The Earnest Money Deposit (EMD) of Rs 40,200/- (Rupees Forty Thousand Two Hundred) mentioned above only is absolutely mandatory and should be enclosed with the tender in the form of FDR / Call Deposit in favor of Assam University, Silchar was drawn. only from a scheduled/nationalized bank, failing which the tender will not be accepted. Tenders must be valid for 90 days from the date of opening of the tenders and may be extended further if deemed necessary by the University. All tenders in which any of the prescribed conditions are not met or any condition set by the tenderer will be summarily rejected. The contractor shall also comply with the provisions of the Child Labor (Prohibition and Regulation) Act, 1986 and other labor laws. The decision of the sole Arbitrator will be final and binding on both parties.
Those bidders who accept the above terms and conditions may submit their bid along with all relevant documents and a duly signed copy of the above terms and conditions of tender. In case of non-acceptance of the offer, but in no case before the end of the period in which the offer is open, the contribution is paid. Once the Client accepts the offer, the Client and the successful tenderer may sign and execute a formal contract between the Client and the successful tenderer at a time specified by the Client, which must in any case be within 15 days of the intended date of commencement of work. The Contractor shall be provided free of charge with one certified copy of the tender documents, excluding standard specifications, price list and similar other printed and published documents, together with all drawings which may form part of the tender documents.
The work to be carried out under the Contract shall, except as otherwise provided in these conditions, include all labour, materials, tools, plant, equipment and transport which may be required for the preparation from time to time and in the full and complete execution and completion of the works. The computerized measurement sheet shall be submitted by the concerned contractor of the work for verification of the site i/c and Executive Engineer before final payment of the bill. A 10% deposit is retained by the university from the invoice value, which is released after one year from the date of completion of the work.
Release of deposit will be after 12 months after final acceptance of the work by Assam University, Silchar. In extreme circumstances, where subcontracting of part of the work is unavoidable, the contractor must, however, have prior written permission from the client.

The Bidder shall be deemed to have full knowledge of the location, whether or not he inspects it, and no additional charges shall be allowed as a result of any misunderstanding or otherwise. The tenderer is responsible for the arrangement and maintenance at his own expense of all materials, tools and devices, water, access to electricity, facilities for workers and all other services necessary for the performance of the work, unless otherwise specifically specified in the tender documentation and he himself has made himself aware with the extent and specifications of the work to be done, and the conditions and rates at which stores, tools and appliances, etc. Earnest Money Deposit (EMD) RS: 53,700/-(Rupees Three Fifty Thousand Seven Hundred) only mentioned above is absolutely mandatory and should be attached along with the tender in the form of FDR / Call Deposit in favor of Assam University, Silchar with a Scheduled / Nationalized Bank only, otherwise the offer will not be accepted.
If a registrant withdraws his registration before the stated deadline or the issuance of a letter of acceptance, whichever is earlier, or makes changes to the conditions of the registration that are not acceptable to the University, the University will, without prejudice to any other right or remedy, shall have the liberty to forfeit the said Earnest Money Deposit. The successful tenderer/contractor, upon acceptance of his tender by the University, shall, within 15 days from the stipulated date of commencement of work, sign the contract agreement in standard form, consisting of the notice of tender, all documents, including additional conditions, specifications and any drawings constituting the quotation as issued at the time of the invitation to tender and its acceptance, together with all correspondence leading thereto. In the event of delay in completing the work within the specified period due to reasons attributable to the contractor, the Standard Damage at 0.1% of the accepted quotation value for each day of delay will be recovered from the final bill or part thereof. up to a maximum of 10%.
The Contractor shall obtain a valid license under the Contract Labor (R&A) Act, 1970, and the Contract Labor Central Rules 1971 at the commencement of work and shall continue to hold a valid license until completion of the work. Failure to comply with this requirement will be subject to the penalty provisions of this contract arising from the resulting non-performance of the work. Tax at higher or prescribed rate or 20% will be deducted on all transactions subject to TDS where the Permanent Account Number (PAN) of the beneficiary is not available.

If any differing or conflicting provisions are contained in any document forming part of the contract, the Executive Engineer, Assam University shall be the final authority as to the intention/interpretation of the document and his decision shall be final and binding on the contractor . .
