ABSTRAK
Transportasi dan infrastruktur merupakan salah satu aspek yang berkesinambungan dan berkelanjutan dalam aspek ekonomi dan pembangunan negara. Dalam pengelolaan dan pelaksanaannya transportasi dan infrastruktur pemerintah melibatkan pihak swasta dengan melakukan konsesi. Salah satu cara yang digunakan adalah tender dalam melibatkan pihak swasta, adanya pelaksanaan tender maka timbul persaingan usaha antar pelaku usaha. Agar terjadi persaingan usaha sehat, dalam hal ini komisi pengawasan persaingan usaha (KPPU) merupakan lembaga yang berwenang untuk melakukan pengawasan dan menjatuhkan sanksi. Berkaitan dengan hal tersebut, maka melalui studi kasus ini penulis mencoba mengangkat permasalahan hukum dari putusan KPPU No.12/KPPU-L/2010 mengenai dugaan persekongkolan tender berkaitan pengadaan barang dan jasa bidang bina marga dinas pekerjaan umum di Kabupaten Rejang Lebong. Penelitian bertujuan untuk menganalisis putusan KPPU, serta bagaimanakah putusan No.12/KPPU-L/2010 dikaitkan dengan UU No. 5 Tahun 1999.
Penelitian ini bersifat deskriptif analistis yaitu menggambarkan secara menyeluruh dan sistematis mengenai UU No. 5 Tahun 1999 dikaitkan dengan teori hukum dan praktik. Pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif, yaitu dititikberatkan pada studi dokumen dalam penelitian kepustakaan untuk memepelajari data sekunder yang terkumpul berupa bahan-bahan yang ada kaitannya dengan permasalahan yang diteliti.

ABSTRACT
Transport and infrastructure is one aspect of a continuous and sustainable economic and development aspects of the country. The study aimed to analyze the Commission's decision, and how decisions No.12/KPPU-L/2010 associated with Law no. 5 of 1999.
This is a descriptive analytical study that comprehensively and systematically describes the Law. 5 of 1999 associated with the theory and practice of law. The approach used in this research is normative, that is focused on the study of research papers in the literature for the study of the secondary data collected in the form of materials that are related to the problems studied.
