I NSTRUCTIONS TO B IDDERS
Failure to comply with any of the above responsibilities is at the risk of the Bidder concerned. Unless otherwise specified in the BDS, the Bidder may subcontract portions of the Goods to the extent approved by BULACAN STATE UNIVERSITY and stated in the BDS. Unless otherwise stated in the BDS, the financial component of the bid will contain the following:. Unless otherwise specified in the BDS, payment of the contract price shall be in Philippine pesos. If the project is no longer necessary as determined by the head of the BULACAN STATE UNIVERSITY; and. iii).
If the source of funds for the project has been withheld or reduced through no fault of the BULACAN STATE UNIVERSITY. Within three (3) calendar days from the date of approval of the contract by the appropriate government approval authority, the BULACAN STATE UNIVERSITY shall issue its Notice to Proceed to the Bidder.

16.1(b) The bid prices for goods supplied from outside the Philippines are quoted in Philippine pesos. This contract shall be interpreted in accordance with the laws of the Republic of the Philippines. Payments shall be made only upon a certification by the Principal of the BULACAN STATE UNIVERSITY to the effect that the Goods have been delivered or delivered in accordance with the terms of this Contract and have been duly inspected and accepted.
Customer shall withhold ten percent (10%) of the amount of each payment to cover Supplier's warranty obligations under this Agreement as described in Article 17 of the GCC. The Performance Bond shall remain valid until issued by the BULACAN STATE UNIVERSITY Certificate of Final Acceptance. The performance bond may be released and returned to the supplier by BULACAN STATE UNIVERSITY upon issuance of a final acceptance certificate subject to the following conditions:.
BULACAN STATE UNIVERSITY shall notify the Supplier in writing and in a timely manner of the identity of any representatives retained for these purposes. Delivery of the goods and/or performance of services shall be made by the supplier in accordance with the schedule prescribed by BULACAN STATE UNIVERSITY in Section VI. Arbitration may be commenced before or after delivery of the goods under this contract.
Supplier's liability under this Agreement shall be governed by the laws of the Republic of the Philippines, subject to any additional provisions set forth in the SCC. BULACAN STATE UNIVERSITY will terminate this Agreement for default if any of the following conditions are met: Before recovery can be made, Supplier must prove loss under oath satisfactory to BULACAN STATE UNIVERSITY before recovery can be made.
All decisions recommended by the CTRC are subject to the approval of the Head of BULACAN STATE UNIVERSITY; And. H). Risk and title pass from the Supplier to the Contracting Entity upon receipt and final acceptance of the Goods at their final destination.”. S CHEDULE OF R EQUIREMENTS
The delivery schedule, expressed in weeks/months, then sets a delivery date, which is the date of delivery to the project site. The machine must be rigid, hardened rectangular guideways to ensure maximum stability and constant accuracy. Cords and other items necessary to connect and operate the machine to the BSU power source.
The supplier must have distributed/supplied machinery for the last 10 years to 5 or different agencies that have no problem in the requirements.
T ECHNICAL S PECIFICATIONS
Bidders shall declare here either "Compliant" or "Not Compliant" against each of the individual parameters of each specification declaring the relevant Performance parameter of the equipment offered. Evidence should be in the form of conformity issued by the manufacturer, samples, brochures, independent test data, etc., as appropriate. A statement either in the bidder's declaration of compliance or supporting evidence that is found to be false either during Bid Evaluation, post-qualification or contract execution may be considered fraudulent and renders the bidder or supplier liable to criminal prosecution, subject to the provisions. of Clause 3.1 (a.2) of the ITB and/or Clause 2.1 (a.2) of the GCC.

We undertake, if our bid is accepted, to deliver the goods in accordance with the delivery schedule specified in the Schedule of Requirements.
