PLEASE TAKE NOTICE that the abovenamed applicants (“the Applicants”) intend applying to this Court, alternatively the Chief Justice, for an order condoning the late filing of the record referred to in paragraphs 2 and 3 of the Directions of this Honourable Court dated 19 January 2009, under circumstances

where such record should have been filed on Friday 20 February 2009, but was only filed on Monday 23 February 2009.

TAKE NOTICE FURTHER that no cost order will be sought in terms of such condonation application.

TAKE NOTICE FURTHER that the affidavit of PETER BASIL MURRAY and the annexures thereto will be used in support of the application.

TAKE NOTICE FURTHER that the Applicants have appointed the offices of their attorneys of record set out below as the address at which they will accept notice and service of all documents in these proceedings.
