AFFIDAVIT

I, the undersigned,

KAREL JOHAN JANUARIE

do hereby make oath and say the following:

1. I am an adult male captain in the South African Police Service (“SAPS”). I have been stationed at Vredendal since the 2nd of May 2001. Before my transfer to Vredendal I was stationed at the South African Narcotics Buro, Belville. I have 20 years experience in SAPS.

2. The facts deposed to herein are true and correct and within my personal knowledge unless I state to the contrary or the context indicates otherwise.

3. I am deposing to this affidavit to supplement my affidavit filed in the forfeiture application (record pp 401 –403). I have read the affidavit of captain Johan Smit to be delivered with my affidavit, and confirm the correctness of the contents insofar as they relate to me.

4. I wish to add the following to clarify the process of commissioning of the affidavit of captain Johan Smit on 31 January 2001 in support of the application for a warrant to search the respondent’s premises:

4.1. At the time I left with captain Smit for Woodstock, the commissioning stamp had been affixed and the place (Bellville) and date (31 January 2001) had been added, but I had not yet entered the time, signed it or filled in his name and other particulars. Though it is therefore technically correct that I completed the commissioning in Woodstock at about 09h00, I submit that there was no attempt to

mislead the magistrate in this regard. This was simply an oversight on my part due to the confluence of circumstances on the day.

4.2. I was never a member of the investigation team into the alleged activities of the respondent. I did however assist captain Smit on two occasions during his investigation. I accompanied him to the airport when he first went to collect the chemicals which I later learnt were related to this investigation. As is apparent from this affidavit, I also accompanied him to Woodstock on the morning that the respondent was arrested. I did so due to standing instructions in SANAB that prohibited us from ever working alone. On both occasions the investigating team members were otherwise occupied and he requested me to accompany him. I should add that at that time I was also unaware that it is considered undesirable for members of the same unit to commission affidavits deposed to by members of that unit.
