DECISION

The application be approved subject to conditions outlined in the report.

PUBLIC NOTIFICATION OF THE DETERMINATION PURSUANT TO ITEM 20(2)(c) AND (d) OF SCHEDULE 1 OF THE ENVIRONMENTAL PLANNING & ASSESSMENT ACT, 1979

DECISION

The Section 4.55(1A) Modification Application be refused for the following reasons:

1. The proposed modification application does not meet the requirements of Section 4.55(1A) and Section 7.11 of the Environmental Planning and Assessment Act, 1979 as it is considered that the contributions have been appropriately applied to the application and the proposed modification to Condition No. 32 is not warranted.

(Section 4.15(1)(a)(i) of the Environmental Planning and Assessment Act, 1979).

2. The proposed modification is not considered to be in the public interest as it has the potential to adversely impact on the provision of services.
