Valid Mayor's permit issued by the city or municipality where the principal place of business of the prospective bidder is located. (12.1.a.ii);. Declaration of compliance with technical specifications, as summarized and specified in Sections VI and VII of the Bidding Documents; (12.1.b.ii);. Prospective bidders must have experience of completing a single contract within the past two (2) years that is similar to the contract to be bid, and the value of which, adjusted to current prices using the wholesale consumer price index , must be at least fifty percent (50%) of the approved budget for the contract to be bid.
Bulacan State University assumes no responsibility to compensate or compensate bidders for any expenses incurred in the preparation of the bid. Delivery of the Goods is required within seven (7) days of receipt of notice to proceed. It may also be downloaded free of charge from the Government of the Philippines Electronic Procurement System (PhilGEPS) website and the Bulacan State University website, provided Bidders pay the non-refundable fee for the Tender Documents no later than submission of their offers.
All Bids must be accompanied by a bid security in one of the acceptable forms and in the amount specified in ITB clause 18. Bids will be opened in the presence of the representatives of the Bidders who choose to be present at the address below.
INVITATION TO BID
Failure to comply with any of the above responsibilities shall be at the risk of said Bidder. Except as otherwise specified in the BDS, the Bidder may subcontract portions of the Goods to the extent that may be approved by BULACAN STATE UNIVERSITY and declared in the BDS. In the event that any subcontractor is found by BULACAN STATE UNIVERSITY to be unsuitable, subcontracting of such portion of the Goods is not permitted.
Unless otherwise specified in the BDS, the financial component of the bid shall include the following: Unless otherwise specified in the BDS, payment of the contract price shall be in Philippine Pesos. BULACAN STATE UNIVERSITY shall prepare the minutes of the bid opening proceedings which shall contain at least the following: (a) names of bidders, their bid price, bid security, preliminary investigation findings; and (b) attendance register.
If the project is no longer needed as determined by the Head of BULACAN STATE UNIVERSITY; and. iii). If the source of funds for the project has been withheld or reduced through no fault of BULACAN STATE UNIVERSITY. Irrespective of the issuance of the order placement notice, the following conditions for placing the order shall apply:
Within three (3) calendar days from the date of approval of the contract by the appropriate government approving authority, BULACAN STATE UNIVERSITY shall issue its notice to proceed to the bidder.
INSTRUCTIONS TO BIDDERS
This Agreement shall be construed in accordance with the laws of the Republic of the Philippines. Payments shall be made only upon certification by the Head of BULACAN STATE UNIVERSITY certifying that the goods have been handed over or delivered in accordance with the terms of this contract and have been duly inspected and accepted. The performance bond posted in favor of BULACAN STATE UNIVERSITY will be forfeited in the event that the winning bidder is found to be in default of any of its obligations under the contract.
The performance security will remain valid until the Certificate of Final Acceptance is issued by the BULACAN STATE UNIVERSITY. The performance security may be released by the BULACAN STATE UNIVERSITY and returned to the Supplier upon the issuance of the Certificate of Final Acceptance subject to the following conditions:. The BULACAN STATE UNIVERSITY will promptly notify the Supplier in writing of the identity of any representatives retained for these purposes.
If performed at the premises of the Supplier or its subcontractors, all reasonable facilities and assistance, including access to drawings and production data, shall be provided to inspectors free of charge BULACAN STATE UNIVERSITY. The Supplier agrees that neither the performance of a test and/or inspection of the Goods or any part thereof, nor the participation by BULACAN STATE UNIVERSITY or its representative, shall release the Supplier from any warranty or other obligation under this Contract. Delivery of the Goods and/or performance of the Services shall be made by the Supplier in accordance with the time frame set forth by BULACAN STATE UNIVERSITY in Section VI.
Arbitration may be commenced before or after delivery of the Goods under this Contract. The Supplier's liability under this Contract shall be as determined by the laws of the Republic of the Philippines, subject to additional provisions, if any, set forth in the SCC. The BULACAN STATE UNIVERSITY will terminate this contract for non-payment when any of the following conditions attend its implementation:.
The head of BULACAN STATE UNIVERSITY may terminate a contract for the convenience of the government if he has determined that conditions exist that make the project. Before recovery can be made, the loss must be established under oath by the supplier to the satisfaction of BULACAN STATE UNIVERSITY before recovery can take place. Termination shall be based only on the reason(s) stated in the notice of termination. g) The Head of BULACAN STATE UNIVERSITY may establish a Contract Termination Review Committee (CTRC) to assist him in the performance of this function.
All decisions recommended by the CTRC are subject to the approval of the Head of BULACAN STATE UNIVERSITY; And. H). Delivery of the Goods will be made by the Supplier in accordance with the conditions specified in Chapter VI. Four copies of the real estate billing receipt signed by the Bulacan State University representative at the project site.
The Goods remain at the risk and ownership of the Supplier until their final acceptance by Bulacan State University.
