5 Bank solvency with a nationalized/regular bank within one year from the date of publication of NIT as per prescribed [Proforma-2(b)] [At least 40% of the estimated charges should be mentioned in the. Bidders must submit a hard copy of the documents uploaded above, duly self-certified, together with proof of payment of tender documentation costs and submitted EMD. EMD can be submitted in the form of Bank Transfer/FDR/Call Deposit in favor of Assam University, Silchar only from a Scheduled/Nationalized Bank failing which the offer will not be entertained.
Soft copy of such EMD is uploaded while submitting the tender and hard copy of the EMD must be submitted to Engineering Department, AUS before or on the Day of tender opening. Tenders must be valid for 90 days from the date of opening of the tenders and may be extended further if deemed necessary by the University. No Telefax/ Telefax/ Telegram/ Email of the Techno commercial and price bid will be accepted.
The contractor must also adhere to the provisions of the Child Labor (Prohibition and Regulation) Act, 1986 and other labor laws. The latest challan copy means proof of payment of the salary month within two months from the last date of submission of the bid. All future tenders will be notified of the change, which will be binding on all bidders.
Those bidders who accept the above terms and conditions may submit their bid along with all relevant documents and a duly signed copy of the above terms and conditions of tender.

The tender must be accompanied by the Earnest Money Deposit pledged in favor of Assam University, Silchar, in the form of Demand Draft/FDR/Call Deposit as specified in the Tender Notice. If, after submitting an offer online, the offeror releases his offer or changes the terms and conditions thereof in a manner not acceptable to the University, the money earned will be forfeited. Offers not accompanied by the earnest money deposit will not be considered and will be rejected.
After submission of 5% performance bond, 2% of the EMD submitted by the bidder during the tender is released. A tenderer whose tender is not accepted shall not be entitled to claim any costs, charges and expenses arising out of or in connection with his submission of the tender, although the University may amend/withdraw the tender. The University is not bound to accept the lowest bid and reserves the right to reject any or all bids received for clear and logical reasons.
The Tenders received and accepted will be assessed to determine the best and lowest viable tender in the interests of the University, for the entire work covered by the technical specifications and documents.

The several documents included in the Contract must be understood as mutually explanatory of each other, as detailed drawings are followed rather than small scale, drawing and figure dimensions rather than scale and special conditions rather than general conditions. Any error in the description, quantity or rate in the Bill of Quantities or any omission therefrom shall not invalidate the contract or relieve the contractor from carrying out all or part of the works contained therein in accordance with the drawings and specifications or from any of his obligations under to the contracts. Subject to any deduction to which the Employer may be entitled under the Contract, all payments to the Contactor for the Work will be made on completion of the Work to approved specifications via digital mode by direct credit to the Contractor's bank account d. satisfactory completion report and signature of the computerized measurement book and bill of site (i/c) of the proposed work and Executive Engineer without which payment will not be released.
The computerized measurement sheet should be submitted by the concerned contractor for i/c verification at the site and to the Executive Engineer before finalizing the bill payment. The University will retain 05% of the invoice value, which will be released along with 05% of the performance bond after 01 (one) year from the date of completion of the work. During this period of liability for errors, the contractor must eliminate all errors in the work performed at his own expense, otherwise reimbursement will be made from the deposit and performance guarantee in part or in full, depending on the case. maybe.
Release of 05% Security Deposit and 05% Performance Bond will be after 12 months from final acceptance of work by Assam University, Silchar. The contractor is not allowed to assign or transfer his/her obligation or benefit under the contract, in whole or in part, to other individuals/firms/agencies. However, in extreme circumstances where subcontracting of a portion of the work is unavoidable, the prior written permission of the Client will be obtained from the Contractor.
