. Legal consciousness is the knowledge of law, the assessment of current laws, the set of opinions about the law. In addition, legal consciousness is a tool that affects the legal system of the state. Legal consciousness is rising from generation to generation. This is because as a result of socialization, a person accumulates the values developed by people before him. This serves to objectify the legal consciousness.

Legal consciousness is always in close contact with the legal system. This shows, on the one hand, that the legal consciousness depends on the current legislation, and on the other hand,

62 the legal system forms the legal consciousness. The legal consciousness is always in close contact with the legal system. This shows, on the one hand, that the legal consciousness depends on the current legislation, and on the other hand, the legal system is the foundation that forms the legal consciousness.

Legal consciousness can be divided into the following types:

- Ordinary (everyday) legal consciousness;

- Theoretical legal consciousness.

Legal consciousness can be divided into the following types:

- Ordinary (everyday) legal consciousness;

- Theoretical legal consciousness.

Another aspect of the legal consciousness is that it is a product of personal experience. That is why it is theoretical. Theoretical legal consciousness, in turn, is manifested in three layers.

1. Theoretical legal consciousness of lawyers;

2. Legal theory;

3. Legal ideology.

It is no exaggeration to say that theoretical legal consciousness is a collection of scientific concepts that serve to raise the spiritual level of the legal system.

There are several types and forms of legal consciousness, which can be categorized based on the following aspects:

- According to the structure - ideas, feelings;

- By level - scientific, daily, professional;

- According to the subjects - individual, collective, public.

The following elements transform legal consciousness into a system:

1. Law;

2. The rule of law;

3. Law enforcement agencies;

4. Officials;

5. Legal relations;

6. Legal literacy.

In short, legal consciousness is people's attitude to the law. Legal consciousness, like ethical norms, contributes to the evaluation of values in society. Legal consciousness as a multifaceted concept is a set of ideas and views that reflect the laws, events, relationships, and the principles of justice in them.
