PENCABUTAN PENASEHAT HUKUM DALAM ARBITRASE DIKAITKAN DENGAN PUTUSAN MAJELIS ARBITRASE ICSID ATAS DASAR MEMBAHAYAKAN PERSIDANGAN DAN HUBUNGANNYA DENGAN
ARBITRASE DI INDONESIA
ABSTRAK
Arbitrase merupakan salah satu pilihan dalam menyelesaikan sebuah sengketa. Dalam suatu majelis arbitrase terdiri atas dua arbitrator dan satu presiden arbitrator yang dipilih oleh kedua arbitrator tersebut. Dalam suatu arbitration proceeding dapat terdapat penasehat hukum dari para pihak yang memiliki hubungan dekat dengan salah satu arbitrator yang dapat membahayakan integritas dari majelis arbitrase tersebut. Pengaturan atas challenge terhadap arbitrator memang dapat ditemukan, akan tetapi tidak ada pengaturan untuk sebuah majelis arbitrase yang dapat juga memiliki kuasa untuk mencabut seorang penasehat hukum dari sebuah perkara apabila partisipasi penasehat hukum tersebut dapat membahayakan integritas dari majelis arbitrase.
Penelitian ini bersifat deskriptif analisis, memberikan gambaran secara khusus mengenai kompetensi dan kelayakan dari sebuah majelis arbitrase dalam memutuskan sebuah sengketa arbitrase tanpa adanya unsur bias dan dapat timbulnya justifiable doubts atas posisi para arbitrator. Hal ini akan dicapai dengan menggunakan metode pendekatan yuridis normatif yang menitikberatkan pada data sekunder dan data kepustakaan sebagai sumber utama serta hukum positif yang berlaku seperti peraturan yang terkait dengan permasalahan dalam penelitian ini seperti putusan yang dibuat oleh Majelis Arbitrase ICSID dalam kasus Hrvatska Electroprivreda, d.d v. The Republic of Slovenia (2008) dimana David Mildon QC, penasehat hukum dari Slovenia, dicabut dari posisinya. Penelitian ini dilakukan secara normatif kualitatif untuk mencapai kejelasan masalah yang akan dibahas dengan didasarkan pada asas-asas hukum serta norma-norma hukum dan memberikan uraian sistematis yang berhubungan dengan objek penelitian dalam bentuk uraian.
Penelitian ini dibuat untuk menunjukan tindakan apakah yang harus diambil oleh sebuah majelis arbitrase terutama majelis arbitrase di Indonesia, apabila timbul sebuah situasi dimana tidak ada ketentuan yang mengatur situasi tersebut. Dalam kasus Hrvatska, majelis arbitrase ICSID mengambil keputusan berdasarkan Pasal 41 Ayat 1 dan Pasal 44 dari Konvensi ICSID untuk mencabut partisipasi dari seorang penasehat hukum.
THE REMOVAL OF LEGAL COUNSEL IN ARBITRATION IN CONNECTION WITH ICSID ARBITRAL TRIBUNAL’S DECISION THAT MIGHT JEOPARDIZE THE ARBITRATION PROCEEDING AND ITS CONNECTION

Arbitration is one of the choices in settling a dispute. Within an arbitration tribunal, it may consist of two arbitrators and one presiding arbitrator which was appointed by those two arbitrators. In an arbitration proceeding, there might be a situation in which the legal counsel of one of the party has a close relationship with one of the arbitrator in which it could jeopardize the integrity of that arbitral tribunal. The regulations of challenge towards arbitrators may be found, however, there are no regulation in which an arbitral tribunal may have the power to remove a legal counsel from a case if his or her participation may jeopardize the integrity of the arbitral tribunal.
This research was a descriptive analysis research, providing a specific picture regarding the competence and worthiness of an arbitral tribunal to decide on an arbitral proceeding without bias and the possibility of creating justifiable doubts toward the position of the arbitrators. This point may be achieve through the judicial normative method which is strengthened on secondary data and library data as the main source as well as positive law that is regulated such as the case in this research which is the decision that was made by the ICSID Arbitral Tribunal in the case between Hrvatska Electroprivred, d.d. v. The Republic of Slovenia 2008 where David Mildon QC, the legal counsel of Slovenia, removed from his position. This research is performed in qualitative normative method to reach the clarity of the issue that will be discussed based on legal principle as well as legal norms and provide systematical description that relates to the object in research in descriptive form.
This research is made to show what steps that needed to be taken by an arbitral tribunal, especially arbitral tribunal in Indonesia, if there is a situation in which there are no specific regulations to regulate it. In Hrvatska case, the arbitral tribunal took the initiative based on Article 41 (1) and Article 44 of the ICSID Convention to remove the participation of a legal counsel
