BULACAN STATE UNIVERSITY, through the Corporate Budget (Revenue) intends to apply the amount of two million five hundred and seventy thousand pesos only (P is the approved budget for the contract (ABC) for the payments under the contract for the IMPROVEMENT OF SERVICE ENTRY FROM ONLY. PHASE IN 3- PHASE MENESES CAMPUS (12-12) BULACAN STATE UNIVERSITY now invites bids for IMPROVING SERVICE ENTRANCE FROM MENESES CAMPUS IN PHASE 3 (12-12).
INSTRUCTION TO BIDDERS
Unless otherwise specified in the BDS, the financial component of the bid shall include the following: Unless otherwise specified in the BDS, payment of the contract price shall be in Philippine Pesos. If the project is no longer necessary as determined by the Head of BULACAN STATE UNIVERSITY; And. iii).
BID DATA SHEET
All materials and installations on site are deemed to be the property of BULACAN STATE UNIVERSITY. The contractor shall carry out all instructions given by the representative of BULACAN STATE UNIVERSITY in accordance with applicable laws where the location is located. The performance guarantee shall remain valid until the issuance by BULACAN STATE UNIVERSITY of the Certificate of Final Acceptance.
All decisions recommended by the CTRC shall be subject to the approval of the Head of the BULACAN STATE. All drawings prepared by the Contractor for the execution of the Temporary Works are subject to prior approval by the BULACAN STATE UNIVERSITY's Representative prior to their use. The BULACAN STATE UNIVERSITY representative's approval shall not alter the Contractor's responsibility for the design of the Temporary Works.
The Contractor shall obtain third party approval for the design of the temporary works if required by BULACAN STATE UNIVERSITY. Each completed form must be verified and signed by the BULACAN STATE UNIVERSITY representative within two days after the work is completed. The approval of the work program by the representative of BULACAN STATE UNIVERSITY shall not alter the contractor's obligations.
The Contractor shall submit to the BULACAN STATE UNIVERSITY representative monthly statements of the estimated value of the work performed less the cumulative amount previously certified. A report of such verification shall be submitted directly to the Head of BULACAN STATE UNIVERSITY or his duly authorized representative. However, this does not exclude BULACAN STATE UNIVERSITY's claim for damages.

Unless otherwise specified in the BDS, the Bidder may subcontract portions of the Works to an extent approved by the BULACAN STATE UNIVERSITY and stated in the BDS. In the event that any subcontractor is found by the BULACAN STATE UNIVERSITY to be ineligible, the subcontracting of such portion of the Works shall not be permitted.

The Bidder shall enter rates and prices for all items of the Works described in the Bill of Quantities. The bid security described in ITB Clause 0 must also be extended corresponding to the extension of the bid validity period at least.

No bid may be withdrawn in the interval between the deadline for submission of bids and the expiry of the bid validity period specified by the Bidder on the Financial Bid Form. In the event that one or more of the requirements in the second envelope of a particular bid are missing, incomplete or manifestly insufficient, and/or if the total bid price submitted exceeds ABC, except as otherwise provided in ITB Clause 13.1(b), BAC shall 'one assesses the bid in question as "unsuccessful".

The ranking of the total bid prices thus calculated from lowest to highest. Within a non-extendable period of three (3) calendar days from the Bidder's receipt of the notice from the BAC that it has submitted the LCB, the Bidder shall submit the following document requirements:. The decision shall be based on an examination of the documentary evidence of the bidder's qualifications submitted pursuant to ITB clauses 12 and 13, as well as other information deemed necessary and appropriate by BULACAN STATE UNIVERSITY, using a non-discretionary “pass/fail” ".
An adverse decision will result in the rejection of the Bidder's Bid, in which case BULACAN STATE UNIVERSITY shall proceed to the next lowest calculated Bid to make a similar determination of that Bidder's ability to perform satisfactorily. Within a period not exceeding seven (7) calendar days from the date of receipt of the recommendation from the BAC, the Head of BULACAN STATE UNIVERSITY shall approve or disapprove the said recommendation. Regardless of the eligibility or post-qualification of a tenderer, the concerned BULACAN STATE UNIVERSITY reserves the right to review its qualifications at any stage of the procurement process if it has reasonable grounds to believe that a misrepresentation has been made of said tenderer, or that there has been a change in the bidder's ability to undertake the project from the time it submitted its eligibility requirements.
If the physical and economic conditions have changed significantly so that the project is no longer economically, financially or technically feasible as determined by the Head of BULACAN STATE UNIVERSITY;. ii). If the source of funds for the project has been withheld or reduced through no fault of BULACAN STATE UNIVERSITY.

Within three (3) calendar days from the date of contract approval by the appropriate government approving authority, BULACAN STATE UNIVERSITY will issue its Notice to Proceed to the Bidder. The Completion Date is the date of completion of the works as certified by the BULACAN STATE UNIVERSITY Representative, in accordance with Clause 49 of the GCC. The contract price is the price stated in the Letter of Acceptance and thereafter to be paid by BULACAN STATE UNIVERSITY to the contractor for the performance of works in accordance with this contract.
Work(s) refers to the permanent works and temporary works to be carried out by the contractor in accordance with this contract, including (i) the supply of all labour, materials, equipment and anything else incidental, necessary or convenient for the complete performance of the Works; (ii) passing any tests prior to acceptance by the BULACAN STATE UNIVERSITY representative; (iii) and the performance of all of the contractor's duties and obligations imposed by this contract as described in the SCC. The Contractor shall submit to BULACAN STATE UNIVERSITY for consent the name and particulars of the person authorized to receive instructions on behalf of the Contractor. The performance security may be released by BULACAN STATE UNIVERSITY and returned to the contractor after the issuance of the certificate of final acceptance under the following conditions:.
From the start date until the certificate of final acceptance is issued, the following risks for BULACAN STATE UNIVERSITY:. A). In the event of insolvency of the Contractor, all Contractor Equipment that BULACAN STATE UNIVERSITY orders in the notice shall be used until the completion of the Works; The representative of BULACAN STATE UNIVERSITY may require the contractor to provide an estimate of the expected effect of the future event or circumstance on the.
The first installment payment may be made by BULACAN STATE UNIVERSITY to the Contractor provided that at least twenty percent (20%) of the work has been completed as certified by a representative of BULACAN STATE UNIVERSITY. Upon completion of the entire works, the contractor may replace the withheld money with an “on demand” bank guarantee in a form acceptable to BULACAN STATE UNIVERSITY. The time frame for the processing of amendment decisions from preparation to approval by the head of the concerned BULACAN STATE UNIVERSITY shall not exceed thirty (30) calendar days.
