I NSTRUCTIONS TO B IDDERS

G ENERAL C ONDITIONS OF C ONTRACT
All materials and equipment on site are considered the property of the client. The contractor will follow all the instructions of the client's representative, which are in accordance with the applicable legislation where the location is located. The performance bond remains valid until the client issues a certificate of final acceptance.
The ordering party shall terminate this contract for breach when one of the following conditions accompanies its implementation:. In the absence of the CPES rating scheme, the client's existing performance monitoring system is used. All drawings prepared by the contractor for the execution of the temporary works are subject to prior approval by the client's representative before use.
The approval of the contracting authority's representative does not diminish the responsibility of the contractor for the design of the temporary work. The Contractor shall obtain third party approval for the design of the Agency Work, if required by the Contracting Authority. Each completed form is verified and signed by the contracting authority's representative within two days of the work being carried out.
Approval of the Work Program by the Procuring Entity's Representative will not change the Contractor's obligations. Either the Procuring Entity's Representative or the Contractor may require the other to attend a Management Conference. This request for payment will be verified and certified by the Procuring Entity's Project Representative/Engineer.
The contractor must submit to the representative of the Procuring Entity monthly statements of the estimated value of the work performed minus the previously certified cumulative amount.
S PECIAL C ONDITIONS OF C ONTRACT
The contract duration will be counted from the start date (NTP) and not from the contract effectiveness date. If a proposed key technical personnel is an employee of the bidder and is working on another project at the same time of the bidder, the bidder must submit a certification that (1) the personnel will be withdrawn from the ongoing project once the bidder the contract is awarded, and (2) he/she will be replaced with another person with equal or better qualifications, as certified by the Head of the Implementation Office. The bidder may propose a Key Technical Personnel who is not its employee, provided that the said personnel is required to submit a certification that he/she will work for the bidder if the contract is awarded under bid.
7.4(c) The performance security shall cover the period from the time of signing the contract until the final acceptance of the project by the Government, during which the warranty period as prescribed in Sec. For this reason, the coverage of the performance security shall include the defect liability period of one (1) year. It shall be released only after the head of the contracting entity has issued the certificate of final acceptance.
Note: The provider's guarantees for the good performance of the contractual obligations submitted by the contractors will be subject to verification/confirmation of validity and authenticity at the headquarters of the issuing bank or insurance company. The provider must submit a certificate duly authenticated by the relevant bank or insurance company. If there is no report on the inspection of the construction site prepared by the client, the bidder must conduct an inspection of the site before preparing his offer.

S PECIFICATIONS
Kalinga State University will engage the construction services of a qualified construction company to construct the completion of Motorpool- Bulanao Campus of the State University. In this regard, the contractor or the key personnel to be assigned to him must have professional experience compatible with the undertaking as specified in point 12.1(b)(ii.2) of the tender information form. The contractor prepares any revised major modifications/changes to the project after the proponent's approval during construction.
The contractor shall adequately handle and comply with the final delivery list to be issued by the KSU infrastructure unit prior to the handover and acceptance of the completed project. The contractor will clean the entire area by removing debris, trash, paint stains, excess, and spills and will leave the entire property free of debris created by its work, to the satisfaction of KSU, at no additional cost. 630, Filipino ownership or interest of the joint venture concerned shall be at least seventy-five percent (75%): Provided further that joint ventures in which Filipino ownership or interest is less than seventy-five percent (75%) , may be eligible where the structures to be constructed require the application of techniques and/or technologies not sufficiently owned by a person/entity that meets the requirement of seventy-five percent (75%) Filipino ownership: Provided, finally, that in the latter case, Filipino ownership or interest shall not be less than twenty-five percent (25%). Failure to fulfill any of the above responsibilities will be at the risk of the bidder concerned. Unless otherwise specified in the BDS, the bidder may subcontract portions of the Works to the extent approved by the Procuring Entity and stated in the BDS.
In the event that the client determines that any subcontractor is ineligible, subcontracting of such part of the works is not permitted.

The bidder shall enter rates and prices for all items of the Works described in the Bill of Quantities. The bid security described in ITB Clause 18 must also be extended corresponding to the extension of the bid validity period at least. Each copy of the first and second envelopes shall be sealed in the same manner and duly mark the inner envelopes as "COPY NO. Failure to submit any of the post-qualification requirements on time, or a finding against their veracity, will disqualify the bidder for the award. When applicable, BAC will conduct a post-qualification of the bidder with the next lowest calculated bid. A request for reconsideration may be filed by the bidder with Hope pursuant to Section 37.1.3 of the IRR of RA 9184.
