P.e-ｰｵ｢ｬｾｫ＠ ｬｮ｡ｯｮ･ｳｩｾ＠ ｾ･ｲｬ｡ｫｳ｡ｮ｡＠ aengan sempurna , memberikan kepaJa Pemerintah Republik I ndonesia kredit sebesar

£ 10 . 700 . 000 , - den0 an kata sepuluh djuta tudjuhrat us r i

-bu pound sterling/satu pound sterling berisi 2 , 4882$ gr am emas murni/untuk pembelian oaik mesi n- mesin dan alat - alat perindustrian batii pemoan unan pabrik- pabrik lengkap jang dikirim dari Pol=ndia ke Indonesia maupun djasa- djasa jang berhubungan dengan pemuangunan projek- projek tersebut . Kredit tersebut akan meliputi 80 persen harga f . o . b . d-ri perjerahan tersebut aiatas .

Selandjutnja Pemerintah Republik Indonesia akan membe-ri tahukan kepada Pememembe-rintah Republik Rakjat Polandia nama-nama perusahaan- perusahaan Indonesia jang diberi kuasa untuk membuat kontrak-kontrak dalam persetudjuan ini jan6 tidak akan melampaui djangka waktu dalam tiga bulan setelah persetudjuan ini mulai berlaku .

Apabila djumlah harga dan djasa- djasa jang akan dibia-jai oleh kredit sebagai tersebut dalam kontrak - kontrak itu melebihi djumlah kredit jaitu £ 10 . 700 . 000, - maka djumlah kelebihan ini akan dibajar dengan tjara jang akan disetudjui oleh kedua Pemerintah .

Penjerahan barang- barang menurut persetudjuan ini akan dibajar oleh pihak Indoresia menurut pokok- pokok dibawah ini :

a . 5 persen harga f . o . b . tiap kontrak akan diba-jar dimuka dalam JO hari setelah kontrak jang bersangkutan ditanda tan5ani ,

persen harga f . o . b . tiap kontrak akan diba-jar pada waktu penjerahan terachir mesin- mesin dan alat - alat jang diperlukan untuk mendjalan-kan pabrik jang bersangkutan atas dasar penje-rahan dokumen - dokumen asli jang disjaratkan oleh masing- masing kontrak dengan satu irrevo-cable letter of credit den0 an mengidjinkan

pengiriman berkala , dibuka oleh Bank Indonesia pada Narodowy Bank Polski ,

c . SO persen harga f . o . b . akan dibajar dengan de -lapan angsuran jan6 sama besarnja dengan draft tersebut dalam Pasal

Angsuran- angsuran selandjutnja akan dibajar pada achir tiap waktu 12 bulan berturut- turut .

d . Apabila ada penjerahan barang- barang dari ne-gara ｫ･ｾｩｾ｡＠ untuk melengkapi penjerahan ｢ｾｲ｡ｮｧ ﾭ

barang Polandia jang disetudjui dalam

kontrak-ｫｯｮｴｲｾｫ＠ jane dibuat antara pihak pihak Indo -nesia dan Polandia, maka harga penjerahvn ini akan tidak dimasukkan dalam kredit , tetapi ak3n dibi:.jar oleh importir Indonesia menurut waktu dan sjarat jang sama sebagaimana halnja eks -portir Pola4dia harus membajarnja pada pendjual dari negara ketiga .

Pemb·jaran kembali kredit akan didjarnin olch draft j ang meliputi tiap ｾｮｧｳｵｲ｡ｮ＠ tersendiri .

DrAft tersebut akan ditarik oleh eksportir Polandia pada importir Indonesia jru;g dikuasakan dan diterima oleh im-portir tersebut disertai tanda aval oleh Bank Indonesia . Draft jang ditarik demikian itu akan diberi domisili di London .

Pembajaran ｢ｵｮｾ｡＠ terachir akan diadakan pada waktu j&n₀ sama dcngan pembajaran kembali angsuran kredit terachir .

A G R E E M E N T

ON ECONOMIC COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INOONESIA AND THE ｇｏｖｅｒｎｍｅｾ ｔ＠

OF ThE POLISH PEOPLL ' S REPUBLIC

The Government of the Republic of Indonesia and the Government of the Polish People ' s Republic having i n mind the friendly relations between both countries and beine desirous of achieving the closest possible cooperation in the economic and technical fields on the basis of equality and mutual benefit , have agreed as follows :

Article 1

The Government of the Polish People ' s kepublic

endeavouring to contribute to the successful implementation of the development plans of the Republic of Indonesia extends to the Government of the Republic of Indonesia a credit up to the amount of£ 10 . 700 . 000 . -.- in words ten million and seven hundred thousand pounds sterlinb/one pound sterling contains 2 , 4882$ grams of fine gold/ for the purchases of machinery and industrial equipment for construction of complete plants to be delivered from Poland to Indonesia as well as services connected with the erection of these projects . ｾｨ･＠ said credit will cover 80 per cent of the FOB value of above mentioned deliveries .

Article 2

The plants for which deliveries of machinery and equipment will be covered by the present Agreement are

specified in the Appendix attached , constituting an integral part of the ttgreerrent .1 The contracts on the deliveries of goods

mentioned in Article 1 will be concluded between the Polish

Foreign Trade Enterprises authorised by the Government of ｾｨ･＠

Polish People ' s Republic and the Indonesian state organizations , named and authorised to this purpose by the Government of the Republic of Indo nesia , successively up to but not later than December 31st , 1963 .

-To this end the Government of the Republic of Indonesia shall communicate to the Government of the Polish People ' s Republic the names of the Indonesian organizations authorised to conclude contracts under the present hgreement not later than within three months after this Agreement has come into force .

Should the value of deliveries and services to be finan -ced under the credit stipulated by the contracts concluded exceeds the total amount of credit i . e . £ 10 . 700 . 000. -.- the amount in excess shall be paid for in such manner as may be agreed upon between both Governments .

Article 3

Deliveries of goods effected under this Agreement shall be paid by the Indonesian parties according to the following principles

a/

per cent of the FOB value of each contract shall be paid in advance within 30 days from the date of signing of the respective contract .

b/ 15 per cent of the FOB value of each contract shall be paid at the last substantial delivery of machinery and equipment necessary for putting the plant in question into operation upon presentation of valid documents provided for by the respective contracts under an

irrevocable letter of credit , providing part shipments , opened by the Bank Indonesia with the ｾ｡ｲｯ､ｯｷｹ＠ Bank Polski .

c/ 80 per cent of the FOB value of each delivery shall be paid in eight equal yearly instalments against drafts described in Article 4 .

The first instalment shall be paid at the end of twelve months period counted from the date of the Bill of Lading or other equivalent transport documents provided for by the

The next instalments shall be paid at the end of each successive period of twelve months .

d/ In case of subdeliveries from third countries for completion of the Polish deliveries as agreed upon in contracts concluded between Polish and Indonesian parties the value of these subdeliveries shall not be settled under the credit but shall be paid by the Indonesian importer at the same time and on the same conditions as the Polish exporter has to pay to the supplier from a third country .

e/ The value of freight and insurance , if any , shall not be financed under the credit but shall be paid by the

Indonesian importer in cash in conformity with the provisions of the Trade and Payments Agreement in force at the time of payment .

f / The value of services rendered by the Polish parties to the Indonesian parties according to the contracts

concluded under the present Agreement shall be paid for in the same manner as stipulated in paragraphs a/ , ｢Ｏ ｾ＠ and c/ of this Article .

Article

4

The repayment of the credit shall be secured by drafts covering separately each instalment . The drafts will be drawn by the Polish exporter on the authorised Indonesian importer accepted by the latter and provided with an aval remark by the Bank Indonesia . The drafts thus drawn will be domiciled in

London . In connection with the stipulations of Article J para c/ the above drafts shall be duly accepted , avalised and forwarded by the Bank Indonesia to the Narodowy Bank Polski one month before shipment of each part delivery .

Article 5

The credit dra:wn in accordance with Article 3 para c/ and f/ shall bear interest at the rate of 2,5 per cent per annum . The amount of interest shall be computed on June JOth , and

-December 31st , of each year on the amount of actually drawn credit . The date of the Bill of Ladin& covering each part delivery of machinery and equipment as well as the date of the invoice and/or certificate of acceptance in respect of services rendered shall be considered as the date of drawing the creait .

The amounts of interest thus calcul&ted shall be

communicated by the r.arodowy uank Polski to the Bank Indonesia and shall be ｾＺ｡ｩ､＠ within one month after receipt of the

respective statement . The last payment of interest shall be

effected simultaneously ｾｾｴｨ＠ the repayment of the last instalment of the credit .

11.rticle 6

All payments stipulated in Article 3 of the present Agreement as well as payments of interest shall be effected by the ｾ｡ｮｫ＠ Indonesia in pound sterling in accordance with the provisions of the Trade and Paymentsngreement in force on the day of paymtnt .

The aforesaid payments can also be effected , upon mutual agreement , between the Bank Indonesia and the Narodowy Bank Polski in other transferable currency . In such a case , the t.arodowy bank Polski will indicate its p<:irticular account to be credited by the 8ank Indonesia . Conversion of pound

sterling into other transferaole currency will be effected at the middle exchange rate of London Exchange ｙｾｲｫ･ｴ＠ quoted on the closing of a business day on the date of payment .

The Bank Indonesia and tre t .. arodowy Hank Polski will nutually agree upon the necessary banking procedure in oraer to put this J.greement into opt.ration .

The meetines will be held at the request of either Party i-1ithin t·.10 months from the date of such request alternatively in Warsaw and Djakarta .

Article lu

The preoent Aereement shall come iPto force on the date of its signing and shall be valid until all obligations arising from the implementation of this Agreement for both Governments are fulfilled .

For this purpose Polish Side has authorized the Polish Foreign Trade Enterprise CEhOP and Indonesian Side has authorized the Government agencies , directly connected \'ii.th the implementation of the above projects , to be named by the Indonesian Government .

With reference to the Agreement on Economic Cooperation between the Government of the Republic of Indonesia and the Government of the Polish People ' s Republic signed today I have the honour to state the following understanding reached between us :

In the course of negotiations the Indonesian Delegation has requested the Polish Delegation to postpone the payments due under the said Agreement in 1961 and 1962 up to the 1st of January , 1963 , with-out any charge of interest .

The Polish Delegation taking into consideration the existing friendly rel ations and close economic cooperation between the both countries has agreed to the above mentioned request .

In connection with the above it has been agreed that the postponed payments shall be effected on the 2nd of January , 1963 .

I shall be grateful if you would kindly confirm that this letter sets out correctly the understanding reached between us .

" Menundjuk Persetudjuan Kerdjasama Ekonomi antara Pemerintah Republik Indonesia dan Pemerintah Republik Rakjat Polandia jang ditanda tangani pada ha-ri ini , maka bersama ini kami sampaikan dengan hormat persesuaian paham jang ditjapai antara kita sebagai berikut :

Dalam perundingan- perundingan jane diadakan , Delegasi Indonesia telah mengadjukan permintaan pada Delegasi Polandia untuk menunda kewadjiban- kewadjiban pembajaran jang timbul karena Persetudjuan ini di tahun 1961 dan 1962 sampai pada 1 Djanuari 1963 , dengan tidak dipungut bunga .

Mengingat akan adanja hubungan persahabatan dan kerdjasama ekonomi jang erat antara kedua negara , Delegasi Polandia telah menjetudjui permintaan terse-but diatas .

Berhubung dengan hal tersebut diatas itu, ma-ka telah disetudjui bahwa pembajaran tertunda tersebut akan dilaksanakan pada tanggal 2 Djanuari 1963 .

Kami akan sangat berterima kasih apabila Jang Mulia suka menjatakan , bahwa jang tersebut diatas be-tul2 merupakan persesuaian paham jang tertjapai antara kita II •
