Settlement of Disputes by Paneling According to World Trade Organization

ABSTRACT
This study is based on the role that the WTO agreements play in our local economy, whereas, the increase and ramification in the spheres of commercial dealings between the member countries of the organization, was one of the major reasons contributing in the occurrence of the many disputes related to the sectors of WTO. The importance of the subject matter locally, since September 11th 2005, when Saudi Arabia became a member of WTO. This may result in making the country vulnerable or liable to any of the cases shown in the Dispute Settlement Body (DSB) of WTO.
The research consists of four independent chapters with an introductory chapter, we designate for approaching the general aspect of the organization, concerning the historical process, since the establishment of GAT in 1947 to 1995, in the framework of what is known as ( The Rounds of 8).
Chapter one is dealing with the general principles and goals, which WTO is aiming to fulfill. In this chapter also, we apply a comprehensive review of WTO's administrative structure and its agreements.
Chapter Two is dedicated for a legal analytical comparative study between the mechanism of disputes settlement within the framework of GAT agreement for the year 1947, and the new mechanism.
Finally chapter Three is designated to study the executive procedures by means of the new mechanism, where the first field of research is dedicated to the primary means and the second field to the last mean of disputes settlement, known as the arbitration panels or the special panels for settlement. The objectives of the research are various, but the most important of them are concentrated in drawing a process for the procedures and ways of dispute solution in front of the Dispute Settlement Body(DSB) in the World Trade Organization; beside the advantages privileged to the developing countries, under the WTO.
In the conclusion of the dissertation I stated a number of significant in my view, recommendations such as:
The importance of undertaking an initiative by the foreign filial of Ministry of Commerce to prepare modern adequate studies about the important export sectors in the Kingdom of Saudi Arabia, in order to be ready to protect such sectors legally in cases of claims, by delivering them perfectly, preparing the specialized legal cadres in the various fields and sectors of the organization in order to prepare the files of cases of disputes to the organization, present and plead such cases in front of panels .to benefit from the possibilities provided by the Secretariat of the Organization in the field of delivering the consultancies and legal experiences in the cases of disputes, to increase the awareness in the private sector so as to make it comply with the new international trade order, so as to compete with the other international sectors, without being liable to legal procedures from other country members in WTO.
