APPLICATION IN TERMS OF RULE 10(4) OF THE RULES OF THE CONSTITUTIONAL COURT TO THE CHIEF JUSTICE FOR ADMISSION AS AN AMICUS CURIAE

PLEASE BE INFORMED that the South African Association of Consulting Professional Planners (“SAACPP”) hereby makes application to the Chief Justice for an order in the following terms:

1. That condonation be granted to the SAACPP for non-compliance with the forms, notice, service and time periods provided for in the Rules of this Court;

2. That the SAACPP be admitted as Amicus Curiae under the above case number;

3. That directives be issued in terms of Rules 10(4), 10(7), 10(8) and 10(9) of the Rules of the Constitutional Court;

4. Costs in the event of opposition; and

5. Further and/or alternative relief.

TAKE NOTICE FURTHER that the accompanying affidavit of LESLIE OAKENFULL, with annexures thereto, will be used in support thereof.

TAKE FURTHER NOTICE that the SAACPP has appointed the address at the end hereof as the address at which it will accept notice and service of all process in these proceedings.

TAKE NOTICE FURTHER that if you intend opposing this application, you are required to:

(a) notify the SAACPP’s attorneys in writing, within 5 (five) days of receipt hereof, of your intention to oppose this application;

(b) within 15 (fifteen) days after you have so given notice of your intention to oppose the application, file your answering affidavit, if any;

(c) appoint in such notification an address at which you will accept notice and service of all documents in these proceedings, provided that such an address is within 25km of the office of the Registrar.

If no such notice of intention to oppose is given, the SAACPP will request the Registrar to place the matter before the Chief Justice to be dealt with in terms of Rule 11(4) of the Constitutional Court Rules.
