MINISTER OF ENERGY AND MINERAL RESOURCES NO. 145A K/05/MEM/2002 AND THE
MINISTER OF INDUSTRY AND TRADE
NO. 104/MPP/Kep/2/2002 DATED FEBRUARY 19, 2002 ON
THE COMMUNICATIONS FORUM FOR USING DOMESTIC PRODUCTS IN THE ENERGY AND MINERAL RESOURCE SECTOR
THE MINISTER OF ENERGY AND MINERAL RESOURCES AND
THE MINISTER OF INDUSTRY AND TRADE Considering :
a. that in the framework of encouraging the use of domestic products, particularly in the procurement of goods and provision of services in the energy and mineral resource sector, it is necessary to take integrated inter-sectoral efforts in studying and formulating policies on the enhancement of the use of domestic products;
b. that in order to ensure the smooth execution of the task as meant in letter a, it is necessary to set up a communications forum for the use of domestic products in the energy and mineral resource sector in a joint decree of the Minister of Energy and Mineral Resources and the Minister of Industry and Trade.
In view of :
1. Law No. 11/1967 on mining basic provisions (Statute Book of 1967 No. 22, Supplement to Statute Book No. 2831);
2. Law No. 5/1984 on Industrial Affairs (Statute Book of 1984 No. 22, Supplement to Statute Book No. 3274);
3. Law No. 15/1985 on Electricity Affairs (Statute Book of 1985 No. 74, Supplement to Statute Book No. 3317);
4. Law No. 22/2001 on Petroleum and Gas (Statute Book of 2001 No. 136, Supplement to Statute Book No. 4152);
5. Presidential Decree No. 17/2000 on the realization of the state budget of revenue and expenditure;
6. Presidential Decree No. 18/2000 on Technical Directives for Procurement of Goods and Provision of Goods of Government Institutions;
Cabinet;
8. Presidential Decree No. 102/2001 on the Status, Tasks, Functions, Authority, Organizational Structures and Working Arrangements of Ministries;
9. Presidential Decree No. 109/2001 on First-echelon Organizational Units and Tasks of Ministries.
Observing :
Results of bilateral meeting between the Minister of Energy and Mineral Resources and the Minister of Industry and Trade on October 30, 2001.
DECIDES : To stipulate :
FIRSTLY :
To establish the Communications Forum for the use of domestic products in the energy and mineral resource (ESDM) sector, hereinafter called the Communications Forum with the members and sector groups as contained in the attachment to this decree.
SECONDLY :
The Communications Forum as meant in FIRST Dictum shall have the following tasks :
1. To foster and direct in the framework of enhancing the use of domestic products in the procurement of goods and provision of services in the ESDM sector through :
a. the empowerment of national integrated design, procurement and construction service providers/EPC;
b. the empowerment of national companies by means of improving systems of procurement of goods and provision of services;
c. the enhancement of the supervision system.
1. To make inventories of problems in accordance with the respective sectoral groups in the procurement of goods and provision of services in the ESDM sector connected with the use of domestic products;
2. To study the problems as meant in point 2; and
3. To formulate results of the study as meant in point 3 in accordance with the respective sectoral groups.
THIRDLY :
In order to support the execution of the tasks of the Communications Forum, the Chairman of the Communications Forum can establish, appoint and replace the secretariat and members of the secretariat.
FOURTHLY :
a. Chairpersons of the respective sectoral group shall be responsible and obliged to convey written reports to the Chairman of the Communications Forum;
b. The Chairman of the Communications Forum shall be responsible and obliged to convey written reports to the Minister of Energy and Mineral Resources and the Minister of Industry and Trade.
FIFTHLY :
The meeting of the Communications Forum shall be he ld every three months for the first-echelon level and every six months for the minister level or in accordance with the need and interest coordinated by the Chairman of the Communications Forum.
SIXTHLY :
The Communications Forum shall execute its tasks starting from the date of stipulation of this joint decree to December 31, 2002.
SEVENTHLY :
All costs needed for the execution of the tasks of the Communications Forum shall be borne by budgets of the Ministry of Energy Mineral and Resources and the Ministry of Industry and Trade.
EIGHTLY :
This joint decree shall come into force as from the date of stipulation. Stipulated in Jakarta
