An Act to amend the Loans for Fencing and Water Piping Act, 1938.

[Assented to 28th November, 1940.]

BE IT ENACTED by the Governor of the State of South Australia, with the advice and consent of the Parliament thereof, as follows:

1. (1) This Act may be cited as the" Loans for Fencing and Short titles.

Water Piping Act Amendment Act, 1940".

(2) The Loans for Fencing and Water Piping Act, 1938, as amended by this Act, may be cited as the " Loans for Fencing and Water Piping Act, 1938-1940".

(3) The Loans for Fencing and Water Piping Act, 1938, is hereinafter referred to as " the principal Act".

2. Section 12 of the principal Act is amended- Amendment of principal Act,

(a) by inserting after the word "loan" in the first line B.l2- thereof the words " made before the passing of the ~~too~e1and.

Loans for Fencing and Water Piping Act Amendment Act, 1940":

(b) by adding at the end of subsection (1) thereof the following passage : -

The amount for the time being remaining unpaid of every loan made after the passing of the Loans for Fencing and Water Piping Act Amend- ment Act, 1940, and the interest thereon, shall be, and until paid shall remain, a charge on the land in respect of which the loan is made.

3. Section 22 of the principal Act is repealed and the following section is enacted and inserted in the principal Act in lieu thereof : -

22. (1) Without any further appropriation than this section, the Treasurer shall pay to each of the district councils and vermin boards mentioned in the second schedule the amount shown in the said schedule opposite the name of each such district councilor vermin board.

(2) All claims of the Treasurer or the bank against any district councilor vermin board (whether such district council or vermin board is mentioned in the second schedule or not) in respect of any advances made under any repealed Act to such district councilor vermin board are hereby determined.

(3) All claims of any district council or vermin board (whether such district councilor vermin board is mentioned in the second schedule or not) against the Treasurer or the bank in respect of any advances made under any repealed Act to such district councilor vermin board are hereby determined.

5. The principal Act is amended by adding at the end thereof the following schedule : -

Amounts due to district councils and vermin boards in respect of advances made under Part V. of the Vermin Act, 1931-1936, and under the Loans for Fencing and Water Piping Act, 1938, and the corresponding provisions of Acts repealed by those Acts.
