The Bidding Documents shall clearly and adequately define, among other things: (i) the objectives, scope and expected outputs and/or results of the proposed contract or Framework Agreement, as the case may be; (ii) the eligibility requirements of Bidders; (iii) the expected contract or Framework Agreement duration, the estimated quantity in the case of procurement of goods, delivery schedule and/or time frame; and (iv) the obligations, duties and/or functions of the winning bidder. However, they must be adapted as necessary to the circumstances of the procurement project in question. Specific details, such as the "name of the Procuring Entity" and "address for submission of bids," must be provided in the Instructions to Bidders, Bid Data Sheet and Special Conditions of Contract.

Bid – A signed offer or proposal to undertake a contract submitted by a bidder in response to and in accordance with the requirements of the bid documents. Bidder – Refers to a contractor, manufacturer, supplier, distributor and/or consultant who submits a bid in response to the requirements of the Bidding Documents.

Invitation to Bid

The complete set of tender documents may be obtained by interested bidders on September 30, 2020 at the address and website(s) below and upon payment of the applicable tender documents fee, in accordance with the latest Guidelines issued by the GPPB, in the amount of four thousand pesos for lot 1 and one thousand pesos for lot 2. All bids must be accompanied by a bid bond in any acceptable form and in the amount specified in Article 14 of the ITB. Bids will be opened in the presence of representatives of bidders who decide to participate in the activity.

These clauses serve as a secondary source for the terms and conditions of the contract. Advance payment of the contractual amount is provided in accordance with Annex "D" of the revised IRR 2016 no. RA. The customer must notify the supplier in writing in a timely manner of the identity of all agents hired for these purposes.

In order to ensure that the supplier will correct manufacturing defects, the supplier is required to provide a guarantee as specified in Section 62.1 of the Revised IRR No. RA of 2016. Supplier's liability under this Agreement shall be governed by the laws of the Republic of the Philippines.

Special Conditions of Contract

The Supplier will deliver the goods in accordance with the conditions set out in Section VI (List of Requirements). Supplier must provide all of the following services, including any additional services listed in Section VI. The Supplier shall provide such packaging of the Goods as is necessary to prevent their damage or deterioration during transport to the final destination as specified in this Agreement.

The dimensions and weight of the packaging, if applicable, take into account the remoteness of the final destination of the Goods and the absence of heavy handling facilities at all points during transport. A packing list listing the contents and quantities of the packaging should be placed in an accessible area of ​​the outer packaging if possible. If the Supplier is required under the Contract to deliver the Goods CIF, CIP or DDP, transportation of the Goods to the port of destination or other named place of destination in the Philippines as specified in this Contract shall be arranged and paid for by the Supplier, the cost of which is included in the Contract Price.

Where the supplier is required under this contract to transport the goods to a specified place of destination within the Philippines, defined as the project site, transportation to such place of destination in the Philippines, including insurance and storage, as specified in this contract, will be arranged by the Supplier, and related costs will be included in the contract price. Where the supplier is required under the contract to deliver the goods CIF, CIP or DDP, goods must be transported on carriers of Philippine registry. The Supplier shall indemnify the Procuring Entity against all third party claims of infringement of patent, trademark or industrial design rights arising out of the use of the Goods or any part thereof.

Technical Specifications

Where applicable, drawings, including floor plans as required, may be provided by the contracting authority with the tender documents. Tenderers are also required, as part of the technical specifications, to complete their Declaration of Conformity and demonstrate how the items conform to the specification. A statement not supported by evidence or later found to be contradicted by the evidence presented will render the Bid under evaluation liable for rejection. A statement either in the Bidder's declaration of compliance or the supporting evidence found to be false during Bid Evaluation, post-qualification or the performance of the Contract may be considered fraudulent and render the Bidder or supplier liable to prosecution subject to the applicable laws and issues.].
