I NVITATION TO B ID
A complete set of bid documents may be acquired by interested bidders on 21 February 2019 (Thursday) up to 10:00 a.m. on March 13, 2019 (Wednesday) from the address below and upon payment of the applicable fee for the Bidding Documents in accordance with the latest guidelines issued by the GPPB, in the amount of Five Thousand Philippine Pesos (Php 5,000.00). It may also be downloaded free of charge from the website of the Philippine Government Electronic Procurement System (PhilGEPS) and the website of the procuring entity at https://ksu.edu.ph/good-governance/invitebid, provided that bidders pay the applicable fee for the Bidding Documents by upon submission of their bid. All bids must be accompanied by a bid security in any of the acceptable forms and in the amount specified in ITB Clause 18.
I NSTRUCTIONS TO B IDDERS
If the client determines that the subcontractor is ineligible, subcontracting is not permitted. A statement from the offeror's SLCC, which is similar to the contract to be offered, in accordance with clause 5.4 of the ITB. Any other document related to the financial component of the offer as specified in the BDS. a).
Unless otherwise specified in the BDS, payment of the contract price shall be in Philippine pesos. The notice will be issued within seven (7) calendar days from the date of bid opening.
B ID D ATA S HEET
Contract Location: KSU Main Campus, National Highway, Purok 6, Bulanao Centro, Tabuk City, Kalinga. The name of the project is Construction and/or Renovation of Multipurpose Facilities including Php 500,000 for Sports Facilities - Final Phase. 5.4(b) For this purpose, similar contracts shall refer to contracts having similar major categories of work such as the construction of a single-story building of the same size and equivalent to at least fifty percent (50%) of ABC, amounting to Php 636,209.87.
G ENERAL C ONDITIONS OF C ONTRACT
All materials and plant on site shall be deemed to be the property of the Procuring Entity. The Contractor shall carry out all instructions of the Procuring Entity's Representative that comply with the applicable laws where the Site is located. The performance security will remain valid until the Certificate of Final Acceptance is issued by the Procuring Entity.
The contracting authority terminates this contract for default if any of the following conditions accompany its performance:. All drawings prepared by the contractor for the performance of the temporary works are subject to prior approval by the contracting authority's representative before being used. The approval of the contracting authority's representative does not diminish the responsibility of the contractor for the design of the temporary work.
The contractor obtains the consent of third parties for the planning of temporary works, if requested by the client. Each completed form must be checked and signed by the customer's representative within two days after the work has been completed. Approval of the work program by the client's representative does not change the contractor's obligations.
The client's representative or the contractor may request the other to attend a management conference. Such request for payment must be verified and approved by the client's representative/project engineer. The contractor will submit to the client's representative monthly statements of the estimated value of the work performed, reduced by the cumulative amount previously approved.
S PECIAL C ONDITIONS OF C ONTRACT
The duration of the contract must be calculated from the start date (NTP) and not from the effective date of the contract. If a proposed key engineer is employed by the offeror and is working on another project concurrently with the tender, the offeror must submit a certification. The tenderer may propose a key technician who is not its employee, provided that the said personnel must provide a declaration that he/she will work for the tenderer if awarded the contract under tender.
7.4(c) The performance security covers the period from the time of contract signature to final acceptance of the project by the government, during which the warranty period as prescribed in Sec. For this reason, the coverage of the performance bond includes the liability period for defects of one (1) year and must be released only after the head of the contracting authority has issued the certificate of final acceptance. Note: Tenderer's performance/deposit guarantees submitted by the contractors will be subject to verification/confirmation as to validity and authenticity at the head office of the issuing bank or insurance company.
A letter of confirmation duly attested by the relevant bank or insurance company shall be submitted by the bidder. If there is no available site investigation report prepared by the procuring entity, then the Bidder shall conduct a site visit prior to the preparation of its bid. 13 If the Contractor is a joint venture, "All partners of the joint venture shall be jointly and severally liable to the Procuring Entity".
S PECIFICATIONS
Kalinga State University shall engage the construction services of a qualified construction company to construct the completion of multi-purpose building of the State University. In this regard, the contractor or key personnel to be assigned must have professional experience compatible with the business as set out in clause 12.1(b)(ii.2) of the tender data sheet. The contractor shall prepare the revised major changes/changes in the design after the approval of the tenderer during construction execution, if any.
The Contractor shall prepare weekly and monthly performance reports supported by status images and S-curves to monitor actual progress to be used as the basis for progress billing to be submitted to the KSU Infrastructure Unit. The contractor must fully address and comply with the final punch list to be issued by the KSU Infrastructure unit prior to turnover and acceptance of the completed project. The Contractor shall clean the entire area by removing dirt, debris, paint stains, excess and spillage and shall leave the entire premises free of debris caused by their work to the satisfaction of KSU at no additional cost.
It takes responsibility for this and the contractor is specifically responsible for any liability arising therefrom. Above or equal to (15%) of the contract price less advance payment (Section 10.2), applicable withholding taxes and a withholding fund in the amount of ten percent (10%) of the contract price (Section In case of early termination, the contractor shall notify KSU within thirty (30) calendar days before such termination.

630, the Philippine ownership or interest in the joint venture concerned is at least seventy-five percent (75%): Provided, That joint ventures in which the Filipino ownership or interest is less than seventy-five percent (75%) may be eligible if the structures which are to be constructed, require the use of techniques and/or technologies not adequately possessed by the person/entity fulfilling seventy-five percent (75%) Philippine ownership: Provided, That in the latter case, the Philippine ownership or. interest may not be lower than twenty-five percent (25%). Failure to comply with any of the above obligations is the responsibility of the provider concerned. The Bidder must complete prices and rates for all parts of the Works described in the Bill of Quantities. Bids shall remain valid for the period specified in the BDS, which shall not exceed one hundred twenty (120) calendar days from the date of opening of bids. The bid security described in ITB clause 18 should also be extended corresponding to the extension of the bid's validity period as a minimum.

In the event that one or more of the requirements in the second envelope of a specific bid are missing, incomplete or apparently insufficient, and/or if the submitted total bid price exceeds the ABC unless otherwise stipulated in ITB Clause 13.2, the BAC will bid worriedly rates as "failed". The Procuring Entity must prepare the minutes of the proceedings of the bid opening which shall include at least: (a) names of Bidders, their bid price (per lot, if applicable, and/or including rebate, if any), bid security, findings of preliminary investigation, and whether there is a withdrawal or amendment; and (b) attendance sheet. The summary of bids as read and the minutes of the bid opening will be made available to the public upon written request and payment of a specified fee to recover costs of materials.

When applicable, the BAK will conduct a post-qualification of the Bidder with the next Lowest Calculated Bid. A request for reconsideration may be submitted by the Bidder to the HoPE in accordance with Section 37.1.3 of the IRR of RA 9184. The Completion Date is the date of completion of the Works as certified by the Contracting Entity's representative in accordance with GCC Clause 49. The Contractor shall submit to the Employer for consent the name and details of the person authorized to receive instructions on behalf of the Contractor. The performance security provided in favor of the client shall be forfeited if the contractor is found to be in breach of any of its obligations under the contract.
The performance security may be released by the client and returned to the contractor after the issuance of the certificate of final acceptance under the following conditions: From the start date until the certificate of final acceptance has been issued, the following risks are for the procuring entity:. one). In the event of the contractor's insolvency, the contractor's equipment, which the contracting authority specifies in the notice, must be used until the work is completed.
All decisions recommended by KTRT will be subject to the approval of Hope. In the absence of the CPES evaluation sheet, the existing performance monitoring system of the procuring entity will be applied. The Procuring Entity's representative may ask the contractor to provide an estimate of the expected effect of the future event or circumstance on the contract price and completion date.
The first installment payment may be made by the contracting authority to the contractor, provided that at least twenty percent (20%) of the work has been completed, as certified by the contracting authority's representative. On completion of the entire work, the contractor may replace the money withheld with an "on demand" bank guarantee in a form acceptable to the contracting authority.
