APPLICANT’S NOTICE OF MOTION: DIRECT ACCESS

BE PLEASED TO TAKE NOTICE that the applicant intends applying to this court for:

1 Direct access to it under s 167(6)(a) of the Constitution for the purpose of enabling the applicant to contend that subsection (aa) of S 1 of the Promotion of Administrative Justice Act, 2000 (APAJA2) is unconstitutional and invalid to the extent that the provision, properly construed, prescribes that the power of the President of the Republic to pardon offenders constitutes administrative action;

2 An order, conditional upon a finding by this court that s 1 of PAJA, properly construed, prescribes that the power of the President of the Republic to pardon offenders constitutes administrative action, that s 1 of PAJA is to that extent unconstitutional and invalid.

TAKE NOTICE FURTHER that within 10 days from the date upon which this application is lodged, the respondents may respond thereto in writing, indicating whether or not they consent to the grant of direct access and, if the application is opposed, the grounds for such opposition.

TAKE NOTICE FURTHER that the affidavit of Anne Edworthy will be used in support of the application.

TAKE NOTICE FURTHER that the applicant has appointed the offices of his attorneys of record set out below as the address at which he will accept notice and service of all documents in these proceedings.
