Terms and conditions:

Note: Bidders must read these conditions carefully and comply strictly while sending/submitting their quotations.

1. Duly filled quotations for each project in separate sealed envelopes should reach to the office of the Director, Information Technology Center, Anand Agricultural University, University Bhavan, Anand 388 110 during office hours on or before 17th May, 2018 in by post or courier only.

2. Validity of the quotation should be on or before March 31, 2019.

3. Tender Fee Rs. 500/- to be paid through DD/Cheque in favor of “AAU Fund Account”

4. EMD 5 % of total amount is to be paid through DD/Cheque in favor of “AAU Fund Account” submitted with the tender documents.

5. Eligibility: Company must have at least 2 years of experience for successful Online Admission with choice based merit generation at state level after Std 10 and Std 12.

6. System Development: The developed systems shall be completely web-based system, with adequate level of security. The said web based Application must be capable to work with our existing database structures and/or other modules.

7. Acceptance Testing: The system once installed will be subjected to an acceptance testing procedure to test the particular form. The details of the procedure will be worked out jointly by Anand Agricultural University and Company. The Anand Agricultural University will accept the said web-based application only after successful completion of acceptance testing.

8. Warranty: All through the one year period of post implementation (after successful installation of the software) warranty the company should rectify the bug/modification/error in the application.

9. Production or Reports: The system should be capable to produce standard downloadable reports in PDF/Excel/HTML and other useful format based on search criteria.

10. Completion Period: The system should be fully developed / updated, implemented and tested within 18 days after receiving the work order.

11. Liquidated Damages: On failing to complete in full, all modules / website within the stipulated in accordance with this work order, you shall pay to Anand Agricultural University, Anand liquidated damages for every day at the rate of 25% of the total contract value up to the completion of your project.

12. Updating/Upgrading: The Company shall guarantee provision of all website updates/upgrades, depending upon the option to be exercised by Anand Agricultural University during the period of warranty free of cost.

13. Rates quoted should be inclusive of all applicable Taxes and F.O.R. our office at Director, Information Technology Center, Anand Agricultural University, University Bhavan, Anand 388 110 inclusive of installation, commissioning and demonstration, if any.

14. Payment Conditions:

(i) No Advance payment shall be made.

(ii) The payment will be made after satisfactory completion of the said Web-based Application.

(iii) The payment will be done by NAU, Navsari; hence the bill for the same in the name of NAU, Navsari.

15. Termination for default:

The AAU may, without prejudice, to any other remedy for breach of contract, by written notice of default terminate the contract in whole or in part:

(i) If you fail to deliver any or all of the obligation within the time period(s) specified in the contract, or any extension thereof granted by the AAU, Anand;

(ii) If you fail to performs any other obligation(s) under the contract

16. Termination for insolvency:

The AAU, Anand may at any time terminate the contract without notice to the company without compensation, if you become bankrupt or otherwise insolvent, provided that such termination will not prejudice or affect any right of action or remedy which has accrued thereafter to the AAU, Anand.

17. Termination for convenience:

The AAU, Anand may at any time by giving notice, terminate the contract, in whole or part at any time for its convenience. The notice of termination shall specify that termination is for AAU's convenience, the extent to which performance of work under the contract is terminated, and the date on which such termination becomes effective.

18. "No claim":

The company shall not be entitled to make any change, whatsoever, against the AAU, Anand under or by virtue of or arising out of this contract nor shall the AAU, Anand entertain or consider any such claim regarding the web-based Application.

19. Suspension:

The AAU, Anand may by a written notice of suspension, suspend all payments to you under the contract, if you fail to perform any of its obligations under this contract, (including the carrying out of the services) provided that such notice of suspension : (i) Shall specify the nature of the failure and

(ii) Shall intimate the company to remedy such failure within a specified period from the date of receipt of such notice of suspension.

20. In case of disputes, decision of Vice Chancellor, Anand Agricultural University, Anand will be final and acceptable to all the parties.

21. Loss of Revenue to the Purchaser:

The bidder shall be vicariously liable to indemnify the Purchaser in case of any misuse of data/information by the website developer, deliberate or otherwise, which comes into the knowledge of the purchaser during the performance or currency of the contract.

You are therefore, requested to send your separate rates for development, Supply, Installation, Testing, Implementation and Maintenance of the said project.
