SUMMARY OF REPORT:
At its meeting held on 25 September 2012, the Trust resolved to grant a lease for a term of ten years over Crown Reserve 140049, reserved for kindergarten purposes.
Since that time, the Pottsville Community Pre-School has received funding and have been granted approval to extend the pre-school buildings. This required the extension of the Crown Reserve from surrounding Crown Land, which was achieved by the subdivision of that land to create a larger parcel and the addition of those areas to Crown Reserve 140049.
Gazettal of the addition was gazetted on 15 June 2018.
This report relates to the surrender of the 2012 lease and entering into a new lease for the new area of Crown Reserve 140049.
RECOMMENDATION:
That the Tweed Reserves Trust:
1. Approves the granting of a 20 year lease to the Pottsville Community Pre-School over Lot 1 DP 1240808 at the statutory minimum rent of $491 per annum.
2. Executes all necessary documentation under the Common Seal of Council.

The Trust approved these additions by resolutions made on 19 June 2014 and 21 August 2014, these reports are annexures to this report for background information to this report.
DP 1240808 was registered on 19 April 2018, the plan is shown below:

Gazettal of the addition was gazetted on 15 June 2018.
As the area to be leased has been increased it is necessary for the Pre-School to enter into a separate lease for Lot 1, note that the former area leased to the Pre-School is that area marked “M” in the plan, being within the southern part of Lot 1, which is the original area of the Pre-school.

Page 7 The Pre-School is finalising final certification to enable commencement of construction of the new building.
It is recommended that the Trust approves the granting of a lease for a term of twenty years, at the statutory minimum rent, payable as the Pre School is a not for profit body, and they will be bearing all costs to maintain and repair all improvements within the leased area.
The Preschool obtained government funding for the extension to the preschool, and require secure long term tenure under the agreement.
OPTIONS:
1. To accept the surrender of the current lease and to approve the granting of an alternative lease for a term of twenty years.
2. To not approve the granting of a twenty year lease.
CONCLUSION:
In light of the long term financial commitment by the Pre School to the provision of pre-school services to the Pottsville community, it is recommended that the Trust approves the acceptance of the surrendered current lease and the granting of a new twenty year lease.
COUNCIL IMPLICATIONS:
a. Policy:
Corporate Policy Not Applicable.
b. Budget/Long Term Financial Plan:
The rental to be charged for the leasing of this land will be the statutory minimum of $491 per annum. All costs for the maintenance of the leased area will be borne by the Pre School.
c. Legal:
The Pre-School will lease the land under a standard Crown Lands lease.
d. Communication/Engagement:

The intention to issue a lease to the Pre School was advertised in the Tweed Link on 12 June 2018. No submissions have been received in response.
