PLEASE TAKE NOTICE THAT the applicant, Nedbank Limited, makes application to this Honourable Court for an order in the following terms:

1. Admitting Nedbank Limited as an amicus curiae in the matter;

2. Directing that Nedbank Limited may file written submissions on a date to be determined by the Court;

3. Directing that Nedbank Limited may make oral argument at the hearing of the matter;

4. Condoning Nedbank Limited’s failure to comply with the time period in Rule 10(5) of the Constitutional Court Rules; and

5. Further and/or alternative relief.

PLEASE TAKE NOTICE FURTHER that the affidavit of DIRK LOURENS COETZEE and the annexures thereto will be used in support of this application.

PLEASE NOTICE FURTHER that the applicant has appointed the offices of Cliffe Dekker Hofmeyr Inc at 1 Protea Place, Cnr of Fredman and Protea Place, Sandton, Johannesburg, as the address at which the applicant will accept notice and service of all process and documents in these proceedings.
