RESOLUTION
The Minutes of the Development Assessment Unit Meeting of Council held on 4 April 2017 be confirmed.
ITEM-2 FURTHER REPORT - DA NO. 781/205/HC/C - SECTION 96AA(1) MODIFICATION TO AN APPROVED SELF STORAGE AND INDUSTRIAL DEVELOPMENT - LOT 32 DP 834050, NO. 324 ANNANGROVE ROAD, ROUSE HILL
RESOLUTION
The subject application be refused as follows:
1. The proposed modification is inconsistent with The Hills Local Environmental Plan 2012 in regard to the aims of the plan in that the proposed modification will be contrary to the aim ‘To guide the orderly and sustainable development of The Hills, balancing its economic, environmental and social needs’ (Section 79C (a) (i) EP and A Act, 1979).
2. The proposed modification is inconsistent with The Hills Local Environmental Plan 2012 in regard to the aims of the plan in that the proposal will be contrary to the aim ‘To provide for the development of communities that are liveable, vibrant and safe and that have services and facilities that meet their needs’ (Section 79C (a) (i) EP and A Act, 1979).

within the area (Section 79C (b) EP and A Act, 1979).
4. The proposed modification is contrary to the public interest Section 79C (e) EP and A Act, 1979).
5. Council only has the power to impose a Section 94 contribution if it is determined in accordance with the relevant Contributions Plan. It has no discretion to impose a lesser contribution. (Section 94B(i) EP and A Act, 1979).
